The following are the Findings and Recommendations: HIGH CRIMES: 1. Continued adherence to a person or group accurately pronounced a Suppressive Person or Group by HCO. The Interested Party pleads NOT GUILTY. The Committee concurs as there was insufficient evidence. 2. Organizing splinter groups to confuse people about the true beliefs and practices of Scientology or to deceive them into considering that they will be able to study part or all of Scientology or receive standard Pastoral Counselling from the splinter group. I/P pleads NOT GUILTY. The Committee concurs due to insufficient evidence. 3. Organizing splinter groups which take and pervert Scientology materials or practices, in whole or in part, still calling it Scientology or calling it something else. I/P pleads NOT GUILTY. The Committee concurs as insufficient evidence found. 4. Seeking to splinter off an area of Scientology and deny it properly constituted authority for personal profit, personal power or to "save" Scientology. I/P pleads NOT GUILTY. The Committee concurs due to insufficient evidence. 5. Engaging in malicious rumour-mongering to destroy the authority or repute of one's fellows or executives of Scientology Churches or Missions or Organizations. The I/P pleads NOT GUILTY. The Committee finds him GUILTY. Steve testified to the Committee that his juniors, the EDs of Salt Lake City Mission, University Way Mission and Seattle Mission knew of Steve's disagreements with SMI's management and with the actions of the 17 October Mission Holder Conference in San Fransisco (see SO ED 2188 INT for details of the Conference itself). Steve did not write up his disagreements but instead nattered about these to his juniors. He did this again during the course of the Committee of Evidence and voiced his disagreements on the Comm Ev proceedings to these same Eds. This constitutes malicious rumour mongering particularly since the natter occurred during the Committee of Evidence itself, not to the Committee, but to outside parties. Additional High Crime: As per HCO PL 7 Feb 65 Keeping Scientology Working Series: "Therefore actions which neglect or violate this Policy Letter are HIGH CRIMES resulting in Comm Evs on ADMINISTRATORS and EXECUTIVES." Steve did receive standard correction on Keeping Scientology Working after his personal involvement in implementing the squirrel Kingsley Wimbush "PTS Handling" tech in his missions, per testimony and per reports to the Committee. However, even after this Qual action, Steve has failed to keep this policy letter in by his failure to use standard Knowledge Reports. Steve also did lower conditions and received a sec check on this failure to Keep Scientology Working. By his own testimony he did not communicate any of his viewpoints and disagreements on the October 17 San Francisco Mission Holder conference even whilst being aware of these during his Sec Check. This was a known whithhold he kept from his auditor. Steve still had these disagreements and upsets whilst doing Solo NOTS. The HCOB on this is quite clear: "But now, against the Code there is a transgression. And so because the Code was held, whatever Code it was, and Man sought comfort in Man's company, he held back his deed, and so entered then the bourne in which no being laughs or has a freedom in his heart." Steve did not write standard Knowledge Reports on his juniors, as regards to known out-ethics, improper loan deals, holding onto Clears, etc., that he knew about, such as with John Balkin ex-ED Salt Lake City Mission. He has not implemented standard policy actions in the missions he is responsible for as adjudicated by statistics to expand these. Thus, he has put Scientology and Scientologists at risk in the areas of Seattle and Salt Lake City. Per HCO PL 26 Aug 82 KNOWLEDGE REPORTS "It is a failure of the individual group members to control their fellows that makes a group hard for all to live and work with." 2. Omissions or non-compliance requiring heavy intervention by seniors consuming time and money, with dev-t. I/P pleads NOT GUILTY. Committee finds him GUILTY. Steve's omitted Knowledge Reports on his juniors, as above mentioned and on his disagreements with policy and management per his own testimony and per reports received by the Committee has acted to require heavy intervention by key executives. This situation has been in existence since October 1982 per Steve's own report yet no action by Steve has been taken to handle. 3. Being or becoming a Potential Trouble Source. The I/P pleads GUILTY and the Committee concurs. Steve testified that he "feels PTS" and named a Scientology Unit and Scientologists in good standing. The committee did not have sufficient evidence as to who Steve is PTS to, but per HCO PL 2 June 1965 WRITING OF AN ETHICS ORDER, "if you name the wrong one or err in that it's a group not a person, the PTS won't disconnect." 4. Withholding from local Scientology executives that he or she is a Potential Trouble Source. The Interested Party pleads NOT GUITLY. The Committee finds him GUILTY. Steve has had 'PTS Indicators' since October yet took no action to handle per his own testimony. 