The War Against Terror:
A European Lesson For The United States
Between May 9 and 22, 2002, I visited Germany to share information on the trans-national "psycho-terror" and human rights abuses of the Church of Scientology. I was able to make this particular visit because of the generosity of some anonymous U.S. citizens who enabled me to purchase the airfare. They are among those who are concerned that Scientology's human rights abuses, civil rights violations and obstruction of justice be stopped. I visited Germany on this occasion, as I have on two previous occasions (1998 and 2000), at the request of Ursula Caberta who is the Commissioner of the State of Hamburg's Permanent Working Group on Scientology (and now the approximately 500 other sects or cults that exist in Germany). Although she was able to provide for my food, shelter and travel there, her budget was unable to accommodate my airfare at less than twelve months' notice to the State Budget Office.
The few days before my departure from Los Angeles were extremely hectic for all of the usual reasons. However, the primary reason why the Germans were so anxious for me to visit at this time was to update them on some very sudden and disturbing developments in the U.S.A., which are still unfolding on a daily basis. Particularly with regard to the Lisa McPherson v. Church of Scientology wrongful death case, the extortion of Bob Minton and Stacy Brooks, the reversal of their testimony and the resulting perjury and potential impact upon the trial which now commences July 8, 2002, in Tampa, Florida.
Consequently, before departing Los Angeles on May 9, I spent several days talking to many different people and listening to their knowledge about and views of these new developments involving Scientology's corruption of the legal process, extortion, perjury and obstruction of justice. In this regard, several hours before my plane departed, I met at a nearby restaurant with Jesse Prince who had arrived from the Florida the previous day. He is a former deputy leader of the Church of Scientology and was to have testified after me in the Wollersheim case on May 9, 2002. However, the previous day Scientology had paid $8.7M into the court and finally satisfied the 16-year-old judgment against them. Consequently, the Scientology Organization had avoided the hearing to add other church corporations to the Wollersheim judgment in order to satisfy it. This was a major reversal and defeat for Scientology after 16 years of refusing to pay " --- one thin dime to Wollersheim." Or was it? The manner in which the last-minute payment was made, and on whose behalf, coupled with subsequent filings, strongly suggests that Scientology will engage in further chicanery to try and prevent Wollersheim, his lawyers and other lien holders from ever seeing "one thin dime," at least in this lifetime.
To continue my tale, a person I recognized as Scientology Office of Special Affairs ("OSA") staffer Matt Ward, tailed Jane and me to the restaurant meeting with Jesse Prince. Later, we all returned to my home. Jesse Prince left, and Jane and I departed for Los Angeles International Airport. Matt Ward, the OSA staffer, closely tailed us again. This was "Overt Surveillance," which is intended to harass and intimidate whereas "Covert Surveillance" is intended to secretly collect intelligence data. When Jane stopped at the airport terminal to let me off, the OSA staffer also stopped about 200 yards in back of us. Unobserved, I spoke with two airport police officers who separately approached the OSA staffer and prevented him from driving away when he realized that they wished to speak with him. Consequently, a written report was made which included Matt Ward's details and those of the (stalking) incident. That was most assuredly an unsuccessful "cycle of action" and a "downstat" for Matt Ward and his particular OSA Legal Unit. Moreover, this attempted intimidation has more serious and sinister obstruction of justice overtones. The previous day, I had submitted a further criminal complaint to the Department of Justice, supplementing my January 21, 2002 letter to Attorney General John Ashcroft. The supplemental criminal complaint results from the extortion and perjurious testimony given during the motion to disqualify Ken Dandar, Esq., in the Lisa McPherson case. The extortion and perjured allegations represent a continuum of Scientology's uninterrupted racketeering and other criminal conduct directed specifically at me (and others) since late 1993.
My flight from Los Angeles to Frankfurt via Heathrow was not as pleasant and restful as it could have been. I was flying on a Continental Airlines ticket, which cost $773 total, including taxes and service charges. Although it was a Continental ticket, it was a code share flight via Virgin Atlantic to Heathrow and British Airways to Frankfurt.
