Reached by phone, Yoder said he was "too poor" to make the trips to Springfield, Ill., where his deposition was to take place. He lives in New Douglas in Madison County. He did not appear at the East St. Louis federal courthouse Friday, prompting U.S. District Judge Michael J. Reagan to dismiss the suit on a request by defense lawyers.
"It's a failure of the justice system," Yoder said of Reagan's decision. "We knew this was going to happen."
Yoder said the lawyer [Scientologist Randy Kretchmar] who filed suit on his behalf lives in northern Illinois and bowed out of the case when it was transferred to East St. Louis. Yoder said he has been unable to hire another lawyer.