5. Failing to report a Potential Trouble Source to local HCO. The Interested Party pleads NOT GUILTY. The Committee finds him GUILTY. The Interested Party has had 'PTS indicators' since October but has made no report to HCO on this and in fact withheld this data during his sec check, per reports received per his own testimony. These 'indicators' were not reported by Steve until the beginning of this Committee of Evidence. 6. Being a knowing accessory to a suppressive act. The I/P pleads NOT GUILTY. Committee concurs. Insufficient Evidence. 7. Following illegal orders or illegal local policies or alter-is, knowing them to be different or contradictory to those issued by the International Board. The I/P pleads NOT GUILTY. The Committee finds him GUILTY. Steve used squirrel admin in running his mission per reports received and per his own testimony using his own local policy rather than standard Policy Letters as written by the Founder. He refused to follow the comm lines and command lines as outlined in his Mission Charter agreements and thus violated HCO PL 25 October 1971 Iss I "Comm Routing, How to Tie Up a Whole Org and Produce Nothing" (page 405 OEC Volume 7). Steve's "Know Best" attitude contributed to the shrinking of the missions under his care and control rather than to the expansion of these using standard HCO PLs and HCOBs as reflected in the statistics of these missions. 8. Permitting a section, unit, department, or zone or division to collapse. The I/P pleads NOT GUILTY and the Committee concurs due to insufficient evidence. Whilst the missions under his care and control did not expand sufficiently they were not in a state of collapse. 9. Spreading destructive rumours about Senior Scientologists. The I/P pleads NOT GUILTY. The Committee finds him GUILTY. By Steve's refusal to apply HCOB 26 Aug 82 KNOWLEDGE REPORTS, and by his act of nattering to his juniors in his missions even during the comm ev called on him, he is guilty of this act. See data in High Crime 5 above. 10. Overworking an executive by ignoring one's duties. The I/P pleads GUILTY. The Committee concurs. Due to Steve's refusal to write Knowledge Reports, and spreading his discontent to others, he has seriously overworked executives. Additonally, the lack of these reports on other Mission Holders has lead to other Mission Holders being called before a committee of evidence (John Balken, Leo Dow, David Stokes, Joey Allesandrini). Had standard reports been written it is possible that lower ethics gradients could have been used to correct these individuals rather than allowing out-ethics to continue, thus leaving it to others and senior executives to handle. 11. Neglect or omission in safeguarding the copyrights, registered marks, trademarks, registered names of Scientology. The I/P pleads NOT GUILTY, and the Committee concurs. Insufficient evidence. 12. Neglect of responsibilities resulting in a catastrophe even when another manages to avert the final consequences. The I/P pleads NOT GUILTY. The Committee finds him GUILTY. The ED of Salt Lake City resigned his post during the committee of evidence called upon him (John Balken). Steve took no responsibility to handle this per his own testimony and in fact was not surprised that John Balken resigned. Steve took NO action to have John replaced and this was in fact left to D/CO Production SMI INT to appoint a new ED to prevent Salt Lake City Mission from a state of collapse. Steve thus neglected his responsibility as a Mission Holder. Additional Findings: Steve wrote a despatch of 15 Feb 1983 in which he originated he did not feel good about being the Mission Holder of the three missions and that he had a program to do to be able to have the responsibility as the Mission Holder. Steve has suspended himself from post. Steve did not do conditions except for Non-Existence as the Mission Holder, and did not do the MEST work that all Interested Parties were to do, as well he had not done any amends, or originated ethics handling himself. Recommendations: 0. [sic] That a non-enturbulation order be issued forthwith and that if one more report of natter or enturbulation is received he will be declared suppressive. 2. Steve is assigned a condition of Treason. 3. A full sech check to be done on Steve, HCO style, at his own expense. This sec check is to cover management, missions, and any other areas found in this comm ev. 4. Steve is to do amends of MEST work of 75 hours as assigned by HCO SMI. 5. Steve is to do his ethics handling, conditions and recommendations at SMI INT under the direction of the Dir I & R SMI INT. As part of this he is to write up all knowledge reports for everything he has data on. 6. Steve is suspended from any other training or processing until 3, 4 and 5 are done, and all his ehtics [sic] conditions are wrapped up. 7. Steve is to do M9 the Mission Holder Conference Transcript, under the direction and supervision of a supervisor. 8. A full PTS handling is to be done, as found earlier in this comm ev to full EP and no further PTSness seen or originated by Steve. 9. Steve is to report to SMI INT Qual for correction program whne complete with the above. Respectfully submitted to the Convening Authority.
