In my statement of allegations in support of a criminal charge under the Criminal Code of Canada, I WILL SAY.
I came to Canada and applied for refugee status here because I was harassed and threatened with death by a cult in the US.
In the US I was subjected to years of continual harassment, including large numbers of hang up phone calls (made from payphones), being followed by private investigators or cult members, having private investigators stake out my house and locate and harass my friends, neighbours and relatives. My parent’s house in another state was picketed, and my daughter was threatened with kidnapping (I have a transcript and the police in California have the tape.)
My home has been picketed; my cars have been vandalized. I have been attacked several times and once was physically forced into fast moving traffic by two agents of this cult.
This information can be verified through news stories, Internet web sites and a running log of the harassment in the Internet news group alt.religion.scientology.
Since arriving in Canada four years ago I have been stalked a number of times, especially while in the company of Gregg Hagglund, an Oakville resident who (with his family) has been subjected to criminal harassment to an extent equal or greater than mine. The harassment of Mr. Hagglund may be verified through the Toronto police.
To the best of my knowledge the physical harassment, scam phone calls, and stalking of both Mr. Hagglund and me were suspended about two and a half years ago. (There may have been low level surveillance, but not at an obvious level.)
So it was a considerable shock to have open harassment, what this cult calls "noisy investigation," resume.
Friday morning, April 28, 2005 I was driving to work. Just after making the turn from Wayne Gretzky to Elgin I noticed a co-worker walking to work. I stopped to pick up him up in a wide driveway used by Stelarc. (Just across from the Brantford Police Station.) This was within a few minutes of 9 am.
A Grand Caravan, license# ATCR 068 (Ontario, photo #7) pulled in behind my vehicle, closer than would be expected. My co-worker is aware of the vehicles of company people who stop to pick him up. He looked back and realized it was not someone he knew. He then asked me why the driver was blatantly video taping us?
His words came as a dismaying shock. I was both scared and angry that the harassment was resuming. I had nightmares about it that night and the following night. I jumped out of my vehicle and confronted the person. He was alone, driving with his left hand and holding a video camera with his right. I stood in front of his minivan. Still holding the camera the driver backed up into the driveway. I followed not letting the vehicle get more than two feet away so that if he tried to run me over he would not have much speed.
When his vehicle was at right angles to Elgin he went forward hitting me. The vehicle had enough speed to bend me at the waist over the vehicle’s hood, a fact that could be verified from his video tape which I believe was still running (if it has not been destroyed). As my co-worker saw the vehicle hit me he went to the side of the vehicle and thumped on the window, yelling for the driver to stop.
After failing to push me out of the way with his vehicle, the driver reversed and backed his vehicle further into Stelarc’s property in a half circle with me staying within two or three feet in front of his vehicle. He stopped when he was almost at right angles to Elgin again, but pointed away from Elgin. He could not have gone much further without backing into one of the bins Stelarc uses for metal scrap.
At the point he stopped I called 911 and was connected to the police station across the street. Unfortunately there were no police available so the dispatcher called in some cars.
After calling 911, I called my wife (Arel) and gave her a description of the person in the vehicle. She made notes (Exhibit A). He continued to tape during most of this time alternating with calling on a sliver coloured cell phone.
When the police arrived (in two cars, Officers Billone, Oliver, and third whose name I did not get but is pictured in Photo #8) I told them that the person I had at bay who had been video taping me was probably a PI. I also said I had been harassed by PIs and cult members a number of times before.
I also told the officers that he had hit me with his vehicle and that I had a witness to the event.
A minute or two after the police drove up, my wife came over from home with a camera. She photographed the entire scene. Photos 1-3 are of me talking with the officers, 4-6 are her attempts to photograph the driver through the windows of his vehicle. Photo 7 is the license place of the vehicle. Photos 9-11 are of one of the officers talking to the driver. The driver’s face is clearly shown. Photo 12 shows where my vehicle was parked.
One of the officers talked to the driver determined that he was working for a PI. The police identified the driver, but would not identify him to me. That is why this information is sworn out against the unknown person in the vehicle depicted in Photos 9-11 attached.
The police did provide me with the name and phone number of the company the driver (PI agent) told the police he was an agent for. It is:

When the police gave me this number, I immediately called Mr. Brewer up from my cell phone and inquired if he did have an agent in Brantford that morning. (I have had experience with PIs lying about whom they were working for.) He was at first not cooperative so I handed my cell phone to the police who talked to him. Apparently Mr. Brewer verified that the driver of this van was his agent.
After talking to this PI agent, and his boss one of the officers informed me that they would not arrest the PI agent.
The officer told me that I could lay a private charge with the Justice of the Peace if I was dissatisfied with their handling of the situation. The officers would not tell me if I was the target of this PI agent.
Photo 17 shows the PI agent leaving the area.
Half an hour or so later I called the PI’s agency and talked again to Mr. Brewer. Mr. Brewer would not admit or deny that I was the target of his agent’s blatant aggressive behavior citing client confidentiality. He implied his agent’s behavior might have been because my car was similar to someone else they were investigating.
He did say he knew whom he was working for and denied that he was working for a "religion." If he was working for Scientology, their lawyers or one of their many fronts this is a true statement. They have been denied religious charity status by Revenue Canada and are a criminally convicted corporation rather than a religion in Canada

