Foreword

Who hasn't seen them - the mass mailings with the picture of Albert Einstein and the assertion that we use "only 10% of our mental potential" or posters with the call to "Think for Yourself." Or on the street or squares you run into people wearing yellow t-shirts printed with "Volunteer Minister" of the "Scientology Church" who invite you into a big yellow tent. There's where you are supposed to make your first acquaintance with the mental-spiritual counseling in accordance with the methods of Scientology founder L. Ron HUBBARD. Or while you're stopped in the street for a "survey" from a company and you are offered a "free personality test". This comprehensive pseudo-scientific 200 question test from the "Scientology Organization" (SO) is for many only a first step, and it can have unforeseeable consequences for the individual. After the revelation of supposed personal inadequacies comes the offer of a reasonably priced course, during which more necessities for more expensive courses are "discovered." In the subsequent "auditing" sessions lasting many hours, the subjects turn into "clear" people.

Besides the risk to the individual, though, there's another aspect to take into consideration. The organization does claim to do more than just mentally "free" people individually. That is just the starting point for a political claim to sole representation, which Scientologists dogmatically trace back to Hubbard's writings. The SO primarily promotes the claim that a "new civilization" can be reached by means of its procedures. Based on the goal of making a social order that functions according to Scientology principles, which also includes the requirement for political power, the SO poses a risk to our liberal democratic basic order. Here the duty of the Verfassungsschutz (Office for the Protection of the Constitution) as an early warning system of a defendable democracy begins in the research and analysis of the risk potential of counter-constitutional endeavors.

The SO is continually trying to give the impression that it is a religious community that is "discriminated" against in Germany, for whom surveillance by the Verfassungsschutz is not compatible with Article 4 of Basic Law, which guarantees religious freedom. Actually, the question of whether a certain group is religious or not is incidental to surveillance. The decision for surveillance by the Verfassungsschutz has to do with whether or not an organization pursues counter-constitutional goals.

Observation by the State Office for Protection of the Constitution has brought a part of the "Scientology Organization that operates conspiratorially into the light, unmasked and "demystified" it. Its findings, since the beginning of surveillance in 1997, has contributed to materialization of discussion, which occasionally used to be compromised by previous risk scenarios. During the last six years, however, findings that the organization is deliberately working towards a totalitarian state system have solidified.

This publication by the State Office for the Protection of the Constitution is meant not only for those new to the theme of Scientology, but also for those who want to broaden their knowledge of the topic.

1. The History of the "Scientology Organization" (SO) The "Scientology Organization" originated with the US American Lafayette Ronald HUBBARD (1911-1986), an effervescent personality who spun a network of legends around his adherents. Even in his youth he is said to have explored and gained experience on long journeys. He made his public appearance in the 1940s as a moderately successful science fiction author. At the end of his service with the US Navy he requested psychotherapeutic treatment, which is possibly where he became acquainted with Sigmund Freud's psychoanalysis and his therapy processes. Out of fragments of those teachings and other psychological concepts he developed a method to manipulate the human psyche. In 1950 his book "Dianetics: The Modern Science of Mental Health" was published. In it he claimed that, with his methods, he could free the world from all evil, like war, crime, sickness and poverty. In the following years, HUBBARD supplemented his teachings with concepts of reincarnation, ideas from science fiction, conspiracy theories and teachings of social salvation. In 1954, he founded the first "Church of Scientology" in Los Angeles, which would bring him prestige and tax advantages. In subsequent years HUBBARD envisioned himself and his organization being increasingly surrounded by enemies.

In a decision that went into legal effect in 1978, HUBBARD was convicted of fraud in France. After his death in January 1986, Scientologists continued to come into conflict with the laws of democratic societies because of unethical operating methods and criminal activities, as court cases is various states show. After David MISCAVIGE replaced HUBBARD as organization boss in the beginning of the 1980s, the SO developed into a strictly managed network of "churches," business enterprises and other organizations.

2. The "Technology" of L. Ron HUBBARD

The writings on methods of operation, management and social techniques according to HUBBARD, as well has his Dianetics and Scientology teachings, which Scientologists refer to as "technology" or "tech," are composed of more than 20,000 pages. The core of his teachings is presented in standard works, such as "Dianetics" or "Introduction to the Ethics of Scientology." In the 13 volumes of the so-called "Technical Bulletins," besides political essays, are the fundamental "technical" instructions ("HCO Bulletins" [1]) for auditors [2]. The "Organization Executive Course") and the "Management Seminars" consist of several thousand pages of "HCO Policy Letters" which contain the general method of operation for management and administration ("Admin Tech") for Scientologists. The numerous course consist mainly of HUBBARD's policy letters; tape recorded lectures and various training films round out the "education" of the Scientologists.

At the core of HUBBARD's "Admin tech" is a totalitarian system of control. Intensive surveillance and discipline are obtained from personal "statistics" to assign "ethics conditions" to individuals. These "ethical" conditions of existence range from "power" and "affluence" down to "enemy" or "treason." [3] While staff with high statistics ("upstats"), in the Scientology method of thinking, are right no matter what the rules are, those with low statistics ("downstats") are subject to especially rigid procedures. [4]

The SO propagates portended ability for optimum control of political organizations and states with HUBBARD' administrative techniques, too. At the same time, HUBBARD's concepts spurn, in part subliminally, the principal of democracy and reveals socially Darwinistic ideology.

On the outside, the SO tries to give the impression that some of HUBBARD's writings are "old" and therefore no longer of significance. Actually, HUBBARD's instructions are law for dedicated Scientologists; those who disregard them face punishment. Policy letters and bulletins are <valid from the time they are published, unless they are explicitly cancelled>. [5] Policy letters are to be <applied without exception at a broad level for all organizations and Scientologists. (...) HCO policy letters do not expire, unless they are superceded or modified by later HCO policy letters. No representative and no Scientology staff may disregard policy, even if he is requesting a revision>. [6] Scientology even claims that it has etched HUBBARD's works in steel, to maintain them forever. [7] Besides that, HUBBARD's instructions are also followed by Scientologists because they believe that the use of this alleged superior technology will remove every obstacle from their path and will solve all problems.

The attempt to compromise the importance of HUBBARD's writings to outsiders, or even to pass them off as his "private opinion," are attempts at obfuscation from an organization marked by ideological strictness, who constantly seeks to convince its members that

- the salvation of humanity depends on the correct application of the "technology,"

- people before had not developed any usable mental "technology" (this was possible only for Hubbard),

- Scientologists are the only "ethical" group on the planet,

- non-Scientologists are "aberrated," [8] and are even described as a "mob" [9],

- Scientology is the only chance to save humanity.

The most important Scientology processes are "auditing," "security checks," "training routines," and training techniques like "word-clearing."

3.1 "Auditing" "Auditing" is the SO's central method by which it claims to create a "new person" and to remove undesirable perceptions, fears and psychosomatic pain, as well as to increase performance ability. This is the way that a perfect society, a "clear" state and a "new civilization" with people that function almost perfectly, called "clears," is supposed to be gradually built.

According to HUBBARD's theory, a person consists of body, mind and an immortal spiritual being, called a "Thetan." Every person possesses an "analytical mind," which HUBBARD said functions like a computer and is capable of solving problems, and also a "reactive mind," which is said to store painful and traumatic experiences ("engrams"), and which supposedly exerts influence over the individual. According to HUBBARD, "engrams" give rise to "aberrations," which Scientologists perceive to be debilitative deviations from "proper" behavior. Since, according to HUBBARD's theory, all people have a "reactive" mind as long as they have not been "cleared" by Scientology processes, non-Scientologists are considered to be "aberrated." These are the ones who are said to pose a potential risk to society.

In "auditing," the engrams are "erased" by mentally re-living the painful experiences and traumata, which then relieves the person's psychic pressure ("charge"). According to HUBBARD's teachings, people become "good" this way. The first step is to have the person become a "clear" by removal of the "reactive" mind. After that come various levels to become an "Operating Thetan" (OT). HUBBARD claimed that an OT was in complete control of his power and possessed superhuman abilities. Scientologists call the path up through the highest OT levels the "Bridge to Total Freedom." Individual "auditing" levels ("rundowns") can cost ten thousand dollars a shot.

"Auditing" is basically a combination of interrogation-type sessions and and some hypnosis-like psycho-techniques [12], wherein the "patient" and auditor sit facing each other. Most of the time it is carried out with a simple skin ohmmeter called the "e-meter." In "auditing" the subject is interrogated on themes, some of which are taboo, like sexuality. In giving reasons the subject also names people whose confidence has been gained, and whose reasons also have to be stated. It must be reckoned that the written minutes taken down during these sessions serve to "clear" not only the individual, but also his personal and professional environment. It is self-evident that a person who reveals intimate personal details risks extortion. In this connection the SO indicates that confidentiality is maintained, but the credibility of this statement is doubtful. For instance, Scientology "ministers" are supposed to forward to the "ethics" department written records of "unethical" dealings which have been revealed to them [13].

On February 22, 2002, the Belgian "Le Soir" newspaper reported that several thousand folders of Scientology adherents were confiscated in 1999 during a fraud investigation. After the SO, in a series of lawsuits, demanded the complete release of the documents, the Brussels court found that the contents of the folders confiscated from Scientology were in contradiction to the Belgian data protection law. The dossiers contained detailed medical information, reports on private life and sexual conduct, as well as statements about families and confessions which were taken from people on whom an "e-meter" was being used.

3.2 The "Hubbard Electrometer" ("E-meter") According to the official Scientology explanation, the "E-meter" relieves "spiritual" anxieties and measures the "spiritual" state of humans. It says the "E-meter" is not a lie detector. In an information letter not meant for public distribution, however, concerning the fight against terrorism, HUBBARD stated something quite different:

<What is really happening in there? It is a very sensitive, extremely modern version of the Wheatstone Bridge, which was invented a hundred years ago. It's use is constantly contested by 'liberals' and subversive groups. An outdated version of it exists today as a 'skin galvanometer' unit for a police lie detector. Those devices, however, are unwieldy and have an error rate of 9%.> [14]

HUBBARD claimed that the device used by the SO was less expensive and essentially improved, so that a greater number of people could be checked <when using it at a roadblock>, for example. <Compared to the old police lie detector, that is a big advantage, since the old lie detectors need about one hour per person.>

Further down in the same Information Letter, HUBBARD wrote of "E-meter" use:

3.3 "Security Checks" The "E-meter" is also used for "Security Checks" ("Sec-Checks" for short), during which "crimes" against the Scientology system are supposedly found. People who have left Scientology have told of a humiliating procedure in the form of non-stop interrogation, which can last for hours. The SO has numerous checklists for doing this. Questions posed by the "Joburg Confessional" include:

3.4 "Drills" and "Training Routines"

Another important element of Scientology techniques are the "Training Routines" (TRs), which deal with various techniques of behavioral conditioning. There is "Confront," for instance, in which the course participant and his training partner ("twin") stare at each other without moving. Other TRs are drills in meaningless communication, such as the incessant "acknowledgment" to the question, "Do fish swim?", or include screaming at an ashtray. In so-called "Bullbaiting," the course participant is supposed to remain motionless while being yelled at and insulted. [19] The trainer is not supposed to allow any interruptions to the stereotyped drills, which can last hours, but stoically fulfil his instructions. The subject sometimes has to endure humiliating procedures under the impression that they contain a scientific or logical explanation for this training routine.

There are also "training routines" for the instructor, or "coach." In the "Administrative Training Drills" [21], people are trained to carry out orders without compromise and without tolerating objections.

HUBBARD has accused psychiatry of wanting to condition people like a Pavlovian dog. In a moment of self-revelation regarding the "training routines" though, he once referred to a Scientologist handling a puppy with similar "TRs." The Scientologist, in exhausting the process of continually putting the dog's paw on the wall, did not end up "clearing" the dog, but he did manage to change the dog's behavior. Certainly it would have the same effect on a small child. [22]

3.5 "Wordclearing" - a alteration of thinking

"OPEN YOUR MIND!

And trust yourself!"

