The previous free speech matter I was involved with was the AABBS
case. From: http://www.nyu.edu/classes/nsg/pbuk1sb.html
AABBS was not unique. One 1994 study found 68 commercial "adult" BBSs
located in 32 states, with a repertory of "450,620 pornographic
images, animations, and text files which had been downloaded by
consumers 6,432,297 times." But the Thomases' mom-and-pop operation
was unusually prosperous and high-profile.
Too high-profile, it turned out. The troubles originated, not in the
freewheeling Bay Area where the Thomases were operating, but in the
Bible Belt, when "Lance White" of Memphis joined AABBS (his revealing
choice of a password: SCOURGE). "White" turned out to be postal
inspector David Dirmeyer, who downloaded some of the raunchiest images
and swore out a complaint. Had the Thomases been alert, they would
have thought twice before signing up customers in Memphis, a mid-South
city with a reputation for conservatism and antiporn activism; the
makers of the film Deep Throat were prosecuted there in 1976. Many
companies that sell hard-core magazines and videos refuse to ship to
certain states and zip codes; AABBS would have been wise to take the
same approach.
In early 1994, the Thomases were indicted. After a federal trial in
Memphis, the jury convicted them of distributing obscene materials via
interstate commerce. (They were acquitted of child-porn counts arising
out of three magazines that the postal inspector had mailed them,
evidently because the jury considered the unsolicited mailing to be
entrapment.) Robert Thomas was sentenced to 37 months; Carleen to 30
months.
[End quote]
I was there reporting on the trial. Since I might have been used as a
witness I was outside the court most of the time. From the people
inside the court I got a remarkable related report on this Dirmeyer
dude. The jury had to see every one of the tapes the government was
claiming to be porn. This was in my opinion a clear case of jury
abuse. One of the tapes was a scat flick from Germany (of women
shitting on the floor). According those inside (and as I reported at
the time) the postal inspector sported a huge boner during this part
of the trial.