The stalking incident had delayed my check-in and my pre-assigned seat was given to someone else. Thus, I ended up seated in the rear of the plane, in the middle of a center row of seats and amidst a large group of rock band supporters, as well as the rock band, all of whom were from the north of England. Sleep and sobriety were not on their agenda for the flight. Fortunately, the short British Airways flight from Heathrow to Frankfurt was far from full and very comfortable. Unfortunately, upon arrival in Frankfurt on Friday evening May 10, I discovered that Virgin Atlantic still had my checked bag at Heathrow. It contained all of my clothing except for my business suit. The bag would not catch-up with me until Sunday May 12, in Leipzig. Curiously, Jesse Prince's baggage also disappeared while on a similar trip.
It was 8 p.m. before I left the airport at Frankfurt. Ursula Caberta had traveled by train from Hamburg to meet me. First, we checked into a small hotel opposite the main Frankfurt train station and went to dinner in the outside garden of a northern Italian restaurant at the edge of a meadow and woods. It is summer time ("fake time") there and it is light until after 10 p.m. We spoke by telephone with several people in the U.S. including Ken Dandar who is the embattled attorney for the Lisa McPherson estate in the Lisa McPherson wrongful death lawsuit against Scientology. I have been in his unenviable shoes on numerous occasions over the past ten years!
The next morning, Saturday May 11, Ursula and I caught the 9:30 a.m. train to Leipzig. The train was the latest generation of the German electric high-speed Inter-City Express or ICE trains. The Germans call it the "I See Eee" train. However, I call it "the ice train," which always gets a good laugh. This train can travel at service speeds of over 225 kilometers per hour. It rides on welded rails, advanced suspension, inclined curves and is extremely stable and very quiet. The interior is also very tasteful and advanced. The latest French high-speed trains are even faster and they have been tested at over 500 KpH!
The 2-½ hour trip from Frankfurt to Leipzig (which is in the former East Germany and south of Berlin) ran through very beautiful German countryside bathed in the sunshine and warmth of early spring. Cows, crops, barns, villages, church steeples, woods, lakes, rivers, barges and vast meadows of the yellow flowering raps oil plant - which is processed into cooking oil and can also be processed into a gasoline substitute. A lawyer who works for The Scientology Task Force met us at the Leipzig train station and we (they) quickly purchased me a new white shirt, tie and belt for my suit (as a result of my missing bag). We decided not to incur the expense of new black shoes and thus I was to be dressed, as the Germans suggested, like a "Hollywood lawyer"; dark suit and tie with white sneakers! We checked into the hotel in which we were to spend the night, which was located in the center of the city.
Leipzig is the very old and intact city where Bach, Goethe and Wagner were born. In fact, the annual Bach festival was taking place the very same weekend as we were there. It is in Leipzig that the East German civil rights movement was born, nurtured and grew until the fall of the Wall and the re-unification of Germany in 1989. For that reason, it hosts the relatively new Leipzig Human Rights Award given annually by The European-American Citizens Committee For Human Rights and Freedom in the United States. The Committee is particularly focused upon the influence of the Scientology Organization (the "S0") in U.S. foreign politics, its trans-national human rights abuses and its global totalitarian goals. Europe is especially sensitive to the dangers of all totalitarian groups because of its recent history and experiences with ideologies such as Communism and Fascism. The European community believes that such threats to democracy and human rights must be recognized, monitored and controlled early, while the threat is still manageable. With hindsight, England's Neville Chamberlain would surely agree, as would the families of the followers of religious extremists such as Jim Jones, David Koresh and Heaven's Gate.
The Leipzig Award ceremony takes place in the ornate, centuries old Stock Exchange building near the historic city center. Minister Alain Vivien of France, recipient of the 2002 Leipzig Human Rights Award, has been working with the problems of totalitarian cult threats since 1983. Minister Vivien is now the President of a special and permanent commission (the MILS) established by the Prime Minister of France. The inter-government commission deals with threats to human rights and intercedes on behalf of the freedom of the individual and of democracy whenever it is necessary to protect against totalitarian misuse and abuse by private organizations and sects (cults) such as the SO. Minister Vivien received the 2002 Leipzig Human Rights Award from Dr. Gunther Beckstein, the very popular Bavarian State Minister for the Interior. Dr. Beckstein noted that he, a conservative politician, was presenting the award to Minister Vivien, a socialist politician. In that regard, Dr. Beckstein commented that the protection of human rights should transcend political labels and differences.
Of Minister Vivien it was said:
"With his active involvement in a society susceptible to the totalitarianism of the Scientology Organization, and with his involvement with its former members who have found themselves persecuted and attacked by the Scientology Organization, Alain Vivien has demonstrated merit in the area of human rights, especially in the freedom of the individual and of religion."