HUBBARD's "study technology" includes his "important note" contained at the beginning of his books books and courses that one should never go past a word one has not fully understood. Instead it[s definition] should be precisely cleared to avoid difficulties in learning and understanding. "Wordclearing" is a manipulative learning technique for which numerous words, such as "freedom" and "ethics," have altered meanings in HUBBARD's dictionaries. In this way people are taken step by step into a new Scientology manner of thinking, which alters one's own concepts of values.

The SO recognizes nine different methods of "wordclearing," all of which have the goal of "hammering" the Scientology meaning of a word into the course participant. The testing of whether the person has assimilated the word and has "correctly" understood it can occur with the help of an "E-meter." The widely used program imparts policy and directives in the form of a steady drumbeat. [23] Critical discussion or examination of the subject matter is not an option. The new word system is not to be questioned.

The "redefinition of words" is an attempt to change meaning, and thus consciousness:

<A long-time propaganda technique used by socialists (both Communists and Nazis) is of interest for PR people. (...) The trick is: WORDS ARE REDEFINED TO HAVE ANOTHER MEANING THAT FAVORS THE PROPAGANDIST. (...) They are not 'natural' alterations of the language. They are carefully planned and controlled alterations through propaganda, (...) If the new definition is repeated frequently enough, public opinion can be altered through the change of the word's meaning. (...) The redefinition of words is carried out so that one associated other emotions and symbols with words that were intended. (...) Two things have taken place on this account - the Scientologists redefine 'doctor,' 'psychiatrist' and 'psychology' to mean 'undesirable anti-social elements,' (...)> [24]

3.6 Ideological Re-education In a lecture on the basics of "auditing" Hubbard also mentioned the possibilities of exercising political power through "auditing." The purpose of his instructions is to take away any obstacle that auditors have, which includes researching people's most intimate secrets. HUBBARD bases this on the fiction that the path to a completely conflict-free society may be traveled by "clear" people. [25] It is apparent that Scientology wants to obtain comprehensive tests of people, by "auditing" or "sec checks," so that the organization may produce "x-rays" of their psyches.

Actually, Scientology's techniques are methods of indoctrination and serve the purpose of ideological reeducation. According to Scientology doctrine, mistakes or personal failures are based on insufficient or erroneous use of HUBBARD's handling instructions, and are the result of personal incapability. Processes of group dynamics and intensive peer pressure also plays an important role.

On top of this, individuals are only supposed to be aware of those policies or directives, some of which are confidential, that are necessary for their education level and for their function inside the hierarchy. While only a few top functionaries have the total picture at their disposal, as a rule, individual Scientologists have insight into only parts of the system.

3.7 Scientology Techniques in the Mirror of Medicine Medical experts have directed attention to HUBBARD's technique repeatedly. One opinion determined:

"An allegedly superior value system is imparted to them [the Scientologists]. This produces a perception of being elite, which leads to isolation from the environment. (...) Secrecy and the proximity of educational, organizational and supervisory hierarchies make the situation unfathomable for the individual, so that considerable internal pressure builds up, which originated with the hierarchy but is not provable at the specific individual level. (...) As a rule, people are guided into believing that disturbances in their well-being or in their dealings with Scientology in the outside world can be found in the form of 'suppressive persons' or 'potential trouble sources.'" [26]

Another opinion comments on "wordclearing" as follows:

"All the words of a sentence can be well understood in accordance with a dictionary but the sentence can nonetheless have no reasonable meaning or contain an abstruse idea. In this way, wordclearing can become an instrument of indoctrination, because the PC [27] is urged to accept a text even if he understands only the individual words. (...) An important instruction of indoctrination is technical jargon with its numerous artificial words and abbreviations, which cannot be deciphered without a special dictionary." [28]

Regarding "training routines" and "drills," experts have determined there is a risk of conditioning and have summarized, "It is clear, that the PC is being conditioning in this manner to undertake everything willingly, including carrying out subsequent instructions without criticism. (...) He is supposed to become a transparent person who unconditionally serves the system. Any real psychotherapy, in contrast, has the goal of strengthening the autonomy of the patient, to aid him to greater inner self-determination and on to departure from the psychotherapist. In Scientology and Dianetics the opposite direction is taken quite deliberately for the purpose of control." [29]

4. The Goals of the SO The goal continually propagated by Scientology is <a civilization without mental illness, without crime and without war, in which the able become successful and honest people have rights, (...).> [30] This intended "new civilization" is the social utopia of society that is entirely without conflict.

Individuals have to subordinate themselves to this goal. Those who engage the SO in a critical manner or oppose it are stigmatized as "mentally ill" or "criminal." The SO imagines itself to be in possession of the sole truth, therefore it perceives criticism, especially from outsiders, as an attack.

<In the tumult of battle, where will is put to the test and courage is learned and where one either dies or comes out triumphant, a real group is crafted in the arsenal of truth (...) A group that fights determinedly and unerringly through any consequences for what's right, and never quits the battle until they have won.> [31]

This expresses the concept of being in at "war":

<There are not good reporters. There are no good representatives of the government or of SP groups. [32] (...) SPs are in a state of war. Whether one now behaves nicely or rudely to them - any behavior simply means more war. Therefore counter their counteraction like a battle.> [33]

4.1 Political power claim <One fine day we will approach politics and will have to clean it up, since politics can only have been seduced into given the political controls to criminals. And when you have the answer to crime, then you have the answer to all politics. (...) They would only have to make sure that the people in the government had been cleared (...)> [34]

Nevertheless, the SO publicly contests following political goals. Instead, by providing alleged alternatives to therapy and social reforms, it is suggested that Scientology could revolutionize central social areas. Behind the allegedly non-political reform programs, though, achieving political power appears as an ultimate goal, along with a program which is not compatible with the value system of a democratic constitutional state. In a confidential HUBBARD policy letter distributed only to management, which was reissued under David MISCAVIGE, the following long-term "target" were set:

TARGETS

The vital targets on which we must invest most of our time are:

T1. Depopularizing the enemy to a point of total obliteration.

T2. Taking over the control or allegiance of the heads or proprietors of all news media.

T3. Taking over the control or allegiance of key political figures.

T4. Taking over the control or allegiance of those who monitor international finance and shifting them to a less precarious finance standard.

T5. Generally revitalizing the societies in which we are operating.

T6. Winning overwhelming public support.

T7. Use all other similar groups as allies.

These of course, are very long-range targets. But it is what must be done to continue the longevity of our organizations.

Our only justification for doing these things is that Scientology is the only game where everyone wins.

The names and connections, at this time, of the bitterly opposing enemy are:

1. Psychiatry and psychology (not medicine).

HUBBARD developed a "special zone plan" of deliberate infiltration to attain these targets, especially in political circles:

"And see this: a race is staggering along making difficulties for itself. Locate its leaders. Get a paid post as a secretary or officer of the staff of the leaders of that race. And by any means, audit them (...) And this: a nation or a state runs on the ability of its department heads, its governors, or any other leaders' It is easy to get posts in such areas (...) Don't bother to get elected. Get a job on the secretarial staff or the bodyguard, use any talent one has to get a place close in, go to work on the environment and make it function better. (...) Don't ask for permission. Just enter (...) If we were revolutionaries this HCO Bulletin would be a very dangerous document." [36]

In another policy letter, HUBBARD required achievement of <key positions,> <no matter how," and an <invasion into every area of activity.> [37]. The organization uses a double-strategy to win politicians and to influence legislation:

"ACTIONS (...) Bringing continuous pressure to bear on governments to create pro-Scientology legislation and to discourage anti-Scientology legislation or legislation of groups opposing Scientology. (...) The action of bringing about a pro-Scientology government consists of making a friend of the most highly placed government person one can reach, even placing Scientologists in domestic and clerical posts close to him (...)" [38]

Another policy letter reveals that besides just a constructive improvement of politics, an aggressive battle strategy and the control of media and politics are used to implement one's own goals:

"The object of the department is to broaden the impact of Scientology upon governments and other organizations and is to conduct itself so as to make the name and repute of Scientology better and more forceful. (...) In the face of danger from governments or courts, there are only two errors one can make: (a) do nothing and (b) defend. (...) [M]ake enough threat or clamor to cause the enemy to quail (...) If attacked on some vulnerable point by anyone or anything or any organization, always find or manufacture enough threat against them to cause them to sue for peace. (...) Don't ever defend. Always attack. Don't ever do nothing. Unexpected attacks in the rear of the enemy's front ranks work best. (...) The goal of the department is to bring the government and hostile philosophies or societies into a state of complete compliance with the goals of Scientology. (...) Introvert such agencies." [39]

The state's security area is also scrutinized.

<And now it comes to the point where you turn to the police chief -- it has to be the police department, because this is the department that is used to stop you. That has to be the first point of debarkation. Always the police. They are the place of corruption. They are the place where a revolution takes place. Always keep that in mind. So when you clean them up first, then you can prevent something very bad being conjured up.> [40]

The ideology and practice of the organization show that it intends to permeate society with its teachings and exercise power. Reports from functionaries, leading and otherwise, constantly indicate a combative stance and an uncompromising will to persevere. During an inter-regional SO rally in October 1999 in Hamburg, a speaker presumed there was limitations on the freedom of religion in Germany. He is reported to have said that the representatives of the German "apparatus of suppression" ("Unterdrueckungsapparates") could be assured that this time the battle would go in favor of Scientology. Where Scientologists had to take defeat lying down before, now their time had come. Naturally there was a time - the speaker was referring to National Socialism - in the 1930s when the state had won. But now in the 1990s Scientology would win. The high-ranking SO functionary Guillaume LESEVRE also imagines himself at "war" with Germany. Back in 1997, for instance, he sent the following newsletter to German Scientologists: "(...) there are many successes in the battle against suppression in Germany (...) But this is a war which will not be won without you (...) It is necessary, that you make your contribution in Germany, and the victory will be ours."

4.2 Maximizing Profit: Means to an end The SO combines commercial and political goals together. By marketing courses and books - called "Hard Sell" - as well as by acquisition of donations, the organization creates a foundation for its worldwide expansion. Behind every commercial transaction is steadfastly fixed the straightforward "standard finance policy," which requires the production of "more income." [42]

The "Scientology Organization" plainly combines political power with the accumulation of money, targeted lobbying and infiltration:

<The earthly measure of success is the amount of power, authority, people, wealth and possession that one controls. We are interested in success of this sort because it embodies the means of reaching out and accomplishing our mission.> [43]

5. A dualistic Worldview Like other totalitarian organizations, the "Scientology Organization" claims to be the one valid representative of society. It perceives itself as the one and only owner of political, religious and any other sort of philosophical "truths."

HUBBARD's teachings are hermetically sealed. Although the SO constantly maintains that HUBBARD's teachings are scientific, they were not developed on a basis of rational, open and scholarly discussion. HUBBARD frequently advanced unproven assertions. Parts of his ideology appear as knowledge gleaned from the most diverse disciplines which have been compiled into a new teaching. For example, his Dianetics procedures contain elements recognizably borrowed from psychology. At the same time HUBBARD, while vehemently condemning psychology, refers to the presumably unshakable truth of his own doctrine. In this way the system itself becomes the topic of discussion and criticism is even regarded as deviant conduct that warrants sanctions. In Scientology, contradictions in doctrine are ignored. One consequence of this is that the organization is unduly aggressive in its attitude toward dissidents and opponents, because the implementation of Scientology doctrine is made a matter of life and death:

<This here is not a game for us. The personal future of us all depends on going forward and not making any major mistakes. The question is not whether there is something else. There is nothing. Nobody can be half in and half out of Scientology. Scientologists are Scientologists, no matter what they do to earn their living. (...) If we fail, we are lost. It is not a matter of being killed. It is a matter of being killed and killed and killed, life after life, forever. (...) We have no time at all for doubt or wandering around aimlessly. The next time you hear someone moaning, 'I just don't know, moan, moan', then given him a slap in the face. We are the elite of the planet Earth (...)> [44]

5.1 The Scientology Worldview: A Conspiracy Theory According to the Scientologist perspective, hidden behind the visible everyday occurrences of life is a reality of which the manipulated populace is not aware, a reality has been determined by a small, powerful group which decides the fate of the world:

<We in Dianetics and Scientology are dealing with a totalitarian conspiracy that uses "mental health" to keep people under control. (...) It began with war, whereby the opposition controlled all the press media and governments. (...) The opponent has all available PRO and intelligence techniques at his disposal to stop us, (...)> [46]

It is asserted that only the SO possesses the secret knowledge and the ability to break through political manipulations and to free the world.

