Hi folks, The cult lawyers Moxon & Kobrin is continuously complaining to my ISP's in USA and Norway. In Norway they have yet another law firm to send out their complaints (Simonsen Musaeus in Oslo). In Norway the are complaining about the Photoalbum at:
http://home.kvalito.no/~xenu/archive/photoalbum/ I don't understand why they want to continuously give this page all the attention, it's thanks to them it's so well visited. Information wants to be free!
My US ISP is getting about one call a week about Operation Clambake from the cult lawyers and they have moved on to challenging my use of their trademarks in meta tags etc and have also asked that me be terminated as a repeat offender, which my US ISP have declined to do. The cult have been trying to silence me for 4 years now, when will they learn that it's just petrol on the fire?
Here is my latest reply to the lawyer representing my US ISP:

Thanks for the fax. Interesting claim from Paquette, since it
makes false accusations against me. I removed the mentioned
file last time she complained and changed the link in the HTML
file to this Norwegian copy of the image:
http://home.online.no/~heldal/CoS/scientology.gif If Paquette had only done her homework she would see this easily by checking the source file:
http://www.xenu.net/images/index.html Ask the people at Verio check the file date and you will see that I haven't changed it since August 16 2000. Her complaint to you is dated September 20 2000. Please tell this cult lawyer that the image in question was removed as requested the first time (and as I confirmed to you that I would) and that it since has not been located on Verio's server. You could tell her to do her research more careful so that she does not have to waste your time with nonsense.
But since she reminded me of this I did her the honor of retouching my image and put a new version back on my account at Verio. You can see it here:
http://www.xenu.net/images/scientology.gif This time the Hubbard head is taken from the front page of the critical book "Bare-Faced Messiah" which you can see here:
http://home.kvalito.no/~xenu/archive/books/bfm/bfmcover.htm Please let me know if you want to get a confirmation from the author Russell Miller that I am allowed to use it. At least the cult can't complain about this one.
As for these two:

http://www.xenu.net/archive/banners/oc19.gif
Is she seriously telling you that one is not allowed to use
these public symbols in a non-commercial way? Let me know if
this too has to be removed according to the DMCA and I'll
either link to one of the many foreign copies or retouch them
too. This is like not being allowed to say "Scientology"
because that would infringe their trademark. Where did free speech go?
Best wishes,

http://www.xenu.net/news/ Here's a quick resume:
SEPTEMBER 4 2000: Letter to Norwegian ISP Only available in Norwegian, sorry. They complain about the Photo album at http://home.kvalito.no/~xenu/archive/photoalbum/ Strangely they claim they are unable to document the agreement/ contract between their client (the cult) and the photographer due to "confidentiality decisions" and instead the describe it and quote from the Highwind and Impact magazines. As to the agreement between their client and the photographer they use a quote mentioning CSI. They then say that neither they or their "Swedish colleague Per Magnusson" (a cult lawyer Zenon knows very well!) "will have any problems confirming the contract". The continue: "[Therefore] it should be unnecessary to waste time and money to enter legal proceedings. Even if your client does not want to spend money on this case, any legal [initiative] from our part will inflict considerable cost for Kvalito IT AS [my ISP]. It would therefore be in our common interest to avoid this [haha, a threat]. I have also understood [...] that Kvalito IT AS has the necessary resources in their contacts to endure this without much risk."
Yeah, stupid cult, you should think twice before challenging any Norwegian vikings! ;) Then he ends with a line about him expecting them to close my site. And pigs can fly...
SEPTEMBER 5 2000: Letter from Paquette to US ISP lawyer Requesting reply to previous DMCA notice and express a wish to communicate directly with the ISP's General Counsel.
SEPTEMBER 11 2000: Letter from Paquette to US ISP lawyer Again requesting a reply on the previous DMCA notice.
Complaining about the NOTs 34 analysis and a couple of the banners I've made that has a Scientology cross and the SC triangle symbol. Also repeats her silly complaint about me using their trademarks (eg. "SCIENTOLOGY" and "DIANETICS" I assume) as meta tags. My ISP got some brains and does not share their opinion that this is trademark violations.
SEPTEMBER 20 2000: Letter from Paquette to US ISP lawyer Another complaint about this image:
http://home.online.no/~heldal/CoS/scientology.gif The problem is that this file is not on the US site, it's on one of my Norwegian accounts, the page she quotes just has a link to that image! Silly cult lawyer, she's probably just doing this to harass and generate a revenue. The file date easily proves to the ISP that it has been like that since the first time they complained. But since she reminded me I made a new version of the image where I used the Hubbard picture from the front page of Russel's book and put the image back on the US server. So much for her foot bullet strategy to stop me. Based on her own incompetence she argues in the letter that due me committing "the same infringements over and over" that my ISP should cancel my account. Watch it Paquette, I could sue you for false testimony here!
Best wishes to you all!
Andreas