Personally, I now dream of the day that a United States Attorney General has also. " --- demonstrated merit in the area," which led The European-American Committee For Human Rights and Freedom in the USA to recognize the contributions and courage of Minister Alain Vivien.
The SO had its OSA staffers and others present, but they could not engage in their typical thuggish intimidation and harassment. Police and security officers from Bavaria and France supplemented the local Leipzig police. Consequently, the SO contingent were kept at a distance from which they could neither harass those attending the ceremony nor disrupt the proceedings. Indeed, on my previous two visits I had received German Secret Police protection against the SO risk!
Similarly, the SO and its OSA were unable to either access or disrupt the dinner reception that followed the awards ceremony. It took place in one of Leipzig's oldest, most ornate and most historic restaurants and beer halls. There, I had the opportunity to talk at length with both Minister Vivien and Dr. Beckstein and to become acquainted with their deputies. Later this year, in September, there will be elections for the German Federal parliament and government. If there is a significant loss of support for the Green Party, and a significant gain in support by the conservative parties, Dr. Beckstein is widely predicted to be the next Federal Government Minister for the Interior. For that reason, we all discussed the real potential of the European governments taking a more pro-active role in ensuring that the United States government properly recognizes that the trans-national activities of the SO are a major international problem and a "psycho-terror" threat in the United States as well as in Europe.
In fact, in a March 1, 1969 issue of Freedom, L. Ron Hubbard wrote a "scripture" entitled "Today's Terrorism." Hubbard commenced this "scriptural" writing stating, "[w] hile western countries are spending billions fighting terrorist activities abroad they are neglecting the one they have at home [in the U.S.]." Later, he wrote: "Extortion, kidnapping, murder-these are crimes. Yet where are the security forces? Thousands of miles away tending to other people's business." Hubbard concluded this page and half epistle by writing, "Terrorists never operated more effectively in any land with less interference and less outcry. The evil is so great the public won't confront it. 1984 here we come!"
The 2002 Leipzig Human Rights Award ceremony was also attended by a significant number of people involved in the fight against the SO from various parts of Europe and North America. Accordingly, I was able to renew the acquaintance of: Gerry Armstrong of Canada (Hubbard's former aide and biographer who has been sued by the SO in at least 8 previous cases and is now being sued by it again for $80M); Rev. Thomas Gandow of Berlin (of whom I shall write later); and Tilman Hauser of Berlin (of whom I shall also write later). I was also privileged to meet, for the first time, luminaries such as: Roger Gonnet of Paris; Joe Cisar of Ohio (USA); Andrea Kupker of Germany; Ursula Mackenzie of London; Birgitta Harrington of Sweden and Professor Claire Champollion of Brittany (France).
Claire Champollion is an amazing woman. She is a linguist (formerly a Professor of German), author and researcher. She is extremely articulate and very learned on a wide variety of subjects. Although she looks and acts as though she is in her early to mid-70s, she is actually 88, and is talking of moving back to Paris when she is elderly so that she will be closer to some of her eight children in her old age! She has been involved in the fight against various cults, such as the Moonies and Scientology for many years and advises us to never give up. For nearly thirty years they kept writing letters to complacent government officials before real progress was made. The fact that the SO would engage in forced letter-writing campaigns of its own and mail an even greater number of letters than they were, did not discourage or deter her and those with whom she fought. Hearing this I thought and spoke of the efforts and example of our very own national treasure, Ida Camburn of Hemet, California.
After the Leipzig Human Rights Award dinner concluded, approximately 15 people returned to the restaurant/bar of hotel where Ursula and I were staying. They were all eager to discuss the various intrigues involving Bob Minton, Stacy Brooks, Patricia Greenway and the Lisa McPherson Trust. Ironically, the previous year Bob Minton, Stacy Brooks, Patricia Greenway, Peter Alexander and Ursula had all sat at the very same table. It was then that some of the differences between Patricia and Stacy had been observed which, because of subsequent events, assumed new significance in retrospect.
Around the same time, twelve months ago, Stacy had referred to Patricia as being her "enemy," and to " --- that criminal Gerry Armstrong," which is generally the language of the SO. Indeed, Stacy Brooks' own recent testimony prompts speculation that she may have been liaising with the SO even then, and had possibly been compromised as early as the spring of 2001.