HUBBARD's ideology contains the essential elements of a conspiracy theory. Scientology stylizes psychiatry as the enemy of humanity. According to HUBBARD, mankind is in a dramatic state of political and social decline. The allegedly manipulated society of the western world, which is supposedly <on drugs> and <controlled by the mass media> [47] is in a state of paralysis: the Nazi legacy is said to have survived intact as psychiatrists who have established a <dominion of fear> by means of "mind control" techniques and Gestapo-like methods; behind psychiatric clinics are hidden the annihilations camps tolerated by the state, which HUBBARD compared to Auschwitz [48]:

<A secret police financed by the state arrests anyone they [49] don't like. The state finances their death camps for freethinkers. (...) Germany and other countries have already bowed completely and used them to control entire populations.> [50]

According to HUBBARD, governments, including legitimate democratic ones, are <political marionettes> [51] of the real rulers, who have gained extensive control through blackmail and bribery of politicians, and who influence elections and the legislation [52]. The "Scientology Organization" tries, in the framework of this conspiracy theory thinking, to equate the democratic system with totalitarian systems and to denounce the system as inherently corrupt:

<The system, the establishment, the government - call it what you want - is something that has accumulated entire decades of self-serving self-justice. (...) The properties and the resources of the state in a 'democracy,' which is steered by parties, become a bounty which is won in an election held hat fixed periods of time. Political victory offers the opportunity to enjoy material advantages for a fixed period. The system is a whore, whose favor is won by a new candidate through popular elections. (...) Whether one has a monarchy or an aristocracy, an oligarchy, a republic or a military dictatorship, the model remains the same.> [53]

Members of this <secret, worldwide network> [54] include an alleged <weapons cartel>, pharmaceutical companies, drug dealers and intelligence agencies, who supposedly work for the "conspirators." In the background of this scenario though, HUBBARD places a small group from "higher financial circles" [55], who also direct psychiatry and hold the reins of power. The idea is to survive the <tyranny of the government, a suppressive economic system, inadequate law and the all-encompassing terror of psychiatry>. The SO describes the removal of this alleged circumstance as <the real Crusade of Scientologists all over the world> [56]. This reveals that processes like "auditing" are not at all meant solely as individual instances of therapy for the spiritual "freeing" of the person, as the organization asserts in public. Instead, the SO management sees itself on a political mission, and uses "auditing" as a socio-political means to liberate an allegedly enslaved populace.

5.2 Politics from the Scientologists' point of view Scientology, with regards to the themes of psychiatry and state, reveals itself to be a rigid system in which daily events or political developments are evaluated only according to the Scientology system of definitions. Besides that, it is evident that ordinary Scientologists as well as high-ranking functionaries, on the basis of HUBBARD's concepts, have uncritically accepted:

- A high-ranking representative of the "Church of Scientology International" believes he discovered the <true background> of the Kosovo conflict when he asserted in a speech that the <criminal psychiatrists> had been the true <instigators> of Hitler's German occupation of Yugoslavia. He said the subsequent mass murders in the Balkans had occurred <according to psychiatric race theories>. The most recent Kosovo War was only a recirculation of psychiatric indoctrination. [57] In this way the functionary made the attempt to alter meaning in the assessment of Nazi crimes: he talked about "psychiatric race theories," not Nazi race theories. In another speech the functionary compared psychiatrists and their supposed "strawmen" with terrorists. [58]

- On the occasion of the 11 September 2001 terrorist attacks in the USA, David MISCAVIGE reformulated a political claim to sole representation and asserted that only the Scientologists could stop the <economic and social collapse>. In an urgent appeal he demanded worldwide expansion. At the same time he held psychiatry, as a declared <archenemy>, responsible for the terrorist attacks of 11 September:

<That was done by putting them [the attackers] on drugs and hypnotizing them (...) this is all the stock-in-trade of psychiatrists. Those are not assumptions. Those are facts. And if you still have doubts, then look at the fact that the right hand man of the primary suspect - Osama bin Laden - is a psychiatrist.> [59]

- In November 2001, a functionary of the SO-auxiliary KVPM organization (Kommission fuer Verstoesse der Psychiatrie gegen Menschenrechte - Commission for Violations of Psychiatry against Human Rights, the German version of the CCHR, Citizens Commission for Human Rights) supported an appeal on the Internet against use of troops in Afghanistan, wherein he recognizably oriented himself to MISCAVIGE's statements and presented the same sort of position in detail for the KVPM.

- A Scientologist from Baden-Wurttemberg described his worldview on the Internet as follows, "An important thing I found out through Scientology is that things are not as they appear to be at first glance. Governments and their systems, media and their reports ... etc. are part of a carefully laid out illusion machine which lead the majority of the population astray." [60]

- A petition [61] taken by Scientologists in 2001 and directed at the Baden-Wurttemberg state assembly presumed in a polemic and demagogic manner that the state government had "neutralized" the "sect problem." The selection of words was obviously meant to suggest a close intellectual proximity between the constitutional agency and the National-socialist rule by force.

6. The "cleared State" The "Scientology Organization" plans to "clear" the state, indeed the entire world. As a rule it does not specify what it means by this. Even Scientologists more often than not have diffuse concepts for a basis. The scope of a "cleared" state, however, was very clearly formulated in a Scientology magazine in 1992 ("Ziel: Die Schweiz ist das erste geklaerte Land auf den Planeten"). In it the following goals were set:

"(...) Thousands of auditors of all grades (Dianetics up to Class VIII) auditing the Swiss population and bringing them up the Bridge. (...) In the area of Training and Education: (...) LRH [62] Technology will be applied on all levels: schools, vocational schools, high schools, teaching schools, universities, continuing education classes (inside and outside companies). (...) In the area of the Business World: (...) WISE has become the strongest security organization [Schutzorganisation] for ethics and business expansion. (...) In the area of Law: Policies and judicial orders by LRH are acknowledged and applied. Criminal law will be regulated through the application of LRH policies by WISE. (...) In the area of Finances: Switzerland is the first country without income taxes. The sales tax has been introduced. Good production will be rewarded by the state. the LRH policies on finances will be acknowledged and applied on all levels." [63]

It follows that the "clearing" of a state means the permeation of the state presence in accordance with HUBBARD's teachings and the application of his directives in the legal and justice systems. These sort of concepts are not limited to Switzerland. The SO has consistently stated their goal as wanting to exert their own rules over state and society:

<If we demonstrate a higher measure of order in ourselves and in our organization than in the society into which we are expanding, then through that alone society will yield to us. If there is a better law, easier recourse to injustice and a higher sense of order in our groups, then people will yield to us, because they find greater security and certainty in us than in the madhouse that is the 'the outside world.' This world will yield to us so fast and in our direction to the degree that we reach a superior culture. We must - every one of us - uphold only our laws under the HCO code of ethics and their individual implementation and to that degree we will expand as the greatest influence in society. (...) THE WHOLENESS OF STRENGTH IS ORDERED PROGRESS.> [64]

The reason given for this was the allegedly lawless state of society:

<You say, 'That is adventuresome! An administration ruling the government with Scientology?' Now, I only know that it would cause trouble if we didn't do it.> [65]

Finally, the following vision stands behind the concept of the "cleared" society:

<And in the central organization, I'm now looking only a little bit into the future, there will be a political officer there. You want to know what happens when you've cleared everyone in this environment? The only thing for which this center can be used is a political center. From the point in time they've done all that, you are the government.> [66]

It is therefore essential to confront the Scientology system with the values of Basic Law.

7. The Scientology System - incompatible with democracy The Federal Constitutional Court, on the occasion of prohibiting the "Sozialistischen Reichspartei" (court decision: BVerGE 2,1), used the phrase "liberal democratic basic system." This is the system which, barring rule by force or arbitrary rule, is a rule based on freedom, equality, and the self-determination of the people according to the will of the current majority. Its basic principles include: the respect of human rights as set in Basic Law - but mainly the right of the individual to life and to free development, the sovereignty of the people, the separation of powers, accountability of government, the legal degree of the administration, the independence of the courts, the majority party principle, the equal opportunity for all political parties, as well as the right to forming and exercising a parliamentary opposition.

7.1 Human dignity and Human image "The dignity of a person is inalienable." The prominent position of this fundamental law in Article 1 Paragraph 1 of Basic Law shows that the person in his uniqueness is "the highest legal value in the constitutional system" (court decision: VBerfGE 45, 187, 227). It includes the image of a responsible person with social obligations who acts according to his free determination, protecting this person from any state arbitrariness, and thus guaranteeing free development. The SO ethics presented in a following section is not compatible with human dignity as understood in the sense of Basic Law.

7.1.1 The Scientology Human image Although the SO places great value in public on the image of an organization whose central point focuses on religious transcendence, HUBBARD's writings reveal an almost purely technical image of a person. HUBBARD compared the ideal of a "clear" - a "cleared" person - with a machine:

<We we have obtained a Clear, we are standing before something that man has never seen before, because one has never before existed in a non-fragmented state: a perfect machine, well oiled, powerful, shining and ready to perform all its own functions without guidance and without further delay.> [67.

7.1.2. The "Ethics" of the SO The SO presents the word "ethics" to the public in a way with which many observers could agree: "Ethical behavior" or "ethics" is said to be reason, and reason is optimal survival, such as avoidance of war or environmental destruction. This, however, is only the first step in the Scientology train of thought concerning "ethics." HUBBARD's "ethics" is one of the "re-defined" terms. It does not mean moral teachings with a positive slant for people. In his writings, HUBBARD always listed the principle of "survive" as the highest maxim of all conduct, used it as an absolute for all "dynamics" (areas of existence) and for the judgment of good and evil. According to HUBBARD, the optimization of survival is the equivalent of being "ethical." HUBBARD's "ethics" has been summed up as follows:

<Simply said, good is survival. Ethical conduct is survival. Wicked conduct is non-survival. Construction is good when it promotes survival. Construction is wicked when it hinders survival Destruction is good when it promotes survival.> [68]

According to HUBBARD's doctrine, because only the SO can assure survival, everything that serves it is "ethical" and "right" and everything that harms it is "unethical." In this way, "ethics" becomes a synonym for the ruthless implementation of one's own goal and the removal of "counter-intentions" that stand in the way of the SO:

<The purpose of ethics is: TO REMOVE COUNTERINTENTIONS FROM THE ENVIRONMENT.> [69]

Scientologists who produce "high statistics" are supposed to be assigned a good "ethics condition." In all cases, SO staff are under presser to close ever more sales, to write ever more letters, to make ever more "communication lines." "Unethical" conduct - categorized into errors, misdemeanors, crimes and high crimes - is committed by those that hinder the expansion of the SO. This can be met with psychological pressure or sanctions. The SO designates opponents as "Suppressive Persons" ("SP"). Those merely having a connection with a "suppressive person" can be classified as "Potential Trouble Source" ("PTS").

