An order from the Hopkins County, KY court dated and entered on July 30, 2002, was received in Massachusettsby facsimile on August 21, 2002.
In a brief summary, Judge Charles Boteler, Jr. overruled Scientologist Laura Vannoy Padgett's exceptions and objections to Commissioner Susan McClure's April 12, 2002 Report and Recommendations addressing child support amounts and alleged arrears which was merged with a criminal action filed against Tom Padgett by the Vannoy family in 1998 back by the L. Ron Hubbard invented sect's "Fair Game" Policy. What this ruling means is that Tom was thousands (and 1000's) of dollars "overpaid" and is owed a refund to the tune of $15 - 17,000. Boteler had no where to go with this. Tom Padgett's income plummeted from a six (6) figure income as a once sucessful hotel executive in the early 1990s to a current four (4) figure income from the effects of a composite of "dead agent" and Black PR campaigns. Commissioner McClure was scraping the bottom of the barrel for income sources for support calculations whereby she even included as "income" oddly Tom Padgett's recent demanded refunds from the cult, and as well as a $5000 scholarship (donation) for him to go to Wellspring Retreat in Ohio, a place for recovery from the abuses of cults.
In this same Order, Boteler refused to touch the Vannoy families' request to hault visitation between 17 year old Beau Padgett and his father Tom, which Comm. McClure reinstated just this past spring.
Boteler noted at the end, "This is a final and appealable order." Though Tom and his lawyers disagree with many of the issues, they will not appeal simply to bring conclusion to the devious cult litigation which in the end is harmful to the children involved. Laura Padgett, the Vannoys, and their lawyers, may or may not appeal to preserve the sect's disconnection, Fair Game, and destruction by litigation beliefs. They have 30 days to do so.
There is no change in Criminal Action No.98-CR-098 filed by the pro-Scientology Vannoy clan against Tom Padgett. There is still an arrest warrant issued for him with a $5000 bail bond originating from Madisonville, KY.
