Dear Ms Sonksen:
Today I received the notice from your office in the mail which
starts "The record on appeal has been filed and the appeal shall be
heard on: DATE 1/04/02 . . . .
It is dated 10/15/01 and has a postmark on the envelope of
10/16/01. Again it was mailed with insufficient postage. It was
remailed with additional postage at a subsequent though unreadable
date from San Bernadino and arrived here today, 14 days after the
clock started running.
The notice states that he Appellant's Opening Brief is to be
filed within 20 days. Twenty days is November 4, 2001, a Sunday.
Thus I believe it could be filed on the following Monday. This is,
however, a week and a day less time than the due date Cindy Cohn of
the EFF told me about.
Given the impossibility of being advised before this date by
mail, I will try to comply with this filing date for my opening brief.
Sincerely,
H. Keith Henson
PS. If you have email, email does not require 55 cents of postage and
rather than taking two to three weeks gets here in about one minute.
I would be glad to reply that I got each notice you send if, of
course, you have access to email.