Certainly, Stacy Brooks has testified to compromising communications with OSA by late 2001/early 2002. Consequently, it is my opinion that the evident SO extortion of Bob Minton and Stacy Brooks will boomerang back into one of the SO's biggest-ever blunders. The testimony as to extortion by the SO and certain of its attorneys, and Bob Minton and Stacy Brooks' decision to relent and to personally participate in the obstruction of justice, has potential consequences for Minton and Brooks that are far more serious than those that they feared from the SO. When victims join with the criminal enterprise of their blackmailers they then become equally culpable and punishable. Remember the case of Patty Hearst? She did not go unpunished and she was a far more sympathetic victim/participant than is either Brooks or Minton.
On Sunday May 12, 2002, Virgin Atlantic finally got my lost bag to me (minus one significant document) in Leipzig and we drove to Hamburg, which is a four-hour trip. The weather was glorious, as it was throughout my visit, and the countryside as stunning as it had been for the trip from Frankfurt to Leipzig. On Monday evening (May 13) I had dinner with another friend ("Q"). Q is an independent producer of television documentaries. I first met Q in 1997, when he was working on the ARD television exposé, "Scientology, the Dark Side." A piece of film which I refer to it as the, "All the dead bodies video." Indeed, it should be on the plaintiff's exhibit list for the Lisa McPherson trial.
Q had filmed an interview with me as part of that ARD documentary. The day following that interview, I rescued Q from Scientology chief private investigator Eugene Ingram and six SO thugs who had managed to block his rental vehicle and had also managed to occupy the hotel rooms immediately opposite and surrounding Q's. Q and I remain in regular communication. His documentary on (and with) the international terrorist Carlos (the jackal) was recently broadcast.
Q has just finished a fascinating and potentially explosive documentary that was filmed on the East Coast of the United States, concerning the CIA's "assassination manual" of the early 1950s and former biological warfare researcher Frank Olson, who later died mysteriously after working on, and becoming concerned with, the CIA's Project Artichoke or MK (Project Mind Control) formerly Project Bluebird, also in the early 1950s. Project MK was supervised by the CIA's Office of Scientific Intelligence ("OSI"), which originally led the Bluebird/Artichoke program. I am being put in touch with some sources and document archives involved with the fascinating Bluebird/Artichoke program/Project MK.
The CIA mind control "special interrogation" research for "overseas investigations" included mental manipulation experiments involving hypnosis and low levels of induced electrical charges (which are also part of the subsequently developed Scientology "processing"). There is a rather curious Scientology document that relates to some of this work. Indeed, Arnie Lerma of Virginia has been studying the addictive effects of the induced low-level electrical charges that the Scientology E-Meter transfers to the human body. Over the course of "a session on the meter" the aggregate trickle charge of electricity would often amount to fatal levels if administered in a single charge.
The CIA's mental manipulation experiments also involved the use of various drugs such as LSD (which Hubbard's eldest son claimed his father had used in the early 1950s when writing some of the Scientology "processing" materials). LSD was also used on Frank Olson before he became disenchanted with the nature of his work. Frank Olson appeared to have jumped to his death from the tenth floor of a building in 1953. Or was he pushed? The circumstances of his death resembled assassination methods described in The Assassination Manual, which is apparently now used by certain foreign governments engaged in international terrorist activity.
In 1975, during the Ford Administration, then White House Chief of Staff, Dick Cheney, and then Secretary of Defense, Donald Rumsfeld, successfully recommended a Presidential meeting and an apology to Olson's widow, as well as a payment of over $600,000, in exchange for her silence and co-operation in the official "explanation" of the circumstances surrounding her husband's "suicide." The CIA has steadfastly denied that it had ever engaged in the murder of U.S. citizens on U.S. soil!
Later, Frank Olson's son had his father's body quietly exhumed and independently examined. The terrible truth was laid bare. The body was perfectly preserved; it had none of the disfigurements reported by the U.S. government; it evidenced the administration of LSD; and it bore the trademarks of an Assassination Manual type death. The Project MK documentary is expected to air in late summer. Unfortunately, and not surprisingly, some of the evidence concerning several SO related deaths, which was in the "temporarily sealed" Fishman-Geertz case, appears to indicate the possible application of Assassination Manual methods.
