Many sites do not allow defamation sites as part of their terms-of-service. Thunderstar.net has TOS that specifically bar this kind of site, yet they allow this particular one, because Thunderstar.net is run by a Scientologist named Andy Hoare.

Read their terms of service and you'll notice it has not-so-subtle jibes at the profession of psychiatry in their Terms-of-service! Its likely the only internet provider that specifically slams psychiatry in their TOS.

In any case, the US allows internet providers to remove or not remove content, that they deem inappropriate, as they see fit. There is no reason that we should NOT complain to the provider about content that is inappropriate, because in most cases providers have already determined what sort of content they DO NOT want -- and often this includes content such as defamation web pages.

You are correct that a provider is not obligated to search out the truth of the content on their web pages. However, US Law has given ISPs discretion to control their content -- and many of them choose to use their power to control content -- some providers more than others.

For example. Yahoo / Geocities and Tripod -- both free web hosts -- will not allow people to put up defamation pages, regardless of the veracity of the statements on the pages. If you don't like the fact that Yahoo / Geocities or Tripod "censors" their pages, then you are free to find another provider that has different Terms-of-Service.

And lastly.

Complaints about Thunderstar.net should be directed to their upstream provider which is Simcoe Community Broadband Network Telecommunications Inc.
