Which absolutely connects him to scientology--at the highest level. Might well have been one of the lawyers. Moxon&Kobrin, OSA and/or DM were the only ars readers who jumped to the conclusion that the statement I had put in the Sept. 12, 2000 declaration (in support of a motion on the Hertado deposition) indicated I knew about the indictment and notice to appear.
I didn't have the least idea until the cult entered a Hemet court printout they made Sept. 12 into a bankruptcy hearing Sept. 13, 2004 and nobody outside high levels of scientology jumped to the wrong conclusion I knew about the notice to appear because nobody else knew I had been indicted on Sept. 1, 2000.
The cult and members of the DA's office set up this scam to have me in a far away deposition at the same time and get me cited for failure to appear. It was their guilty knowledge--having set up this vicious scam--that made them read into what I wrote in for the Hertado motion that I knew about the indictment in Hemet.
What I wrote was true, Graham *had* made contact with someone in the DA's office in Riverside to tell them he was my lawyer, if they wanted to arrest me again, call him. But neither of us knew anything about the indictment. The cult lawyers knew about the never mailed arraignment notice--Paquet and Moxon (and maybe more) having set it up in a conspiracy with Tom Gage and others at the DA's office, perhaps as high as the elected DA Grover Trask.
I don't know that this *proves* the trial itself was a fraud, but it sure lends strong support to the notion.
I can see how they misread what I put in the declaration:
"Mr. Berry has been my counsel in this and a number of other matters since then, and is currently my counsel for surrender notice from the District Attorney in Riverside County on pending criminal charges involving purported threats of the use of chemical, biological or nuclear weapons of mass destruction."
*If* a person has a lawyer and the DA or police know he has a lawyer, the proper thing for them to do is to notify the lawyer (surrender notice) to bring in his client to be arrested and booked.
The scientology lawyers misread "surrender notice" to a lawyer for "notice to appear" to a defendant and thought I knew about it. Graham had been talking to the DA's office in Riverside (City) who claimed to know nothing about me. Graham didn't realizing the DA had an office in Hemet--40 miles away--and that's where they filed the charges.
They must have freaked--thinking someone in the Hemet DA's office had ratted them out and given me notice. And when they realized from my confused postings that I *didn't* know that must have caused even more of a flap over the blown opportunity to trick me into a "failure to appear" charge by not mailing the notice.