It is an open secret that intelligence organizations prefer to keep potentially embarrassing situations at arms' length so they may engage in a "plausible denial" if the operation is discovered. For this reason, the SO regularly uses flawed operatives such as Steven Fishman and Garry Scarff, and independent private investigators such as David Lee, from whom they can distance themselves with the "plausible denial" and allegation of mental instability or rogue agent.
The 1993 IRS-Church of Scientology "confidential" tax settlement also involves a room full of documents at the IRS offices in Washington, DC. Curiously and shockingly, Freedom of Information Act requests for access to those documents have been denied upon the grounds of the "national security" of the United States. These documents relate to a so-called "church" tax-exempt status application! Any such CIA Project MK and SO connection might merely be foolish speculation and conspiratorial conjecture. However, it may also have been very convenient, for reasons of "plausible deniability," if the CIA were able to monitor the use of hypnotic and induced low-level electrical mental manipulation techniques by ignoring, and by continuing to ignore, the U.S. activities of the SO in this area. After all, this was the paranoid 50s where "reds" were "under beds" and vast sums of money were being disbursed for all kinds of often questionable research that one day might benefit the West in the Cold War against Communism. Indeed, in the early 1950s, L. Ron Hubbard had his own Manual on Brainwashing and expressly claimed that he could, " --- brainwash people faster than the Russians."
There is another disturbing aspect to the [once] "confidential" 1993 IRS-SO tax agreement. It provides special, unique and unlawful tax benefits and procedures to the SO. The agreement further provides, in language buried deep within the long document, that the U.S. government will be in breach of the SO tax settlement agreement if the U.S. government provides any of the [special and unique] tax benefits and procedures given to the SO to any other church in the United States. In some countries there is a state religion, which has unique and special privileges that are not enjoyed by other churches operating in that particular state, i.e., the Greek Orthodox Church and the Church of England. The "Establishment" clause of the United States' Constitution expressly prohibits the establishment of a state religion in the U.S. All [genuine] religions are supposed to be equal, as they are in Germany. However, because of the express, unique and special provisions of the 1993 IRS-Scientology tax closing agreement, the Church of Scientology has arguably been "established" as the state religion of the United States of America, in that it now has unique and special privileges.
I spent the next Monday and Tuesday (May 13 and 14) at the offices of the Task Force on Scientology or Arbeitsgruppe Scientology (http://www.arbeitsgruppe-scientology.de). It probably has the best Scientology archives in Europe as well as a very helpful staff with whom I have spent time before. I spent much of my time working on the first version of a new paper, which I have entitled "An Introduction to Scientology's Corruption of the United States' Government and Its Legal System." This document has been translated into German for broad distribution there. I have also been requested to update and expand my 1998 paper "The Dark Side of Scientology" for similar translation and distribution. Any constructive criticism on either paper would be gratefully appreciated.
One thing that frustrates Ursula Caberta is the constant requests from U.S. activists and victims for financial assistance. In that regard, the Scientology Task Force not only has the usual spending restrictions of a government entity, but it is always struggling for funding itself. Indeed, it has to submit its requests for annual funding over 12 months in advance. Similarly, Rev. Thomas Gandow and the other ecclesiastical (cult) commissioners always have to beg, scrimp and scrape for their own funds. It is also difficult to assist any U.S. Scientology victim seeking immigration asylum in Germany. A successful applicant for asylum must have suffered political, religious or other persecution from a national government and not from a non-governmental entity, such as the SO, corruptly manipulating the legal process.
One thing that we have discussed reviving and pursuing is the potential incorporation of an entity [perhaps "The Commission on Mental Manipulation", or "COMM"] as an international non-governmental organization (NGO) that would work with, and receive funding from, organizations such as the United Nations, the European Parliament, large foundations and other NGOs. I did extensive research on this in late 2000, when Bob Minton and Stacy Brooks were interested in expanding the activities of the LMT. However, by May 2001, Stacy had gone cold on the project. Clearly, the SO destruction of the Cult Awareness Network ("CAN") and the Lisa McPherson Trust ("LMT") teaches that such a new entity would have to be carefully structured and positioned.
Mid-afternoon on Wednesday May 15, 2002, I took a two-hour ride on the high-speed ICE train from Hamburg to Berlin where Pastor Thomas Gandow met me. He is in his mid-50s and has been the Lutheran Church's Commissioner on Cults for over 20 years. He is also the editor of the Berliner Dialog, which is a magazine dealing with psycho-terror organizations, sects, cults and extremist new religious movements. For the next two days Rev. Gandow and his lovely wife, Ute, were my gracious hosts who pointed out various Berlin landmarks, imperial edifices and cold war relics as we went about our appointments.