HUBBARD developed a meaning for ethics, free of any moral measures of value, from a worldview so typical for him, of uncompromising social Darwinism which does not recognize any justification for the existence of the sick or the weak, meaning those who cannot "produce." One of the most important "Policy Letters" of the SO would rather have Scientologists "dead than incapable" and rejects the principle of democracy:

"WHAT I SAY IN THESE PAGES HAS ALWAYS BEEN TRUE, IT HOLDS TRUE TODAY, IT WILL STILL HOLD TRUE IN THE YEAR 2000 AND IT WILL CONTINUE TO HOLD TRUE FROM THERE ON OUT. NO MATTER WHERE YOU ARE IN SCIENTOLOGY, ON STAFF OR NOT, THIS POLICY LETTER HAS SOMETHING TO DO WITH YOU. (...) And I don't see that popular measures, self-abnegation and democracy have done anything for Man but push him further into the mud. (...) If they enrolled, they're aboard; and if they're aboard, they're here on the same terms as the rest of us -- win or die in the attempt. Never let them be half-minded about being Scientologists. The finest organizations in history have been tough, dedicated organizations. Not one namby-pamby bunch of panty-waist dilettantes have ever made anything. It's a tough universe. The social veneer makes it seem mild. But only the tigers survive (...) When we do instruct somebody properly, he becomes more and more tiger. (...) The proper instruction attitude is "You're here so you're a Scientologist. Now we're going to make you into an expert auditor no matter what happens. We'd rather have you dead than incapable." (...) An Instructor or Supervisor or Executive must challenge with ferocity instances of 'unworkability.'" [70]

"Suppressives" are supposed to be eradicated:

<The recognition as a suppressive is our hanging. When things are bad (bad indicators are strongly visible), it is very beneficial to hang a body from the gallows. We call it 'putting a head on a pike.' (...) If there are bad indicators all around - low and falling statistics, bungled cases - we will be very skilled with our questions and put the area virtually under martial law - we call this a state of emergency. When the emergency situation has been cleared up, you usually have to put one or two heads on a pike to convince people that you meant it seriously (...) Ethics is the steamroller, (...) SUPPRESSIVES! Eradicate them. (...) Find the suppressive and shoot him. Peace reigns.> [71]

HUBBARD's violent language and his cynical world concepts are marked by intolerance and socially Darwinistic influences. Personal interests have to take second place behind the supposed necessity of saving the "human race":

<What kind of a huge overt [72] it is to let the entire human race decay because one does not have the guts to use discipline? (...) Bring ethics hard into your org and your environment. Raise Cain with it. (...) It is a new civilization we're after, and we will make it.> [73]

Although HUBBARD asserts <that primitive people are much more aberrated than civilized people> [74], he nevertheless does not take a classic racist approach. According to him the "new" man does not gain his supposed strength and his "survival potential" from biological origins, but from a mental and social technology that puts him at an advantage over those who do not have this technology available - an Uebermensch via psycho-training. HUBBARD also said that people should stop being a Home Sapiens and become a "Homo Scientologicus." [75] The SO obviously perceives its teachings as the foundation for a perfect human civilization. At the same time, an ever more dramatic need for action regarding a society that is supposedly in decline is constantly signalled:

<Our governments do not manage to stop revolutions from breaking out, the heads of government of these states from being murdered or stop any of their enemies from infiltrating them over and over. The war waits with weapons at the ready for another mistake from incompetent heads of state. (...) We are trying to do our work. One can compare with an attempt to pull a wounded water buffalo out of a wallow. The fact alone that you're trying to help him is positive 'proof' to him that you are up to no good. (...) Remember that when you meet a 'critic.' And also remember that he's only standing in your way (...) Those who have a different opinion have an unrestricted right to their own shock and their own weaknesses, their darkness and their death.> [76]

7.1.3 The Worth of an Individual It is not all too surprising that HUBBARD asserts in the standard work, "Dianetics," that the "potential value" of a person can be calculated with an equation:

"The potential value of an individual or a group may be expressed by the equation

PV equals I D to the X

where I is intelligence and D is dynamic. The [actual] worth of an individual is computed in terms of the alignment on any dynamic, of his potential value with optimum survival along that dynamic ..." [77]

According to this view, the worth of an individual is set according to what "products" he produces in the various areas of life ("dynamics").

Of great importance to the Scientology understanding of people is also the so-called "tone scale" and the "Hubbard Chart of Human Evaluation" associated with it, which are part of HUBBARD's fundamental teachings. The "tone scale" lists numerous human moods by number on a vertical scale, some examples of which range from "enthusiasm" ("4.0") down to the undesirable area - past "anger" ("1.5"), "covert hostility" ("1.1") and go down to "sympathy" ("0.9"). These are not at all considered by Scientologists to be descriptions of a chance moods, but instead to represent a state according to which a person can be categorized by "ethics level" and personality characteristics, also including political tendencies. While people at the top of the "tone scale" get outstanding evaluations, the table lists for "covert hostility" the characteristics of a moral degenerate:

A person in the category of "anger" is evaluated as follows:

<Rape. Sex as punishment. (...) Annihilates or destroys others (...) Fascist.> [79]

These are not just arbitrarily imposed differences between "valuable" and "inferior" people, rather they build a character image of a sub-human.

7.2 The principle of equal treatment before the Basic Law, Article 3 According to Article 3 of Basic Law, all people are equal before the law. The equality principle contains an objective ban on arbitrariness, according to which equals may not be treated unequally and non-equals may not be treated the same. No one may be put at a disadvantages on account of gender, ancestry, language, homeland or origin, belief, religious or political worldview.

7.2.1 Superior Scientologists, inferior opponents?

<A truly suppressive person or group has no rights at all as a Scientologist.> [80]

<I believe and know that auditors belong to the upper tenth of the upper twentieth of the most intelligent of human beings. Their will, (...) their ability to comprehend things and to apply is superior to any comparable qualities of any other condition. (...) We are the only group on Earth who have a usable solution. (...) My goal is to get a Barbarian out of the mud that thinks it's his creator, (...)> [81]

HUBBARD's writings are steadfastly marked with hate and disdain for the non-Scientology society. His teaching differentiate between supposedly superior Scientologists as <golden people> and <new spiritual leaders> [82] and supposedly inferior non-Scientologists. The latter are disdainfully regarded as <assembly line humanoids>, "wogs," [83] or even as "raw meat." [84]

The "Scientology Organization" has a future for society in mind where not all people should have rights:

<This group [the SO] believes that honest people have rights and that dishonest people have forfeited their rights by virtue of being dishonest. The definition of a dishonesty is whether or not someone tries to harm his fellow man with libel, hidden actions and injustice or open crime. This group reserves the right to check the honesty of its members.> [85]

The SO is the one who determines who is honest. In addition, according to the standard "Dianetics" work, only the "non-aberrated," meaning "clear," should have civil rights:

"Someday there will, perhaps, exist a much more sentient law that only the unaberrated can marry and bear children. (...) Perhaps at some distant date only the unaberrated person will be granted civil rights before law. Perhaps the goal will be reached at some future time when only the unaberrated person can attain to and benefit from citizenship. These are desirable goals (...)." [86]

These specifications of the "cleared" state are enough to recognize that it is a dictatorship. HUBBARD's teachings are not compatible with the equal treatment principle as stated in Article 3 of Basic Law.

7.3. Freedom of opinion according to Article 5 of Basic Law In accordance with Article 5 Paragraph 1 Sentence 1 of Basic Law, everyone has "the right to freely express and to spread his opinion in words, writing and pictures." According to a decision of the Federal Constitutional Court this basic right is "quite constitutional, for it first enables consistent mental discussion, the battle of opinions, which is its life-element. (..) It is in a certain sense the foundation of every freedom in general" (court decision: BVerfGE 7, 198 ff., 208).

7.3.1 Rejection of any criticism

<CRITICAL THOUGHTS, these are always only indicators that the person being checked has committed an overt against whatever he or she is criticizing. Critical thoughts, expressing opinions and attitudes toward something are actually indications of a previous overt.> [87]

The SO generally regards criticism as suspicious and it is interpreted as an indication of having committed an "overt," which is an action directed against survival. Therefore there can be no freedom of opinion in the SO. Things regarded as a "high crime" ("suppressive acts") include:

"Proposing, advising or voting for legislation or ordinances, rules or laws directed toward the suppression of Scientology; (...)

Testifying hostilely before state or public inquiries into Scientology to suppress it; Reporting or threatening to report Scientology or Scientologists to civil authorities in an effort to suppress Scientology or Scientologists from practicing or receiving standard Scientology;

(...)

Writing anti-Scientology letters to the press or giving anti-Scientology or anti-Scientologist evidence to the press;

(...)

[High crimes] consist of publicly departing Scientology or committing Suppressive Acts." [88]

The implementation of this type of policy on legal speech would mean the end of the free expression of opinion. The freedom of association mentioned in Basic Law Article 9 Paragraph 1, might also be relevant, because listed as "crimes" under the same "ethics" codes are:

"Continued adherence to a person or group pronounced a Suppressive Person or Group by HCO" [89]

This stands in stark contrast to the "creed" distributed by the SO to the public:

<We of the Church believe: That all men, no matter what race, color or which confession they might be, are created with equal rights. (...) That all people have the inalienable right to think freely, to speak freely, to freely write their own opinion and to counter the opinions of others or so express themselves about it or write about it.> [90]

Also incompatible with the spirit of free contest of opinion is the claim of the "Scientology Organization" to possess the exclusive truth. HUBBARD's presumptuous concepts on opponents testify to the inability of the SO to accept criticism in an open society. The same organization that accuses critics of "religious intolerance" makes the following threat:

<Anyone who criticizes or makes sarcastic comments about someone for being a Scientologist cannot withstand a personal review of his motives or past actions. (...) We find no critics of Scientology who do not have a criminal past. We prove this over and over. Politician A prances in a Parliament on his hind legs and brays like a donkey for condemnation of Scientology. When we check him out, we find crimes, embezzled funds, moral missteps, a longing for little boys - dirty stuff. (...) We are not a justice enforcement agency. BUT we become interested in the crimes of people who try to stop us. If you oppose Scientology, we'll keep a sharp lookout for your crimes - and we will find and expose them. If you leave us in peace, we will leave you in peace (...) But those who try to make life difficult for us are immediately in danger.> [91]

The realization of these sort of ideas on a wide social scale would be equivalent to the end of pluralism and free contest of opinion in a democracy. The graphic comparison of opponents being shot <like ducks in a pond> [92] or the labeling of critical media as the "screaming apes of the press" [93] and identification of them as rats by highest-ranking Scientology manager David MISCAVIGE demonstrates that the new management is also inculcated in HUBBARD's ideology:

<Just look at the reactions of the rats when the fumigator shows up. That's the media!> [94]

7.3.2 Dealing with Critics What is supposed to happen to people who are critics of Scientology or who do not want to be "cleared" with "auditing"? HUBBARD confirmed what should happen to his supposedly "criminal" and "mentally ill" opponents not only in the standard "Dianetics" work, but in "The Science of Survival" as to what should happen to the supposedly "criminal" and "mentally ill" opponents:

"Criminals lie in the band from 2.0 [95] down the scale,(...) The only answer would seem to be the permanent quarantine of such persons from society to avoid the contagion of their insanities and the general turbulence which they bring into any order, (...) or processing such person until they have attained a level on the tone scale which gives them value. In any event, any person from 2.0 down on the tone scale should not have, in any thinking society, any civil rights of any kind, (...)" [96]

According to HUBBARD, the people he is talking about could change only if they undergo Scientology processing:

"This does not propose that depriving such persons of their civil rights should obtain any longer than is necessary to bring them up the tone scale to a point where their ethics render them fit company for their fellows. This, however, would be a necessary step for any society seeking to raise itself on the tone scale as a social order. [97]

At the same spot HUBBARD indicates that the existing legal system already allows similar measures - by this he means making an insane person a ward of the court. By expanding the legal definition with the Scientology concept of "ethics," a similar principle could be put into effect. Plans for legislative action implementing this sort of idea actually exist in the SO. The idea of isolating critics and opponents, whereby an entire segment of the population is declared wholesale to be "anti-social personalities" is part of Scientology's ideology:

"THE ANTI-SOCIAL PERSONALITY / THE ANTI-SCIENTOLOGIST"

"There are certain characteristics and mental attitudes which cause about 20% of a race to oppose violently any betterment activity or group. Such people are known to have anti-social tendencies. When the legal or political structure of a country becomes such as to favor such personalities in positions of trust, then all the civilizing organizations of the country become suppressed (...) Thus, in the fields of government, police activities and mental health, to name a few, we see that it is important to be able to detect and isolate this personality type so as to protect society and individuals from the destructive consequences (...) As they only comprise 20% of the population and as only 2 1/2% of this 20% are truly dangerous, we see that with a very small amount of effort we could considerably better the state of society." [98]

If one takes the SO at its word, then the organization would gladly isolate its critics and opponents - similarly to Soviet communism - as "mentally ill" in institutions. It seems certain that in this case the organization would use force against opponents for the purpose of implementing its "clear" program on a societal level. A directive makes clear that the organization views the use of force as legitimate for the purpose of creating a demand for the "product" of Scientology.

