I got another incredible sentence two days ago.
A scientologist called Philippe Arsac, ceo of a very small company aimed at finding computer employees, has been manipulated by his OSAgoons and pro-scientology attorney to complain against me before the penal court of Villefranche sur Sa"ne.
He was not satisfied because my website reproduced two non-libelous press articles where he had been quoted as a scientologist, and his company being WISE member then. He pretended I was violating his "religious" rights etc. Well, I believed that WISE was'nt religious...
but.
But there is one law in France, which is very unique in the world.
In 1978, to protect the "privacy" of people, the legislators made a law saying that anyone having a file with names of people (even one name) were forced to declare their "files" to a national commission called CNIL -- for National Commission of Computers and Liberties.
That was mainly to protect abuses commited by reasons of commerce (filing habits, philosophy, politic opinions, etc is not allowed).
But said Commission thought that internet files were like automatized treatments of files, and the attorney of the Arsac tried it against me.
Indeed, I started my website in march 1997 while less than 100 or 150 websites had declared their existence in France, since NO ONE ISP was insisting or saying and even, knowing, that any website containing ANY name should be declared, everyone was ignoring the fact.
So, I was guilty, from 1997 to 2000, of not having declared my website to the CNIL.
The best is that Arsac was'nt named then on my site, but I discovered this fact too late.
And I was sentenced on feb 18th 2003, first in France to be, for this penal thing.
The judge sentenced me to an amend of 450 euros despite of my evident good faith, plus 450 euros for a part of the attorney costs of the Pasta, attorney for the cultist, and plus One euro for the plaintiff's "damages" (The guy asked 15000 euros)
What I don't like is that it could go to my justice records.
I'll have the complete written sentence in French soon.
Now , wait for the next steps:
At least 20 millions french people are guilty of the same "crime:
they have individual names in their organizers, electronical agendas, computers, laptops, CD Roms, DVD roms, Hard disks, memory cards, and even, in their cell phones memories, WAPs, textos, and websites, as well as the employers and commercial employees or sellers have lists of their employees, clients, associates, etc.
Scientology having the very worse ones: lists of "overts" and "withholds" of judges, presidents, ministers, commissioners, high officials, congressmen, senators, etc.
But those potential blackmail lists of deeds can't be sued before french courts. Alas.