The next day, May 16, we drove into Berlin and went about our day's engagements. The first was at the German Parliamentary offices next to the Reichstag building, which houses the Bundestag (or Federal Parliament) and which is also adjacent to the large new German Chancery building. The Reichstag is a huge, old imperial building dating back to the nineteenth century. However, its interior was recently gutted and it is now an up-to-the-minute parliamentary chamber. The adjacent parliamentary office building is also super-modern and the interior amazingly "Starship Enterprise"- like. Security measures abound, but they are not the same as the rigmarole that the U.S. has introduced since September 11, in spite of the longer and more extensive experience that Germany has had with terrorist violence.
We had met with a German Parliamentarian for nearly an hour, when we were interrupted by a vote in the Parliament chamber (which occurs by voice and hand). The Parliamentarian was very familiar with the evils of Scientology and its commercial frauds in Germany, particularly in the Hamburg real estate market. Accordingly, the Representative was more interested in discussing new issues involving the SO, ones that would be of concern to members' constituents. For my part, I was laying the groundwork for my next visit to Germany and my future introductions to Federal Government Ministers who could assist us in the U.S. through the communication with, and education of, their U.S. Federal Government counterparts.
I also learned from the Parliamentary representative that the comparison of Scientology to the Taliban does not play as well in Germany as it does in the United States where the SO is widely (though erroneously) considered to be a church. The comparison falls flat because few Germans consider the SO to be a church or to have any religiosity at all. This shift has only occurred over the past ten years and it can be credited to the public information and education provided by sources such as the State of Hamburg's Task Force on Scientology. For this reason, Ursula Caberta is Scientology's "enemy number one" in Germany.
Next, we met with a newspaper photographer and the editor of a large media group that produces daily, weekly and monthly publications. The interview lasted over three hours. Afterwards we went to dinner with Tilman Hauser and his companion Ilse. She was once married to a Scientologist and, not surprisingly, the SO destroyed the marriage as it did with the marriage of my friend and housemate, Jane Scott. Ilse has written a book describing her own experiences. With Tilman and Ilse we spoke of the SO's abuse of children and the problems being encountered by, and with, second and third generation Scientologists who have no frame of reference outside of the group. Like Tory Christman [formerly Bezazian] of Los Angeles, she compares this to the movie "The Truman Project" wherein Jim Carey's character lived within four blank walls until one day he found a hidden doorway which opened into an outside world that he never knew had existed. Germany is now facing analogous problems with many of the young adults from the former East Germany who were brought up under the old Soviet totalitarian system.
On Friday May 17, I had another media interview for both radio (with over dubbing) and magazines with a reporter for a different media group. I have found that the media is currently less interested with the subject of Scientology per se, but is much more interested in hearing individuals' stories, such as my own ten-year litigation saga involving the church and the numerous cases in which I have participated. Following this interview I caught another ICE train back to Hamburg, and a dinner with Ursula's staff attorney.
SO lawyer Kendrick Moxon recently lost a case against Ursula Caberta in the U.S. When she had visited the LMT in Clearwater, Moxon had her served with a lawsuit that was ostensibly filed on behalf of a German Scientologist. The lawsuit alleged that the Hamburg Task Force on Scientology had violated his civil and religious rights. This was the Heller v. Caberta litigation in Florida. On its face, the Heller lawsuit was defective because of the sovereign immunity doctrine and because the commercial activity exception clearly did not apply. Moxon then filed a second complaint that attempted to plead around the fatal sovereign immunity obstacle. After several years of typically abusive SO "discovery" [litigation harassment] the court dismissed the Moxon/Heller complaint on May 9, 2002, which was the same day that the SO paid $8.7M into the court in the Wollersheim case. The Heller court commented that the SO could not use the Tampa/Clearwater court to litigate grievances with the German government and its officials.
Three business days later, the SO retaliated in Hamburg. Through the SO front group, the Citizen's Commission on Human Rights ("CCHR"), the cult sued Ursula Caberta again. It filed an initial complaint for defamation with an Administrative Court in Hamburg. However, it appears that the latest retaliatory lawsuit is another Scientology "foot bullet" that is also doomed to an ignominious demise as well as the awarding of fees and costs to the State of Hamburg government.
