I didn't mention it in the recent rush, but the appeals court kicked back the appeal on the contempt business over the accidentally posted trial transcript saying the judge needed to justify his award (or lack thereof) a little better. The cult filed the usual several inches of paper and I got the date wrong. Frankly I don't think that the problem of scn is going to be solved in the courts, 40 plus years of history indicate that. Defendant misread the order setting briefing dates as his response being due August 24, 2000 rather than August 4, 2000 and did not realize his error until the past weekend. Bankrupt defendant is not certain what he would say in the face of inches of legal paper and complex arguments by expensive lawyers. To remind the court, Defendant's original purpose was to call attention to dangerous and abusive policies and practices of Scientology which hurt, defraud, or kill its members. On June 25 of this year, Stacy Moxon Meyer, the 20 year old daughter of Kendrick Moxon of Moxon and Kobrin (Scientology's in house law firm) was electrocuted and burned beyond recognition in a transformer vault at a Scientology's desert compound near Hemet, CA. She died under extremely strange circumstances. (See www.parishioner.org/osha for the government report.) The court can impose no penalty on me which compares to this. (I have a daughter of about the same age. My condolences to Mr. Moxon and his wife Carla.) If the court has already ruled on the matter of amounts of legal fees on which it requested briefing, this motion is moot.
