Update: 08/21/00
Today, almost a month after my initial battery complaint against Dennis
Heath Clark was filed with the Clearwater PD, I called State Attorney
Bernie McCabe's office again to see whether they had the case. I was
told that they still did not have it, even though a complaint filed two
days prior against Clark has been in their hands since 08/07/00. This
time I spoke with a very helpful victim's advocate, and she got on the
phone and helped figure out what was going on...
I was told that on 08/07/00, the case was personally delivered to the State Attorney's office by a worker from the Clearwater PD. It supposedly was hand-delivered to an attorney in the State Attorney's office by this worker. However, the person who receives the reports and inputs them into the computer never got the file. It just disappeared after being handed off to the mysterious "attorney" in their offices.
Normally it would go into the "in box" for the clerk or whatever her title is, she would input it into the system, and it would be in line for assignment and investigation. Instead, it was evidently intercepted by an "attorney," and was never seen again.
I will hold off on any accusations, as I only have the above information to go on. The Clearwater PD is now forwarding another copy of my complaint, and I have been assured that it will receive prompt attention and will be rushed through the system, because of this delay. Everyone I spoke with was very helpful, and returned my calls the same day. They genuinely were surprised that this case file had vanished, and apologized profusely. I don't blame the Clearwater PD or the State Attorney's office, as I think there are other forces at work here that are beyond their control. It does strike me as incredibly coincidental that a Scientologist posted personal information about me (that could not have come from any other source) to ARS shortly after this file evidently "disappeared."
I have been told that they should have the case by this Wednesday.

Today (8/22/00), the copy of my complaint against Dennis Heath Clark was received by the State Attorney's office, and it has been assigned. It was too late in the day for me to speak to the attorney, so I will call back tomorrow (Wed.).
What I am still trying to find out is where exactly the first one went...I was told it was taken to the "satellite office" for the State Attorney at the Clearwater PD, to later be taken to the actual main office for input into the system and for assignment to an attorney for investigation and (presumably) prosecution. Somehow, it vanished after the Clearwater PD records clerk left it on the desk of the State Attorney working at the police station that day. It never made it to the main office. I plan to dig a little further, maybe talk to everyone that was there that day to see if they have any ideas as to what happened to it. Maybe it is behind the filing cabinet, or possibly the dog ate it...

The SAO denies any involvement, they mainly use space at the CWPD for interviews and such, and this office is where this report was left, so I have been punted back to the police dept. regarding the missing report.
Meanwhile, I was innocently misinformed about my case being assigned an attorney, that was the case from 2 days prior against Clark. Mine should have an attorney assigned in the next 2 days, but I am told it could take 2 more weeks for any real progress.
Let's hope the dog doesn't eat the attorney!

I seriously believe that this will be investigated to the best of their ability,
the Sgt. I discussed this with was very professional, and he takes security
breaches very seriously. This may result in a change of procedures or tightening
of security at CWPD, any number of outcomes is possible.
Meanwhile, I will be waiting another 2 weeks, according to Bernie McCabe's office,
before I can even speak with the attorney on my battery case. Something about a
priority system...more serious cases are priority, which I can understand. In the
big scheme of things, this battery is a minor case. I just have a hard time
understanding how something like Bob Minton's accidental contact with a picket sign
gets such a whirlwind of attention and prosecution, including his high-profile
arrest... yet in my case, I have good video of the battery, a witness, and Clark
goes on to continue harassing, menacing and assaulting others without being
arrested...and I have to wait 2 more weeks, after already waiting a month for
something to happen...
At least I know I am not alone in thinking there is something wrong with this
picture.

I received a call back from internal affairs, and they seem sincere in wanting to
investigate this missing report. However, I will predict the outcome, based on my
conversation: The office where the report disappeared is not in a secure area of
the CWPD due to its nature, it is in an interview area for State Attorneys that is
open to the public. They will likely be unable to conclusively determine where the
report went. POOF! Into thin air (or a thick briefcase).