Curiously, late last year Stacy Brooks was apparently referring to SO lawyer Kendrick Moxon as, "my friend, Mox." Reportedly, she also commented that Moxon was not the terrible person that he is usually portrayed to be. "He is a really nice guy who is just being a good attorney." However, in my experience and opinion, Moxon has nothing in common with "goodness" as an attorney or otherwise, most assuredly not in his role as a SO attorney. Now, Bob Minton is reportedly describing SO lawyers Hertzberg and Weinberg as being "really nice guys" and he is throwing his arm around the shoulder of SO-OSA staffer Ben Shaw. The New York Times story on the circumstances leading to the confidential 1993 IRS-Scientology identified Ben Shaw as the OSA staffer who paid a private investigator one million dollars to examine the back-ground of the then IRS Commissioner. Was some of the money used to set the then IRS Commissioner up in a compromising, criminal "position?" There are those who claim to have such information.
Ten years ago, the Scientology organization in Hamburg was the crown jewel of Scientology organizations and Class IV churches ("Orgs") around the world. It had repeatedly won the annual "L.R.H. Birthday Game" for being statistically the most productive Scientology Org on the planet. Later, it would emerge that the Church of Scientology, Hamburg, had achieved this status through fraud and deception. Such an irony within this organization!
Now Scientology Hamburg is a mere shadow of its former self. The Hamburg Org had to leave its former premises and had such difficulty obtaining a new lease that it paid a huge premium for a central location. Allegedly, the Church of Scientology, Hamburg, is now insolvent, therefore bankrupt, and under German law, unlawfully continuing in business. However, Scientology Hamburg has been permitted to continue doing business because of correspondence from the legally separate Church of Scientology International ("CSI") providing assurances that it would be responsible for the past debts of a separate legal entity, the Church of Scientology, Hamburg. In a recent letter, CSI now claims that it never intended to be responsible for past debts if there were to be a bankruptcy proceeding. Either way, it is interesting that CSI has now created evidence of what it denied in the latest Wollersheim proceeding. There, it paid $8.7M into the court to avoid a hearing upon alter-ego issues, sham corporate structures and over 150 allegedly separate legal entities that were allegedly just one big bad ball of wax controlled by the SO s elite paramilitary Sea Organization which is commanded by "ecclesiastical leader" "Captain" David Miscavige.
An example may serve to illustrate how bad things have become for Scientology in Europe. On Tuesday night (May 14), Ursula, others and I left a restaurant and happened to be driving past the Church of Scientology building with its large satanic (8 pronged) cross-emblazoned on the exterior. The entire building was lit up like a Christmas tree. However, although "the lights were on" there seemed to be no-one home. We stopped the car and a face unfamiliar to the cult went to the main doors and rang the buzzer. There was one person in the building. He kindly provided the latest issue of Scientology's Freedom magazine. Dominating the cover was a story attacking Ursula. Increasingly, Scientology facilities in the U.S. are also nearly empty when once they were crowded and flourishing. Increasingly, the SO appears to turn to commercial activity and financial fraud as a source for funds.
Last week, a journalist asked me why, with Scientology "on the ropes" in Europe, there should be inter-governmental co-operation on the "Scientology problem?" As an analogy I used the Time Magazine, May 6, 1991, cover picture, which pictorializes Scientology as a giant octopus. The octopus has its head in the U.S. and its tentacles reaching into different nations around the world. Germany and other nations can sever pieces of the tentacles, but the severed tentacles of an octopus replace themselves. Unless the actual head of the octopus in the United States is dealt with, the creature will continue growing new tentacles and oozing more dark, evil activity around the planet just like an octopus oozing so much ink. Indeed, the SO is now doing that through Eastern Europe and Africa via the recruiting fronts of the World Institute of Scientology Enterprises, the Association for Better Living and Applied Scholastics. Consequently, the evils of Scientology must also be handled at their terrible heart within the USA. Indeed, it is at Gilman Hot Springs near Hemet, California, that Scientology has its fortified-armed international headquarters ("the Base") and RPF (or "gulag"). It masquerades as the "Golden Era Productions" ("Gold") film studio.