<Hitler (just like Caesar) did not secure 'his conquered territory.' It was impossible to do this - not because he did not have the troops, but because he had no real demand for German technology and German social philosophy before he began the conquest. (...) It is nearly impossible to secure territories if one had not been invited in advance and if force has to be used to expand. One can really remove suppressive with force to assure oneself that a demand is constructed provided that one does not try to force the product on the suppressive and all around him. (...) Since we have a 'product' that frees and deaberrates in the highest sense, naturally there is an end to the game. (...) In any case, we do not conquer land in the same sense that governments do it.> [99]

Another passage from "The Science of Survival" poses nagging questions about the "Scientology Organization":

"It is not necessary to produce a world of clears in order to have a reasonable and worthwhile social order; it is only necessary to delete those individuals who range from 2.0 down, either by processing them enough (...) -- or simply quarantining them from the society. Venezuelan dictator once decided to stop leprosy. He saw that most lepers in his country were also beggars. By the simple expedient of collecting and destroying all the beggars in Venezuela an end was put to leprosy in that country." [100]

To be sure not a single case is known at this time of the Scientology Organization trying to implement its objective with force. Instead the organization concentrates on the ideological re-education of an increasing number of people.

7.3.3 "Knowledge Reports" <Anyone who has knowledge of a case of loitering or of an action that was destructive, not done in accordance with policy or unethical, and WHO DOES NOT SUBMIT A KNOWLEDGE REPORT, will be held CO-RESPONSIBLE in the event of a legal proceeding is subsequently undertaken.> [101]

Collection and evaluation of knowledge reports in RTC

With "knowledge reports," the SO means to penetrate into even the most intimate areas of Scientologists and control them. Scientologists justify "knowledge reports" with the excuse, among others, that they are are pursuing the interests of being reported upon, who otherwise might stray from the "right" Scientology path. In the meantime, the organization also offers Scientologists the opportunity to send their reports to the USA online. These reports encompass almost every area of life, but especially circumstances that could negatively affect how the SO is viewed and so are therefore "unethical." People who have distributed "knowledge reports" who have come forward and talked about them have indicated that some of the reports are forwarded to various SO authorities, including overseas, and filed in the folders of those being observed. Examples from the 1990s:

- One Scientology reported to the organization on the activities of a family member in a state security agency. From the report it could be seen that he had attempted to gain background information on the action, which was security-sensitive. According to the handwritten notes, the report had circulated in the SO intelligence service, the "Office of Special Affairs."

- A staff member in a southern German "mission" reported that a critic wanted to move a Scientologist to leave the organization. According to a follow-up report, investigations of the critic had begun the next day.

- A woman Scientologist described the sexual desires of her husband, which she had rejected, and asked that her husband be "handled" accordingly.

- In another knowledge report, a Scientology member wrote about his brother, also a Scientologist, who had searched the work room in the house and his father's business office for documents that were critical of Scientology. The brother justified himself with words to the following effect: "We are at war; the end justifies the means."

From this it has to be concluded that quite a few Scientologists are busy providing the SO with detailed "knowledge reports" from their private and work lives. This brings up the possibility that they are also busy in the work place, in associations, in functions of public life or among friends gathering information and forwarding it to SO authorities, and denouncing the people in their environment. The SO knowledge report is a manifestation of an attempt at extensive control and is incompatible with the spirit of Article 5 of Basic Law. Freedom of opinion can hardly develop in a climate where people are informing on each other.

7.4 Protection of Marriage and Family According to Article 6 Paragraph 1 of Basic Law, marriage and family are "under the special protection of the state system." This basic standard is put into effect through parents' rights to bring up their children and the ban, with only few exceptions, of separating children from their parents (Article 6 Paragraph 2, Sentence 3 of Basic Law).

7.4.1 "Handling" or Disconnection The method of dealing with family members demanded by the SO in cases of conflict is in crass contradiction to the values set in Basic Law. Scientologist are supposed to "handle" "antagonistic" family members, meaning those who refuse to accept Scientology. Thus, family members have to be drawn into the SO or left alone. Conflicts and occasional mental stress tests are commented upon with cynicism:

<A Scientologist who through family or other ties is connected to a person who is guilty of suppressive actions is generally a potential source of trouble or a source of trouble. The history of Dianetics and Scientology is full of these.> [102]

If the "antagonistic" family members will not be "handled," the organization requires, as a rule, that connections to the person be cut. The directives permit "ethics officers," <particularly in connection with husbands and wives>, to issue a "Separation Order"). If one of these is issued, the husband and wife, at least for a certain amount of time, are not permitted to have contact with each. [103]

The SO justifies the break this way:

<It is quite similar to how one deals with a criminal. If he does not handle the situation, then society reaches for the only other solution: it 'breaks' the connection of the criminal with society. In other words, it removes him from society and puts him in a prison, (...)> [104]

In case of conflict the values of marriage and family founded in the basic law have no meaningful role for the SO. On the contrary, "failure to handle <or dissociate or disconnect from> a person demonstrably guilty of Suppressive Acts" [105] is listed as a "high crime" in Scientology.

7.4.2 Children in the SO <Whole civilizations have changed because someone changed the children.> [106]

Parents subjecting their children to processes like "Child Dianetics" can prove to be extremely problematic. For instance, HUBBARD suggests that an "auditing" procedure be used on small children <like it would on animals>. [107] Children and young people can also be subjected to hours-long sauna sessions of the "Purification Rundown" that go on for weeks. According to HUBBARD, people can become immune from radioactive rays this way! [108] HUBBARD asserts:

<Radiation is apparently water soluble as well as rinsable to a very high degree. According to research, one must only direct a stream of water at the upper surfaces of a building or a street to wash the radiation away. This fact is well known to trained defense personnel. So when one does the Purification Rundown, one should meticulously see to it that one really sweats buckets.> [109]

A pediatrician noted the following after examining a 10-year-old girl:

"... Dorothea enthusiastically, almost zealously, told of her various course which she took at the Scientology Church every afternoon. In doing this she spoke of auditing, of a question-answer problem test and of the Purification Course, which involved daily sessions in the sauna of from 3 to 5 hours. Before the sauna session she was dispensed medication ('niacin') so that her body would be detoxified. During the sauna program there was a drink ('Kalmak' [English: CalMag. Ed.]) for more 'detoxification.' She described the objective of this treatment as a state of "clearness.' To the comment that such a long session in the sauna was strenuous, she related that on the day before she had to be carried out of the sauna; she said she was screaming and was not 'master over her body.' During this she saw herself 'from above,' like 'when one is dead.' She said she had been 'out of body.' The girl obviously perceived this as a great strain. Therefore I asked Dorthea why she hadn't given up this training program, and she answered, 'Papa has deposited so much money for me, and now I have to do it to the end.' My assessment is that a girl of such an age is in no way fit for this method either physically or mentally, and that continued exposure would have harmful influence upon her." It must be suspected that children and young people of various ages are subjected to physical and mental suffering based on the SO's abstruse concepts.

7.5 Democracy and supporting principles of state organization The Federal Republic of Germany is constituted (Article 20 Basic Law) as a social and democratic constitutional state. The federal constitutional court has outlined its supporting principles with the concept, among others, of a basic liberal democratic system.

7.5.1 The Social State principle With the decision for a social state, social justice is elevated to a principle of state action. One component of the social principle is the mission of creating, to the largest extent possible, social balance and equality of social chances. In this, the social state principle does not promote the establishment of a comprehensive welfare state, instead it works towards a convergingly equal promotion of the welfare of all citizens with a convergingly equal distribution of the burden. (court decision: BVerfGE 5, 85/198). The question of "how," meaning by which method this goal may be reached, is not set up to be mandatory. A socially just distribution of burden and taxation is viewed as one effective instrument (the economically strong take on a greater burden, progressive taxation). The SO rejects a corresponding state system principle.

7.5.2 Scientology and social state <One of our most basic obstacles to total freedom in this society is the economy.>

In numerous policy letters and paragraphs HUBBARD disparaged wholesale with heavy polemics and dealt out written barrages against political decision-makers and presumed that a <worldwide idiot economy> was in effect. Essentially, the blame for the economic crises was given by the Scientology found to income tax, which he described as "suppressive" and "Marxist":

<Income tax is designed according to the Marxist principle of taxation (you can find that in Das Kapital, the communist scripture): 'Each according to his needs.', 'From each according to his ability to pay.'> [112]

HUBBARD's core thought is that only those people who produce are 'ethical," and that only <non-production" and "parasitism" and thus "down statistics" are rewarded by the "welfare state":

"Not everyone realizes how Socialism penalizes an up statistic. Take health taxes. If an average man adds up what he pays the government he will find his visits to medicos are very expensive. The one who benefits is only the chronically ill, whose way is paid by the healthy. So the chronically ill (down statistic) are rewarded with care paid for by penalties on the healthy (up statistic). (...) On the other hand a totally indigent non-working person is paid well just to loaf. (...) Parasitism is Parasitism. Whether high or low it is unlovely." [113]

According to HUBBARD, neither the old nor the sick and weak, meaning those who are no longer able to work, deserve any help. HUBBARD wants his readers to come to the following conclusion:

"Draw your own conclusions as to whether or not Western Governments (or Welfare States) became at last Suppressives. For they used the law used by Suppressives: if you reward non-production you get non-production." [114]

The SO fully identifies the social state principle with the welfare state of socialist coinage. A consequence of such ideas it rejects the social state principle and pursues radical political tax goals. In doing this it discards the principle of taxation according to ability to pay, which is put into effect as income tax. The SO wants tax money to be collected or compensated in part through a sales tax.

In the USA, the SO is already conducting campaigns to do away with income tax. In the 1990s an association closely tied to the SO was founded for this purpose called the "Citizens for an Alternate Tax System" (CATS), which was to function as a "pressure group" on politicians. So far the SO has not promoted anything like this in Germany. Nevertheless, doing away with income tax is part of the general plan.

It is quite obvious that - aside from the question of feasibility - a political realization of such a concept would have enormous social dislocations as a consequence. While the removal of income tax by itself does not necessarily transgress the social state principle, the lack of propagation of other equivalent measures by the SO is an indication of its dismissive attitude toward social justice. The radical Scientology standpoint towards social and tax politics in not compatible with the social state principle of the Basic Law.

7.5.3 Disparagement of Democracy HUBBARD bases his assumptions on the "uncleared" person, whether that be a private individual, a judge or a politician, because of his aberrations, is not in a position to be self-determined or to behave rationally. The state goal is to increase the "ethics level" up to a "free society" to ensure survival. HUBBARD assessed a society, which <is hindered through arbitrary restrictions and suppressive laws>, to be at <step 2>. [115] According to HUBBARD, that is where the area of "criminals" begins. [116] These concepts are clarified on HUBBARD's "political scale," in which he classifies political systems according to the "tone scale." [117] His "political scale" puts "social democracy," meaning the principle of a democratic social state, at an "ethics level" of "2.0." [118] According to HUBBARD's complex concept, a democratic social state corresponds to a criminal system. This alone contains a political dimension, a momentum, and a requirement that Germany must be "cleared." Besides that, HUBBARD branded civil society as "suppressive." [119] At the same time, HUBBARD reveals disdain for the parliamentary system and presents democracy as collective aberration.

<No political system that is used on a colony of apes could govern anything other than apes. (...) A political system that tries to function among ignorant, uncivilized and barbaric people could have outstanding principles, but could only enjoy it in an ignorant, uncivilized and barbaric state unless one took them person by person and cured the ignorance, incivility and barbarism of each individual citizen. The collective thoughts of apes is ape-thought. A fascism that is led by idiots and used on idiots would be idiot-fascism. (...) The reactive bank [120] - the unconscious mind, however you would like to call it - suppresses all respectable impulses and supports the bad. Therefore a democracy is a collective thinking of reactive banks.> [121]

In the same policy letter, HUBBARD coins the phrase "aberrated democracy" and adds:

<Scientology gives us our first chance to have a real democracy. (...) Therefore, on the basis of factual evidence we can conclude that the first real democracy will appear when we have freed every person from evil reactive impulses. (...) A political philosophy cannot audit. We can.?

