A long time ago -- back on August 1'st of 2001 -- I filed an FOIA request with the Food and Drug Administration attempting to find out what the current rules and regulations are governing the sale and distribution of the quack medical device that the Scientology cult markets known as their "e-meter."
Having heard nothing for over 5 months I sent an update to the FDA including a copy of the court transcript wherein the Judge ordered Scientology to apply quack medical labels on their quack medical device -- warning labels. Additionally I sent to the FDA newspaper articles of the FDA raids against Scientology for selling e-meters in their quack medical bunko scam, including a _photograph_ of Federal agents walking from the cult's business office to their (the Fed's) vehicles, their arms full of boxes containing seized "e-meters."
I received the following response to my FOIA request. I'm very interested in what activists think about this response given the lengths I went to to locate court documents on the Internet which covered lawsuit proceedings resulting in the very same Judicial mandats that I was in part looking for. I can see what they did to avoid filling the FOIA request and I'm sure that long-time activists will spot it right off.
Also I don't hold any animosity or hard feelings against the FDA for not finding the information since I understand why they could not find it -- or actually chose not to find it.

Re: FOIA Request No. 01-...cuts...flr
Dear Mr. Rice:
This is in response to your Freedom of Information Act request dated August 1, 2001, as reiterated by your follow-up letter dated January 4, 2002. Your request has been referred to our office -- the Office of the Chief Counsil.(sic) You asked for information on:
(1) The current rules and regulations governing the use of a medical device known as an "E-Meter."
(2) Specific court findings resulting from any criminal proceedings against the Church of Scientology relating to the "E-Meter."
(3) The possible existance of any non-public agreements between the Food and Drug Administration (FDA) and the Church of Scientology.
As with other federal agencies, FDA publishes its current rules and regulations in the Federal Register and the Code of Federal Regulations (CFR). The CFR is available on the Internet at www.gpo.gov/nara/cfg, from many libraries, or from the Government Printing Office at (888) 293-6498. FDA's regulations are contained in CFR Chapter 1, Subchapter 1, and those specifically governing medical devices are contained in 21 CFR Chapter 1, Subchapter H.
We conducted a search of our litigation tracking systems, and did not find any records relating criminal proceedings involving to (sic) the Church of Scientology. In addition, a search of our files did not find any records of agreements, either public or non-public, between FDA and the Church of Scientology.
Please note that these searches covered only the Office of the Chief Counsel and not other offices within FDA.
All communications concerning this request should be identified with the FOIA request number above and addresses as follows:
Food and Drug Administration Office of the Chief Counsel, GCF-1 5600 Fishers Lane Rockville, MD 20857
Sincerely yours.