On Monday May 20, 2002, a journalist for another major newspaper published throughout Germany traveled to Hamburg for a five-hour interview with me. The next day I met with a reporter with one of Germany's largest media conglomerates. Then, I traveled to Frankfurt for a Wednesday, May 22, flight back to Los Angeles via London's Heathrow airport. Unfortunately, the return flight from Heathrow was not without incident. Two hours out into the Atlantic there was a mechanical malfunction and we had to return to Heathrow after dumping fuel. We made an emergency landing with a pursuing fleet of fire, medical and police vehicles and had to be towed into the terminal for repairs. Several, who recognized me from television documentaries on Scientology, suggested it might be safer for them if I took another flight. However, we eventually departed and arrived in Los Angeles six hours late.
Upon my arrival in Los Angeles, I discovered another SO outrage. On May 8, 2002, Ava Paquette, Esq., of the OSA Legal Unit designated as Moxon & Kobrin obtained and served a Writ of Possession upon American Airlines. It levied "money paid for round trip tickets to American Airlines for Graham E. Berry (leaving LAX on May 9, 2002 at 7:00 p.m., Flight 136) --- third party possession of funds due to the Judgment Debtor." This was the order of costs in Jeavons v. Church of Scientology. In 1998, I had ghost written a complaint for a pro per litigant in Jeavons v. CSI. In this case, Scientology had retaliated against a helicopter media fly-over of its desert base, described as a "gulag" by former Scientologists. The SO had made material misrepresentations to the FAA in support of a retaliatory complaint seeking suspension of the helicopter pilot's license. I was too busy in the Berry and Pattinson cases to represent Jeavons. However, I ghost wrote his complaint, shepherded it through the filing process and had it served. I had indicated I might later enter an appearance in the case. Moxon filed a Cal. CCP § 425.16 "SLAPP" motion. He successfully argued that the SLAPP statute and the Cal. Civ.Code § 47(b) litigation privilege protected CSI's FAA complaint about Jeavons, no matter how false the evidence or how foul CSI's motives might have been. Because I had drafted the complaint, and might appear as counsel, he argued that both Jeavons and I should be subject to the automatic cost shifting provision of the statute. The judge said it was a very difficult call, but agreed on balance. Moxon & Kobrin have already seized my old Jeep in connection with this costs order and judgment. In blatant defiance of an express statutory exemption, and through misrepresentation involving the California Department of Motor Vehicles (that I owned two vehicles), they have unlawfully withheld the $900 proceeds of that auction sale.
Unfortunately, the nature of the Scientology Organization is such that I cannot publicly report on all of the meetings and discussions that I had in Germany, or my movements and plans for the next twelve months. However, I do believe that those involved in fighting the world's most evil organization must now stick together, in mutual self-defense, more than ever before.
In a post to ARS on April 16, 2002, ("Graham Berry Speaks Out Regarding Bob Minton, Stacy Brooks and the Lisa McPherson Trust") I counseled verbal and written restraint until the evidence was in regarding the speculation as to what Minton, Brooks and the SO were doing together. Some of the evidence is now in and you have read of my reaction above. However, in that April 16 post, I also wrote that for some " --- this may be a part-time game played from the comfort and safety of a home computer. For some of us in the trenches, this is an unrelenting and dangerous nightmare --- " From my own perspective I cannot over-emphasize the damage done by the vicious backstabbing and constant infighting by certain ARS "critics." Recently, reportedly, Stacy Brooks has echoed this "damage" in her testimony in the SO Motion to Disqualify Ken Dandar in the Lisa McPherson case.
In that regard, and during my most recent round of meetings in Germany, a regular comment was that many Europeans dismiss ARS as irrelevant and counter-productive. "Those people are stupid and ignorant. They are not fighting Scientology. They are fighting each other." Indeed, Tory Christman has repeatedly tried to teach the self-styled "street critics of ARS" that this infighting and backstabbing just plays into the standard SO OSA strategy of "distract, divert, divide and destroy." We all need to listen to these lessons from former members, and from Europe. As Europe has painfully noted, "Those who forget the lessons of the past are doomed to repeat them." Regrettably, the United States is now ignoring the lessons of the past by ignoring the Church of Scientology in the War on Terror. It grieves me that no one in any of our three branches of government " --- has demonstrated merit in the area" that led The European-American Committee For Human Rights and Freedom in the USA to recognize the contributions and courage of Minister Alain Vivien at Leipzig on May 11, 2002.