HUBBARD also rejected the majority principle:

<Should you ever have the opportunity to elect a leader for your group, don't be 'democratic'! (...) Instead protect yourself from these ladies and gentlemen and the parliamentary process, who know all the legal and time-consuming procedures, but somehow never attain anything other than chaos. A capable successful leader is worth a million impressionable country bumpkins. Democracy hates understanding and ability. (...) Democracy is only possible in a nation of clears - and even they make mistakes. If the majority rules, the minority suffers. The best are always a minority.> [122]

The concept of an "aberrated" society and HUBBARD's conspiracy theories especially reveal the false bottom of the SO's argument that HUBBARD supported democracy. The Scientology founder rejects the majority principle while asserting that only the SO can create a real democracy. HUBBARD even saw fit to grant "amnesties" to state agencies or to subject them to a Scientology "justice":

<If the tax authorities (...) continue like this or if the FDA complains, then of course we can put them before a Committee of Evidence, and if they are found guilty, then we can cancel them accordingly and let it be known they are a suppressive group. I assure you, that this is not as shallow as it sounds. (...) Therefore, whether 'society' accepts it now or not, we must spread our 'Pax Scientologica' like stormtroopers in front of our direct technical actions, or nobody will stand still for auditing, but will collapse in terror, and only a handful of us will be free. (...) So we can develop our habits early, without worrying about whether people accept our administrative technology or not. Always expand it. React by shrugging your shoulders if someone protests or stops for air. (...)

<As you see, nobody will be declared suppressive as long as he or she does not testify against us. And only those who so testify are suppressive. (...) You find them in the 'society' that they named and elected, because such birds play the reactive minds of every individual in the crowd exactly.

<(...) Society is obviously full (...) of paranoid little wolves like Galbatty in Australia or the head of the FDA in Washington. Such men snatch these posts up because they are men full of fear. (...) If you want to handle one of these 'leaders', then put the guy's hat on. It's hard. With Scientology administration and policy. Never fail to use Scientology administration or our justice system to handle the individual person in society outside of our system. It sounds adventuresome. Well, it is! But also effective. (...) You will only fail to handle a situation if you do not handle it with Scientology. The older methods failed. To hell with them! That's why we're here!> [125]

HUBBARD apparently used the term "Pax Scientologica" in reference to "Pax Romana," (Roman peace), which does not mean a peaceful state of transition, but the implementation of a legal system with the strong hand of a dictator.

The SO dos not regard this sort of concept as remote fiction. In February 1999, for instance, during a gathering of the "International Association of Scientologists" (IAS) in Munich, a leading member of this organization stated tat the SO rejected the democratic system in Germany and could not accept politics as it was. At the same time he compare the situation of the SO in Germany with the persecution of the Jews during the "Third Reich." Every time the speaker uttered a sentence that placed Germany beside the United States and the most important place for the SO worldwide, he was met with a round of frenetic applause. During a "Crusade" gathering of the IAS in Stuttgart at the end of August 2001, a functionary asserted, in an emotionally charged mood, that the SO was more on the advance today than it ever was, and that all people would sometime experience a new Scientology world order. On the occasion of another IAS gathering in Stuttgart in August 2002, a high-ranking SO representative made clear that in the Scientology future, they would talk about the hard times of the Scientology "Crusades," when the world had not yet been "cleared."

7.5.4 The SO and the constitutional state principle Constitutional statehood ("Rechtsstaatlichkeit") means that state power is bound and limited with laws to prevent arbitrariness and misuse of power. Some of the irrevocable components of the constitutional state principle are: the right to a legal hearing, judicial monitoring of government use of force and procedural basic rights.

The "Scientology Organization," which means to permit rights only for "honest" people, is at odds with principles like equality before the law. HUBBARD operates on the assumption that a community with such principles is not capable of survival. As justification for that, he imputes critics with destructive intentions:

<The reason why a democracy or any wide open group collapses lies in their broad endowment of privileges to members who strive to destroy them. The idiocy of such behavior is clear. If a person discloses that he is no longer a part of the group, he has rejected the group. The person has rejected the laws and rules, too. Naturally, they have also rejected the protection they were entitled to as a member of the group. Democracy is at odds with this problem and so far it has never solved it. The Constitution of the United States permits people to refuse to give testimony if they would be incriminated by that (5th Amendment). (...) Idiocy is the right word for that. It does not make any sense to extend the protection of the group to a person who afterwards endeavors to destroy the group. That's as if were promoting illness.> [126]

The Scientology perception of justice differs in fundamental ways from that of a democratic constitutional state:

<The purpose of Justice is to clear the organization and the environment. One cannot make Clears in an uncleared environment. (...)> [127]

One of the most important maxims of Scientology "justice" is to create "order" for the expansion of Scientology and to clear resistance out of the way. Examples of Scientology "justice" include:

<JUSTICE: If a person refuses to answer an auditing question, whether it's in an HCO Confessional or other auditing, he or she can be brought before an ethics court and charged with a 'non-report.'> [129]

<JUDGMENT AND PUNISHMENT (...) No one among us corrects or punishes gladly. Nonetheless we are perhaps the only people on earth with a right to punish - (...) But keep in mind that there are times when it is important to put a head, any head, on a pike, to stifle smoldering disorder. Simply remember that law is an action that serves to do away with disorder and to maintain public security.> [130]

The right of an accused to remain silent, ridiculed by HUBBARD, is an acknowledged fundamental of a constitutional state. Forcing testimony makes it unusable. Forcing people to incriminate themselves is a violation of the right to a fair process.

The SO acts on the assumption that the "aberrated" society is not at all in the position to make a rational decision. The state's justice system is alleged to have become a <cancerous sore>, the <police and the court system> are alleged to be composed <primarily of depraved> people. The "Scientology organization" sees its own system, in place of these, as a <new hope for the law> [131] and has created its own justice system:

<In the name of justice, aberrated people come to incredible injustice. The upstat is punished. The downstat gets away. Rumors are permitted as evidence. (...) Our present legal system here often not only offers no protection, but often creates instead new injustice. (...) WISE offers the NEW, based 100% on L. RON Hubbard's technology, justice system. It is administered by a Charter Committee ...> [132]

Scientology justice is not just an offer to arbitrate disputes out of court (sometimes the SO procedures are called "arbitration.) The SO instead rejects the use of the regular court system in conflicts between Scientologists by threatening to ban them from the organization, and tries to keep members from entering the regular court system. For justice they put their own system in place of the courts, and for that purpose use "Committees of Evidence," "ethics" courts and in the Scientology WISE business association so-called "WISE Charter Committees" (WCC). The "Exekutiv Direktive" of a WCC from Baden-Wurttemberg lays down the rules for Scientologists in even more certain terms:

"1. A Scientologist may not introduce a court warning process ("Mahnbescheid") against another Scientologist.

2. A Scientologist may not yield a claim against another Scientologist to a non-Scientologist who would then take legal steps against the Scientologist.

3. A Scientologist may not initiate a lawsuit against another Scientologist in court.

4. While a Scientologist may consult with an attorney, this attorney may not then represent this Scientologist to sue the others.

5. A Scientologist may not charge another Scientologist or report to the police. If a Scientologist acquires knowledge of an illegal act by another Scientologist, naturally this must be handled and will, in that case, also be reported to the authorities. However this happens exclusively via WISE.

6. A Scientologist may not sue a firm that belongs to another Scientologist or in which another Scientologist is even an associate.

Violations of above items 1-6 are suppressive acts and will be handled in accordance with the standard ethics process. A recommendation of one Scientologist to another Scientologist to commit the above acts will also be handled as a suppressive act."

A Scientologist who had a dispute with a WISE company from Baden-Wurttemberg and did not stick to the rules was declared an "enemy" by an "ethics order":

"Condition - Assignment (...)

Enemy (...) had a dispute with (...). He submitted a complaint to the Charter Committee Stuttgart in order to have the situation handled. Without, however, waiting for the result, he yielded the claim for money that he had on (...) to his brother, and his brother sued (...) in court, which (...) would have been stopped from doing, because he is a Scientologist. (...) knew that his brother would sue. (...)For that (...) is assigned a condition of ENEMY as a Scientologist. It is expected that he will (...) 2. bring his brother to withdraw the lawsuit for an out-of-court settlement, 3. Appear in the (...) Org on (...) at 20:00 to participate in a settle meeting with (...)."

Scientologists who do not submit to this have to count on being declared a "suppressive." This involves a formal declaration ("SP Declare") which is broadly distributed in the SO. The "SP Declare" specifies which of the so-called crimes the "guilty party" is "guilty" of.

For instance, a German Scientology member who several years ago had a disagreement with his WISE employer and brought him to court instead of following the internal Scientology justice system had this "SP Declare" imposed upon him:

"DECLARATION TO SUPPRESSIVE PERSON

X from Y is herewith declared a SUPPRESSIVE PERSON. Through her own actions she is guilt of the following SUPPRESSIVE ACTS: (...): 2. INTRODUCE A CIVIL PROCESS AGAINST ANY SCIENTOLOGY ORGANIZATION OR A SCIENTOLOGIST (...) WHEN ONE HAS NOT FIRST BROUGHT THE ATTENTION OF THE INTERNATIONAL JUSTICE CHIEF TO THE MATTER AND RECEIVED AN ANSWER. (...) Should she recant and come to her senses, her way back to good standing is through Steps A through E [133] in accordance with HCO PL 23 Dec. 1965RB SUPPRESSIVE ACTS, SUPPRESSION OF SCIENTOLOGY AND SCIENTOLOGISTS." [134]

Decisions by the Scientology "justice" system can have considerable consequences, such as the transfer of funds, for example. A case was revealed in 2002 of one SO member having sued another member before the "WISE Charter Committee" (WCC) Stuttgart for a dispute over commission payments from a brokerage in an amount of over 45,000 euro. The WCC came to the "resolution" that outstanding commissions would be reduced or settled with other means.

The SO pursues the goal of establishing its form of "justice" in society. In 1998 there came to light a 1993 letter from a WISE functionary which said that it was planned to expand the activity of "WISE Charter Committees" to non-Scientologists. Among German Scientologists, WISE also propagates that people can only <be pulled out of the mud with application of L. Ron Hubbard's ethics and legal technology,> <where other systems have failed.> [135]

7.5.5 The SO and the Executive <We call them in one after another. We use the E-meter. (...) If someone is not ready to do an E-meter test, then you know that he is guilty. If he does it, then you can observe how every time the needle dips down to a 'yes' when you are right, even when the suspect says nothing at all.> [136]

One of HUBBARD's internal papers that is still valid concerns the quelling of rebellion and the fight against terrorism in South Africa. [137] According to this, the security authorities - and also private persons and businesses - will be subject to widespread use of "E-meters" in state and business so that "subversives" can be told from "honest" people: security checks on the E-meter for the personnel in business and agricultural operations; roadblocks set up on highways and service roads to conduct personal checks with an "E-meter." After the "subversives" have be gotten out of the way, the same sort of checks are to be held at regular intervals in the future. Typical of the SO's perception of justice in the same paper is the following:

One could remark that perhaps HUBBARD conceived this under the impression of an exceptional political situation and therefore got carried away with a particularly drastic formulation of words. Nevertheless "E-meters replace guns" is in keeping with the spirit that is consistently found in HUBBARD's teachings. HUBBARD even goes as far as to promote a future society in which one may not obtain work without an advance check on an "E-meter":

<(...) their young upstarts that find themselves in public will probably live in a civilization where they will have to be checked out on an Electrometer to obtain a job, and where there are no irrational and destructive revolutions, for the excellent reason that most criminals will not be available in society.> [38]

These ideas are therefore not "slips", but typify a frame of mind that would lead to a totalitarian surveillance state.