"In summary, every aspect of this case demonstrates the very real and persistent malice of Scientology."
Mr. Brewer also threatened to sue me if I posted any libel about his firm. I told him I would email him [DL_Brewer (at) hotmail.com] a draft of what I was going to post about my encounter with his agent and did. (Attached posting, Exhibit B)
Later that morning Mr. Hagglund also tried to talk to Mr. Brewer about the legal pitfalls of working for the cult. Mr. Brewer was not willing to talk to him.
I have every reason to believe that this was a blatant attempt to harass me and scare a co-worker. It is consistent with a long-standing pattern of criminal harassment for the following reasons:
1. Openly taping someone is not ordinary PI behavior. It is however part of the "noisy investigation" (intimidation) policy of this cult. I know other PIs and it is their professional opinion that this was not an ordinary investigation.
2. The minivan was rented from Enterprise Rent a Car. (See Exhibit C attached Ontario "Used Vehicle Information Package." The PIs working for this cult have frequently used rental cars for stalking. (Exhibit D) Canada’s privacy laws make it impossible for a citizen to get information about the person who rented this minivan.
If I had not involved the police, I could not have found who was behind this harassment even with the license number. One wonders why the agency would go to the expense and aggravation of renting a vehicle if the intent was not to commit an unlawful act.
3. That very day, April 28, 2005, Gregg Hagglund reported his trash had been taken. Several years ago this was done on an almost weekly schedule, a few times Mr. Hagglund even saw cult members or PIs taking his trash. This time he found his trash was gone but not any others on his side of the street.
4. Other people on the cult’s hate list (Exhibit E) have reported a recent upsurge in PI activity. (Three people on this list are Canadians, Gerry Armstrong, an ex member who lives in BC, Kady O’Malley a journalist covering Parliament in Ottawa, and Dr. Steven Kent, a professor at the University of Alberta.)
The charges:
Assault
Accused #1 did unlawfully commit an assault upon Keith Henson, contrary to the provisions of Section 267(b) of the Criminal Code of Canada. (Alternately Section 267(a) if the vehicle is considered a weapon.)
Criminal Harassment
Accused #1, #2, and #3 did, without lawful authority, knowing or being reckless that Keith Henson was harassed, did engage in threatening conduct directed at Keith Henson, thereby causing Keith Henson reasonably, in all circumstances, to fear for his safety or anyone known to him, contrary to the provisions of Section 264(2)(d) or other applicable sections of Section 264.
Conspiracy to commit Criminal Harassment
Accused #1, #2, and #3 did unlawfully conspire to commit criminal harassment against Keith Henson contrary to the provisions of Sections 465(1)(c) or 465(1)(d) or 465(4) depending on circumstances.
The police made the argument that harassment has to be repeated. This is not so, in some cases one hostile act is enough. In addition, this is part of a long-standing harassment campaign. There is also no doubt that the law applies in this case. From A REVIEW OF SECTION 264 (CRIMINAL HARASSMENT) OF THE CRIMINAL CODE OF CANADA . . . (1996)
"The criminal harassment provisions of the Criminal Code of Canada came into force on August 1, 1993. The main intention of the new section 264 was to help protect women in Canada from physical attacks and harassment. . . . The legislation is also available as a potential tool against . . . harassment practiced by some members of politically motivated groups , or harassment related to business or personal matters not linked to violence against women."
There is no doubt scientology is a "politically motivated group."

Hubbard was wrong: the cult had perhaps 2000 members in Ontario before they were convicted in Ontario for criminal breach of trust.

C-34 (now R.S.C. 1985, c. C-46 , s. 122) following a trial before Southey J. and a jury. The Church of Scientology of Toronto was fined $250,000 and Jacqueline Matz was fined $5,000. The Church of Scientology of Toronto appeals both the convictions and the sentence. Jacqueline Matz appeals the conviction only."

Both sentence and conviction were upheld. Most of their locations were closed and today membership is not more than 200. But the cult is still an awful nuisance with far more influence on government than is safe for a democracy.
There is a small possibility this bizarre business might not have been orchestrated by the cult or aimed at me. In the case that investigation demonstrates this as fact, I will apologize to all concerned, including this court.
Postscript Tuesday morning
Yesterday a Toronto police officer (who has investigated this cult’s harassment for several years) tried to find Mr. Brewer. "Solutions Security & Investigations" turned out to be in a "rent an office" place. Mr. Brewer was not there, and the office people said he would not be in this week.
