After 20 years of winning litigation with Scientology something has just happened that is the best news I have ever had. Driven by a blind desperation to win at any cost, Scientology and more specifically David Miscavige have made the biggest litigation mistake of their legal history.

The BACKGROUND:

In my last message that I posted about a week ago (below) I explained the current litigation situation and made a prediction. The last part of this new message shows you how that prediction has come true beyond my wildest dreams.

Parts of my last posting:

I am forcing Scientology into a court decision in LA superior court where they will have CSI and RTC declared the legal alter-egos of the Church of Scientology of California and that the appearance of corporate integrity between these corporations is a sham. This undoes their past corporate reorganization and turns all their IRS tax exempt status applications claiming their related corporate entities are separate into a mush of fraud that will eventually undo their tax exemptions.

By enforcing the court decision, I mean there is no settlement possible with me EVER after Rinder's and Starkey's last stunt of trying to turn an off the record settlement meeting with me into an inducement to commit a criminal fraud AND, the new Christian judge cannot be bought. This means they are between a diamond hard rock and a tungsten steel hard spot with only one pre-designed route of entrapping escape... They HAVE TO win the Wollersheim court decision and to win THEY have put all of Scientology legally at risk. I could not have asked for a better way to set the stage for the final act of justice in the Wollersheim case.

I have been working on more people and evidence surprises surfacing for the LA superior court action. In the tradition of Aikido these actions will be triggered and allowed into the court most poetically by the false and inappropriate claims and arguments Scientology themselves will make in their desperation to do ANYTHING to win ...

because this time they really, really HAVE TO win.

It is time to simply get out of the way and allow them through their desperation --- to beat themselves.

THAT PREDICTION HAS COME TRUE!

In the Wollersheim case currently in LA superior court, Scientology just filed a banker's box of documents (about 14,000 pages) in reply to normal motion. At first glance it appears just as their tired old "overwhelm them with paper" strategy, but on closer inspection of the documents, Scientology and its attorneys have filed a collection of their most extreme false statements and have perjured themselves at a previously unheard of level --- EVEN FOR THEM!

At the top of the perjury pile is a desperate David Miscavige telling the court in a 65-page affidavit (you have got to see this at http://www.lermanet.com/dwarf.htm) that he does not control Scientology directly or indirectly. 65 pages of I don,t control Scientology or as William Shakespeare would aptly say "Me thinks thou dost protest too much."

David has put his own head so far out over the line in this declaration that anyone can bring the backbone of the Scientology corporate structure down, the tax status down and Miscavige down on perjury charges all in one place and all at one time, (any former Scientology executive who can counter testify and do declarations that Miscavige controls Scientology and/or the Sea Org and the Sea Org also controls Scientology). If you have every heard the story of the Golden BB being fired from old Vietcong guns that brought down US jets during Vietnam, you have an idea of the power that any single, long forgotten or silenced victimized former executive(s) now has over Scientology's future at this very moment.

It is truly a rare moment of poetic justice where I can see that my 20 years of litigation with Scientology, bomb threats by them and harassment are all worth it because now some long forgotten victim(s) of theirs is going to step forward and delivery the testimony and final blow to answer Miscavige's 65 pages and end the case.

Had Scientology not gone to making such desperate and extreme false statements and just argued the law and facts, they maybe would have some small but reasonable chance of winning the action. Now, because once they have been shown to be committing a deliberate perjury with this judge in an instant and with a single blow, they and their arguments will lose all credibility and they have no chance to win. Worse yet with a judge who will then ask for perjury actions against Miscavige.

What is most hard to believe is that they are doing this entirely to themselves out of sheer arrogance and a belief in a Hubbard-Cooley-Rosen look-alike legal team clones/clowns that seldom win anything but a secret settlement from exhausted and collapsed individuals. What they have done entirely to themselves is so bizarre that if you believed in conspiracies, one might believe that Rinder, Rathburn and a few of the old Scientology attorneys have set Miscavige up to be the fall guy to get rid of him in one dramatic loss. The only problem with that theory is that Rinder and Rathburn are just too dumb to plan so many screw ups on the Wollersheim case in advance so that the guy who is completely and finally hanging out in the wind now is Miscavige.

So I am calling in the most important favor I have ever asked for from every individual who is familiar with what I have done to try to get justice from Scientology. I still need your help one last time. Please get this posting and the 65 page Miscavige declaration (at http://www.lermanet.com/dwarf.htm) to every former Scientology executive they know and ask them to read the declaration and see if they have any credible evidence from their own management experience or documents that prove Miscavige,s statements to be perjury and/or that the Sea Org under Miscavige controls Scientology.

To say that there may never be so powerful an opportunity for some former executive(s) to step forward and change the whole history of Scientology is not an exaggeration. I have waited 20 years to be in this position but the paradox is, that it is not really me that is in this position, it is some long forgotten or silenced victimized former executive(s) who has been waiting in the wings saying to themselves "someday I will come forward. Someday I will tell my story and help stop this pain from being passed on to others. Someday I will stand up to Scientology, its upper management and Miscavige because to remain silent any longer when I am needed and can make such a difference is simply no longer possible if I want to be able to live with myself."

So when I am calling in a favor asking you to immediately distribute this to every network of ex Scientologists around the world "for me and all I have tried to do for justice against Scientology," this too is a paradox. If you really understand what is possible at this moment in the Wollersheim LA superior court action, you should be passing this document everywhere to ex- Scientologists so that you can be the one to bring Scientology to justice at this critical juncture and you can move on and spend more time doing other positive things, because if you do Scientology will never be the same again or able to do so much damage.

It is in your hands now to slam-dunk. I have done my part and beyond.