8. A new form of political extremism While the "Scientology organization" would not be categorized as political extremism in the classic form, that is not required because the constitutional protection laws do not contain such classifications, nor are they a provision for surveillance by intelligence agencies. Instead, the sole deciding factor is whether actual indications of counter-constitutional activity are present - as they were primarily described in chapters 5 to 7 - regardless of whether the groups would be described as "rightwing," "left" or in some other way. With respect to the protective purpose of the constitutional security laws to recognize dangers to the basic liberal democratic order in a timely fashion [139], what sort of political flavor the counter-constitutional activities have is of no consequence.

Article 4 [the freedom of religion article. Ed.] of Basic Law is also part of this basic liberal democratic order. This special protection for religious and philosophical communities, and the freedoms of belief and of conscience, is only one of several elements of the basic liberal democratic order and therefore depends on its continued existence. As a consequence of this, those who, under the pretext of practice of religion or in even connection with religious activity, work towards the removal of the higher value-principles of the Constitution, cannot invoke the full scope of Article 4 of Basic Law. As a result of this, the constitutional protection authorities - as long as the legal provisions of surveillance are present - are not prevented by Article 4 of Basic Law from observing religious or belief communities if need be.

<Do they really believe that a society in this condition will grant Scientology public acknowledgment? Hell, no! And to hell with this society! We're making a new one.> [140]

The SO pursues the political goal of replacing our state and social system with a new one that functions strictly according to Scientology principles. The concepts of the Scientology program, though, are not bound to principles of a constitutional state such as the human rights actualized in Basic Law. They contain numerous actual indications of counter-constitutional endeavors and of the goal to establish a totalitarian state system and an arbitrary rule. In such a system, essential elements of basic liberal democratic order, such as the protection of human dignity, the equality principle and freedom of opinion would be in fact put out of commission. Scientology justice, sanctions and laws ("ethics codes") would not guarantee the independence of the courts and the legitimacy of the executive branch like Basic Law does. The Scientology organization's image of humans discriminates between alleged superhumans ("Uebermenschen") and the inferior opposition, propagates that might makes right, and is incompatible with the value system of the Basic Law. The uncritical "leader cult" around HUBBARD also appears significant.

The social and administrative techniques taught by the SO, which in their understanding represents the model for society, aim primarily at having orders uncompromisingly followed, having resistance cleared out of the way, and producing enemy pictures. Criticism and the ability to make compromises - basic conditions for the functioning of a democratic community present - are not undesirable.

Mass gathering in Los Angeles

The ideology and practice of Scientology also continue to show an aggressive basic stance and a radical implementation of will that sometimes uses merciless persecution of opposition. A crass example for this is the notorious "Fair Game" policy of HUBBARD's, which permits people who have been declared "Fair Game" to be injured or even destroyed by any means. [141] This "Policy Letter" was subsequently said to be cancelled by a further policy letter. This makes it clear that this sort of action is no longer fixed in writing. Former Scientologists have repeatedly claimed that the "Fair Game" policy has never really been cancelled.

Today's management operates in the HUBBARD sense in that it says the SO must act like a <piledriver> [142] when it wants members to be somewhat militantly involved. Some observers could remark that all this is really a manifestation of an organization that has overestimated itself, and which has also overestimated its chances in the past. It's indisputable that at the moment the SO does not have the membership potential required to carry out its infiltration intentions on a large scale in countries like Germany. Nevertheless the vehemence and seriousness with which the SO wants to pursue stated expansion goals and to implement HUBBARD teachings are noteworthy. The SO deals globally and with a long-term strategy. For that purpose it has its own intelligence service, which is supposed to clear its path of all resistance.

9.1 History and Mission of the SO Intelligence Service In the 1960s the SO built its own intelligence service, the "Guardian Office" (GO). Because the GO in the 1970 committed felonious crimes such as burglarizing government agencies and theft, the SO saw fit, after this was discovered, to dissolve it. The successor organization was founded as the "Office of Special Affairs" (OSA).

The primary mission of the OSA is combatting critics and their clarifications with covert means. OSA directives and documents, as well as previously obtained findings of basic testimony on the actions of OSA yield the profile of a covert intelligence agency which is in the position to have its actions taken seriously and whose staff are involved at a militant level. [144]

9.2 Overt Information Collection <INTELLIGENCE SERVICE (...) One day the random data yields a usable summary. (...) If an attack on Scientology begins somewhere, we look at the people who are taking part in it and render them useless.> [145]

The OSA differentiates between overt and covert information gathering. The former includes inquiries from association and trade register documents and a systematic media review. In 1998, documents from the first half of the 1990s came to light in which minutes of radio interviews were being noted down and press articles assessed, followed by a list and a review of the people and institutions named therein. Multiple copies were made of the lists and, together with associated reports, were filed in the folders of the corresponding person and/or institutions. The cross-reference lists ("x-filing sheets") allow one to form the conclusion that the OSA as assembled a considerable amount of information about critics and opponents. It could be read from one "x-filing sheet" that discourse gleaned from one SO critic had been filed in 22 different personnel and institution files. The tradition of using the abbreviations "E-Germ" (for Enemy Germany) and "T" for "apostate" Scientologists ("Traitors") appears no longer to be the preferred method. Nevertheless, nothing has changed in the hostile attitude of OSA against critics. For instance, a cross-reference list with the notation of "Enemy media" was available.

Over data collection also includes planned visits to critical institutions. Part of the detailed instructions describe the behavior expected of individual Scientologists in doing so. Afterwards, records of the course of events are to be prepared.

Since the year 2000, open government information sources have served OSA members in various German states [146] through the freedom of information laws, which grant considerable access of third parties to view government files. The same purpose is served by an "Aktion Transparente Verwaltung" (ATV), with operating areas in Munich and Hamburg. Allegedly to fight corruption, the ATV seeks support of a nationwide law for more access to government records at state locations. From experiences in other German states, however, this endeavor is an effective tool to help state agencies in find out exactly what the SO is looking for.

OSA members are prepared to operate in not only a stubborn manner, but in a brazen and aggressive manner as well. In 2001 a document came to light in which an OSA reported how in specific cases, intimidation was used and unauthorized access to state agencies was gained, in the scope of doing research for an investigation.

9.3 Covert Information Collection <We know our enemies, before they strike, we keep them away from important positions. (...) Intelligence agency alertness, even if we do not have any folders, is reckoned in the form of calm, watchfulness and progress. (...) If we deem it necessary to snare someone, then we make inquiries.> [147]

9.3.1 Appearance under a guise Covert data collection includes a suitable guise. OSA adherents repeatedly make appearances as "journalists." One OSA staff member tried to pass himself off to state as well as to private agencies as a "concerned citizen," who supposedly wanted to act as an informant against the SO. In the first half of the 1990s an order was issued in which a survey was to be taken of SO critics. It was supposed to reveal whether the survey subject was a former student of the target person. This same order required expansion of the scope of research by making inquiries of uninvolved family members. This order was actually carried out. In the scope of intensive research, laid out in advance in writing, into the life of a critic of Scientology, phone calls were made under apparently false pretenses to family members and inquiries were made into the sphere of the target person.

9.3.2 "Dust Bin Collection" During an investigation of a German critic in the early 1990s, an order was issued to carry out a "DBC." This abbreviation stands for "Dust Bin Collection," which means a search through the trash of the target person to find written documents. An compliance report was written on a "DBC" of a critic's organization. The operators appeared under the guise of trash collectors.

<(...) we took the trash can between us and rolled it back across the street, (...) The whole operation looked as if two street sweepers worked down in the garage and were simply using the trash can to carry out some trash, (...) We went back into the garage to the parked car, put our normal clothes on and left the site calmly.> [148]

9.3.3 Use of private detectives <Use the state agencies if nothing else will work, such as in the case of embezzlement or bodily injury, but try to operate without involving the local constabulary. We are always better off when we do it ourselves or with private detectives.> [149]

High-ranking OSA functionary Kurt WEILAND remarked in an interview that the SO usually hired their private detectives in the USA through attorneys to disable accusations against themselves or to support their own case. As far as he knew though, this did not happen in Germany, as he said. [150] A document came to light in 2001, however, according to which OSA in Germany had also sought contact with a "PI" or private investigator. In 1998, the Swiss Justice and Police Department reported that in May 1996, a private detective, which had been sent into Switzerland from the USA, was attempting to find out who within the Geneva Justice and Police Departments had anything to do with the SO. [151]

9.3.4 Observations When one prominent Scientology critic visited Germany in Fall 2000, according to findings of the Hamburg constitutional protection agency, he was followed by an observer from the USA. The professionally operating observer worked together with German Scientologists on site. The operative methods used included an extremely conspirative method of operation, covert eavesdropping on conversations, and use of technical means, such as photo and video technology.

In January 2003, in the Brandenburg area, a Scientologist followed the vehicle of a church sect commissioner in which a high-ranking ex-Scientologist was riding. According to the sect commissioner, his vehicle's occupants were photographed and badgered by the Scientologists on the autobahn. During this, the Scientologist braked in front of them and swerved toward the vehicle from the side. The sect commissioner called the police for assistance and filed a charge. The police escorted the vehicle to Berlin. The divine service held by the sect commission in the Luisen Church took place under police protection. Members of OSA were there taking notes. The SO conceded having the ex-Scientologist under observation and under investigation. Their purpose was to take legal steps against the ex-Scientologist. The SO alleged that the Scientologist would be held accountable in accordance with the church's internal discipline for his conduct. The whole operation may have been connected with a tactic that OSA calls "harassment," and which serves to wear down critics.

9.4 Evaluation of information.

In the past, through the systematic collection of information on German SO critics, the SO has succeeded in coming into the possession of personal mail and documents from the workplace, hospital documents, letters to government agencies, records of meetings, and much else. In one case photographic intelligence on the residence and vehicle was obtained, in another case the critic's place of employment. The OSA lays high worth on obtaining material which is as compromising as possible on a target person. Thus there are orders to look for "scandal." Surveillance of one female SO critic in the early 1990s involved visits with men. The OSA pursues a goal of collecting as much as possible about the target person, no matter how apparently irrelevant or relevant the information is, for the purpose of putting together a "mosaic of findings," if needed, to lay the foundation for a campaign of defamation.

In the article mentioned in section 3.1 by the Belgian "Le Soir" newspaper, it also reports that these court proceedings in Brussels revealed more about the data collection of the SO. The files of the organizations there included reports on officers in the security forces there as well as on political persons and journalist, all of which were classified according to the degree of their danger to the SO.

9.5. Defamation campaigns 9.5.1. General <Black Propaganda is a covert distribution of false data which intends to harm, impeded or destroy the activities or the life of another person, group or nation, (...) It is heavily used in 'waging psychological warfare.' (...) Our propaganda is dirty, but it is not black, because it is true. Black Propaganda is fundamentally false. (...) We will not carry out a black campaign, because we are dealing with the truth. (...) We are carrying out a simply propaganda campaign.> [152]

So the OSA justifies "dirty" actions by saying that the SO, in opposition to its opponents, is always in possession of the truth, and is therefore right. The defamation campaigns against critics and opponents are consistently spiced with great harshness. In this way the SO demeans its opponents in the way they are pictures in the "Freiheit" propaganda publication as alleged criminals or mentally ill people. The purpose of this tactic, which is called "dead agenting" by the SO, is to destroy the credibility of an opponent.

