MILESTONE - A DECADE OF ABUSIVE AND GROTESQUE LITIGATION! Exactly ten (10) years ago today, on July 29, 1992, Scientologist Laura Vannoy Padgett, filed a civil action against her declared SP enemy husband, Thomas Carter Padgett, in her parents' hometown of Madisonville, Kentucky, approximately 170 miles west (3 hours drive) from where the couple and their 2 children lived in Lexington. Initially, this civil action appearred on the surfaceto be a simple divorce and custody case with the cause being identified by Mrs. Padgett as "irreconcilable differences." In the balance, the best interests of a 12 year old daughter and an 8 year old son, were the primaryconcerns of statutory law application for a reasonably swift "domestic dispute" resolution. This case has spawnedfour (4) additional legal actions from Scientologist Lauraagainst her ex Tom who has also been identified by the Church of Scientology officials as a PTS (potential trouble source) -- 2 civil case appeals, a related (and merged) criminal action, and a criminal case appeal. As recently as August 22, 2001, Laura Vannoy, through her current lawyer William R. Whitledge, entered into the court records as an exhibit via depositions, a print out of the website: http://padgett.taxexemptchildabuse.net as documention of the parties' respective parental differences and concerns. History of documentation shows a littany of settlement offers and mediation gestures from the father, Tom, and ALL being rejected by the mother, Laura, only to be responded to with MORE litigation to bury the issues. Several comments by past and present court officers involved were:- Public Defender Mike Ruschell: "This case has a life of it's own!"- Attorney Robert Ristanio of Lexington: "They're a bunch of peckerheads down there! (Madisonville.)"- Hopkins Circuit prosecutor David Massamore: "I am not going to debate matters of 'religion.'"- Attorney Bill Whitledge: "I just do what my client(s) tell me to do.- Judge Charles Boteler: "Scientology beliefs and practices are admissible, so long as 'harm' can be shown."- Court Clerk Paul Summers: "Sorry, the file is so huge, I can not find the Order, or the transcripts, overruling Mrs. Padgett's Motion in Limine to restrict expert testimony as evidence you asked for. Have your lawyer come look for them."- Domestic Relations Commissioner Susan McClure: "The files were so large and vast, I needed help from the bailiffs to carry them to my car in cart loads to bring home to review." Where does this cultic mess stand now after 10 long dismal years? The children involved are now 21 and 17 years old respectively. They are very hurt and extremely confused trying to sort through their feelings and significant family disfuntions. There are civil court matters still pending regarding normally simple child support calculations, arrears, as well as visitation and custody issues. The mother, Laura Vannoy, lives in a customed built home in a North Madisonville, KY affluent subdivsion. The father, Tom Padgett, has temporarily left a halfway house and safe haven for former members and victims of cult abuse in Massachusetts, because he has an arrest warrant out on him issued from Laura Vannoy's criminal allegations filed back in March of 1998. Obviously something is very wrong here. Who or what is the cause or blame here? Kentucky, like most other states in the U.S., has adopted "no fault" statutes to do away with ugly he said & she said accusations, and to put the best interests of any children at the top of the list of importance in the sad but common break up of marital unions(referred to in Scientology "tech" language as "2Ds." The only person that can be held responsible for allowing thistragedy and travesty of injustice to continue in this case and instance, is the judge - Charles W. Boleter, Jr. For this is HIS doing from the beginning in 1992 when he failed to recuse himself and refused to consider a venue change.