9.5.2 Campaign against Germany

The "Scientology Organization uses various means to design a distorted image of Germany and to present it as an rogue state. For years it's been deliberately carrying out a devaluation of attitude towards the Federal Republic of Germany and its representatives. For instance, the "German Office for Human Rights" in Munich, which is counted as OSA, continues to publish statements on the Internet that disparage legal measures, such as the development of a school schedule as "religious apartheid" or as "ethnic cleansing in Germany." [153] With this the SO desires to give the impression that there is no freedom of press in Germany, and even accuses the media of "instigating" the public. [154]

The immoderateness of the accusations peak in the "Scientology Organization" comparing its situation in Germany with that of the Jews persecuted during the National Socialist dictatorship. In the past, this comparison has led to sharp protests against the SO both at home and overseas. Nevertheless they still continue to hold this position on the Internet. To this end, the SO also uses a selection of pictures that are supposed to subtly suggest that the Scientologist's situation is comparable to that of the Jews being deported to extermination camps during the Third Reich era. [155] In regards to this, the SO propagates:

<In Canada and Germany malicious raids were perpetrated upon our churches that are reminiscent of the genocidal attacks on religions in 'less informed' times and societies of history.> [156]

9.5.3 Fabricated "religious persecution"

In November 1997, the report that a German Scientologist had sought for and received political asylum in the USA caused some concern. Grounds for asylum was listed by the Scientologist woman, who came from Baden-Wurttemberg, as <fear of persecution of her belief>. In Summer of 2000, research by journalists [157] revealed that the case was apparently staged for the media by the SO for the purpose of making an example out of Germany at the international level. Several corporation that belonged to the SO had authored letters that purported to refuse employment to the woman, and which referred to her membership in Scientology in a negative manner. These letters were said to be the "proof" provided to the US immigration judge to show that many Scientologists were unemployed in Germany and that it was almost impossible for a Scientologist to lead a normal life. After the woman was granted asylum in the USA, she was said to have sent a "commendation" to a fellow German SO member for his collaboration in the matter.

9.6 Security measures The SO uses various security measures to prevent the disclosure of certain operations, especially that of intelligence operations:

- Since there is extensive reporting done from OSA organizational units, the production of regular situation reports for instance, sensitive information is supposed to be encrypted before sending. [158]

Security of data is of vital importance. DSA and Cont reports must all be sent in their own envelopes and are never sent open in the Org's mail. Security must be maintained to preserve the attorney-client relationship as covered in OSA Network Order 5 Legal Matters and False Impressions. Confidential data must never be faxed or otherwise sent on open communication lines but is handled per OSA Network Order 47, Preparing Confidential Mail or must be encrypted using an approved encryption method. - Regarding the confidentiality of information, one known liability form provides for a penalty of 30,000 DM for non-compliance.

- The OSA headquarters in the USA can send out its own "sec checker" to give "security checks" to OSA personal on site.

- Besides that, the OSA tries to react tactically in situations that are perceived as threatening. In 2001 a document came to light that described how the "Investfiles" [159] were to be brought at a certain time of night to the private spaces of another OSA member because a police search and seizure operation was anticipated.

10. The membership

The membership figures published by the SO are greatly exaggerated. The organization has neither seven million adherents worldwide nor 30,000 members in Germany. Actually it has about five or six thousand people at its disposal in Germany, of them about 1,200 in Baden-Wurttemberg. According to current findings, worldwide membership is about 100,000.

Contrary to the official reports by the SO, the organization and its adherents to not form a completely homogenous group, nor is the SO the allegedly perfectly functioning organization that is likes to portray itself as. Apparently there are quite a few Scientologists who are dissatisfied with conditions in the organizations, most of all with the international management. There is the opinion that today the management no longer represents what HUBBARD once supposedly wanted. Up to this point this dissatisfaction has not turned into a disruptive force for the SO. Splinter groups like the "Free Zone" have developed, however, against with it has taken steps with measures like the copyright law.

There is a "hard core" in the SO, which is formed from the "Sea Org." It's obvious, though, that only a portion of the membership can be counted as part of this core of activists. Elements of fanaticism are evident in these adherents, who are greatly, if not totally, dedicated to the SO, to the point of sacrificing their own material existence. This group is buffered with a diverse layer of more or less inactive members who could not longer continue the Scientology course system, for reasons including financial. Nevertheless, these members also stand behind HUBBARD's teachings, as a rule, and feel as though they continue to be part of the Scientology milieu.

Many Scientologists regard HUBBARD's teaching primarily as self-development ideology, and are not politically oriented in the narrow sense, but uncritically orient themselves, as a rule, to the dogmatic teachings and dictates of management. Numerous Scientologists on the ground level are in the dark, not only as to the activities of OSA, but also regarding the strategic goals of management, only fragments of which they may be aware of. However, the "Sea Org" functionaries at the command level of the SO operate from a different perspective than the base level. One former member from Germany who was employed as an officer in the SO and left the organization in the second half of the 1990s gave the following "Scientology wants to govern the whole world according to its maxims. The organization's claim to world domination is constantly stressed by all functionaries. Staff are under obligation to keep this goal in mind."

11.1 Management of the "church" and "social reform groups" SO institutions are not self-sufficient, but are part of an international hierarchical organization, which is strictly led from the USA. The center of power is the "Religious Technology Center" (RTC) in Los Angeles. The RTC is the owner of the copyrights and trademarks of the works of L. Ron HUBBARD and oversees their proper usage. Also in Los Angeles is located the top management headquarters of the "Church of Scientology International," (CSI), which has more than 1,000 members and through whose management the entire organization is directed. The chain of command runs from there to the appropriate "Continental Liaison Offices," which for Europe is located in Copenhagen. It is from there that national institutions are directed and controlled. In public, most SO activities run over "church lines."

"Missions" are entry-level organizations that offer introductory services. In contrast to them, "Class V Orgs," which appear as "Scientology Churches," offer a broader variety of courses and "auditing." "Celebrity Centers" are to care exclusively for prominent personalities who can be used to polish the SO's image. "Field auditors" offer their own services in a "practice" outside the "orgs."

The SO also makes an appearance in alleged social reform groups. Auxiliary organizations like "Narconon" and "Criminon," for example, claim to be able to use HUBBARD's techniques successfully for drug rehabilitation or resocialization of convicts. The "Kommission fuer Verstoesse der Psychiatrie gegen Menschenrechte" (KVPM [the German equivalent of "CCHR". Ed.]) uses incendiary publications to propagate an alleged intention to fight grievances in psychiatry. It appears, however, that a major part of KVPM's activities are dedicated to spreading portions of HUBBARD's conspiracy theories throughout society.

The "International Association of Scientologists" (IAS) member organization officially has its headquarters in East Grinstead, Great Britain. The IAS is responsible for collecting donations for the so-called "war chest," which is used to finance the "war" against opponents and which is supposed to assure the organization's ability to campaign. The financial reserves of the "Scientology organization" are said to be located in various "trusts." There is no doubt that the SO has enormous financial power at its disposal. At the "continental" level, i.e., Copenhagen, Scientology has a so-called "Advanced Organizations Saint Hill" (AOSH), that offers advanced courses, among other things. The worldwide services center is the "Flag Service Organization" (FSO) in Clearwater, Florida, which is said to employ 800 staff. The FSO and the "Freewinds" passenger ship conduct "auditing" up through the highest levels. Managerial and staff positions at the "continental" level, as a rule, are manned by "Sea Org" members. In public, the SO characterizes the "Sea Org" as a "religious fraternity." A look behind the scenes, however, reveals something different.

11.2 The "Sea Org" - a paramilitary outfit The "Sea Organization" ("Sea Org") was founded by L. Ron HUBBARD in 1967 and, according to testimony from former members, is a paramilitary outfit that de facto exercises power and control over the "Scientology organization." A former high-ranking Scientologist testified as follows:

<The personnel of the Sea Organization are authorized to supervise and take over other Scientology organizations and to demote their personnel ...> [164]

According to its own presentation, the "Sea Org" has about 5,000 members. The self-understanding of this uniformed unit is based on the principle of order and unconditional obedience. The "Sea Org," which understands itself to be an elite unit, idealizes strictness, harsh discipline" and readiness <to go through hell>. Its members are supposed to <destroy>, <exterminate> and <eradicate> any obstacles to the "global expansion" of Scientology. [165] Former members report that the "Sea Org" runs its own penal camp, called the "Rehabilitation Project Forces" (RPF). In public the SO both disputes the existence of the RPF and presents it as an institution to <purify> individuals.

The "Commodore Messengers Org" (CMO) is a sort of cadet institution in the USA that prepares children and teenagers for future management positions. The "Sea Org" operates recruitment offices in international units, which also send "Sea Org recruiters" to national SO establishments. Therefore there are even Scientologists from Baden-Wurttemberg in the "Sea Org," including in management positions. Evidence indicates that the "Sea Org recruiters" have been operating in Baden-Wurttemberg to recruit young Scientologists.

11.3 "WISE" - Spearhead into Politics and Business <When today's businesses and governments understood and could apply the underlying principles of organization and administration, they would provide functioning solutions to end social and economical chaos, rather than maintaining it. And if one regards this along with (...) unstable social and political structures, then the urgency of the situation becomes even more apparent. WISE offers hope and improvement. (...) His [HUBBARD's] philosophy with respect to organizational know-how and his clear explanation for its realization have a direct claim on general application in industry, in business and in the government.> [166]

Although the "church" appears open as a rule, in the SO background, licensees of the "World Institute of Scientology Enterprises" (WISE) business association, who are relatively frequently employed as management trainers for the fields of real estate or information technology, are often not at first recognizable. WISE trainers market as management training seminars which are almost identical with introductory Scientology courses but whose contents is not recognizable to newcomers as Scientology material. WISE, whose stated goal it is to introduce HUBBARD's administrative policies <in broad measure in every society, every organization and nation> [167], has at its disposal for this purpose a worldwide network of "Hubbard Colleges of Administration" (HCA). According to the Internet web site of the center in the USA, the purpose of this network is the spread of Scientology "ethics" and "administration technology" in business, state agencies, in associations and the media. According to a confidential directive, WISE pursues a strategy of making a leadership power out of the SO for politics and business. It's planned, for instance, <to catch management in key position in leading businesses worldwide, who in return will become WISE members and sponsors for LRH's administrative technology.> [168]

A WISE newsletter came to light in 1999, which was directed to the EDP area, which made clear the typical manner of procedure. Outsiders who were expecting only a communications course, were to become more steadily involved with the SO:

"People from your circle of friends, family and workplace will get acquainted with LRH here and his Tech in a businesslike atmosphere they can feel comfortable in. In this way they can take that decisive step that's going to change their lives fully relaxed. After the seminar we also want to help you get your people on the right path for them, be it in the Org, a group of field auditors, WISE or wherever they would like." [169]

Despite their problems in Germany, the SO demonstrates the unbroken intention here at home to put HUBBARD's ideology into the executive branch of government. They continue to publish alleged success reports in which activists have done something to bring the public administration of a foreign city of a million inhabitant to re-organize on the basis of HUBBARD's administrative policies. Even if the truthfulness of such assertions is questionable, these greatly overdone announcements of success recognizable serve the goal of more strongly activating German Scientologists toward expansion attempts of this sort.

The SO's public presentation of itself draws the picture of a patriotic, selfless religion of salvation that is dedicated to charity. A look into the organization, however, results in a completely different picture. The crass contrast between claims and reality justifies the accusation of deliberately misleading the public, and even of using the most bare-faced maneuvers of deception. For instance, the SO possesses two completely different sets of Scientology codes. The one which is pleasing to the ear is placed on "press lines," apparently primarily for the purpose of creating a pretense.

After an initial boom in the early 1990s, the SO has had to accept backsliding and membership loss in Germany. Since that time a plateau of stagnation had been reached in Germany, which varies by area. The alarm cannot be called off, though. The organization is Europe can rely completely on the logistics and the enormous financial strength of the mother organization in the USA. Experience shows that the more freedom the SO has, the more openly and boldly it tries to enforce its claim to power. In the USA, for instance, it takes greater action against against critics than it does in Germany. In an increasingly globalized world, the organization can win enough influence in business and politics to be concerned about during the great social upheavals and crises in eastern Europe, particularly in Russia. The media have reported repeatedly on SO expansion in eastern Europe. Among the most spectacular reports were the articles about the contacts of former Russian prime minister Sergey Kiriyenko with the SO, and the influence that the SO were allegedly able to gain in the Perm region and the western Urals. According to reports, in 1995, the mayor of Perm even gave a SO representative from the USA a symbolic key to the city. The influence is said to have reached into areas of strategic armament. [170]

The "Scientology Organization" deliberately aims to implement a totalitarian "parallel system" and program in a society in which it is preparing for that purpose. To day it has succeeded in Germany only within its organizations or in companies that are managed in accordance with HUBBARD's teachings. The claim to change state and society in Germany in accordance with HUBBARD's teachings continues unaltered.
