This is the sentencing report which was withheld ("we don't have it")
from my lawyer till he was in court. After reading the outrageous
statements in it, you can see why they wanted to sandbag me with it
and not let it get out on the net before sentencing me and hauling me
off to jail.

Part One.
CIRCUMSTANCES OF THE OFFENSE:

On July 19, 2000, at approximately 4:22 p.m., a deputy responded to
Golden Era Productions, located at 19626 Highway 79, San Jacinto,
regarding threats being made over the Internet. Upon arrival, contact
was made with Ken Hoden, General Manager of Golden Era Productions
(Church of Scientology).
Mr. Hoden advised that Keith Henson, the defendant, has been outside
their church, protesting since May 26, 2000. On July 15, 2000, Mr.
Hoden advised he noticed some threats being made against the church on
the Internet news group alt. Religion. scientology. Mr. Holden had his
"Internet expert", Gavina Idda explain to the deputy how the news
group operates.
Gavina advised the news group site is a site where people talk about
their disbelief in the Church of Scientology. Gavina showed the deputy
numerous documents that he printed from the Internet site, where he
believes the defendant is making threats against the church. In the
documents, it shows the defendant discussing how an ICMB (Inter
Continental Ballistic Missile) could be accurate enough to hit the
Church of Scientology. Gavina also showed documents that have pictures
of the church in San Jacinto, with satellite coordinates, so that a
missile could be accurately launched at the church. The documents also
show the defendant discussing how one would have to watch for weather
for more accurate missile shots.
An excerpt from another document printed from the site, shows the
defendant stating that, "Killing the organization off entirely is the
best way to change the future of Scientology". (This quote was taken
from a document written by the defendant in April 1997, on the same
Internet news group).
Mr. Hoden informed that his students, and his employees are afraid of
the defendant because he has also made threats in the past toward
Church of Scientology. He showed the deputy a copy of a deposition
that the defendant was to attend with the church leader, David
Miscavige, in May 1997. That document states an employee of Southwest
Airlines, overhead threatening conversations between the defendant and
another person. As a result, the deposition was deferred for
Miscavige's safety, by a San Jose judge.
Another document shows another person on the Internet site, saying
that GPS (Global Positioning Satellite) will not be needed as long as
the defendant is standing on the hill providing IR (Infared)
illumination for the missiles. Another document shows the defendant
saying Miscavige has to "Watch for cruise missiles as well as eagles".
As a result of the past contacts Mr. Hoden and his church have had
with the defendant, he told the deputy they are all afraid of the
defendant, because of his knowledge of missiles and explosives. Mr.
Hoden said that he, his employees, and students, have had to alter
their day-to-day activities at the church, as a result of their fear.
They are afraid to walk around the church when the defendant is
outside protesting, because they fear he might be armed with some kind
of explosive weapon.
The defendant was outside protesting when the deputy finished speaking
to Mr. Hoden and Gavina. The deputy approached the defendant, detained
him, and placed him in the back seat of his patrol vehicle. The
defendant was transported to the Hemet Station for an interview.
The defendant was Mirandized and questioned. He stated he does not
like the Church of Scientology. He stated he sometimes says things on
the site to make Miscavige "paranoid". He informed the deputy of his
background with explosives. The defendant said he is a pyrotechnics
expert and teaches pyrotechnics to eighth and ninth graders. The
defendant said he has discussed ICBMs on the site, regarding the
Church of Scientology, but only meant any comments as a joke. He
informed he did not have any means of actually getting an ICBM.
However, he stated again that he likes to say things to make Miscavige
"paranoid".
Under Penal Code 11418.5(a), a threat to use weapons of mass
destruction, with! or without the intent or ability to carry out that
threat, is a felony or misdemeanor. Mr. Hoden presented that Penal
Code Section to the deputy and stated he feels it applies to him and
the members of his church, based on the discussion of ICBMs and of the
defendant's knowledge of explosives. Mr. Hoden refused to sign a
Citizen's Arrest form to have the defendant arrested. The deputy
forwarded the matter to the Detectives Unit for further investigation.
On July 22, 2000, a follow-up investigation was conducted. The
reporting party, Ken Hoden, was recontacted. Mr. Hoden printed
numerous e-mails reportedly sent from the defendant. The e-mails
mention how the defendant has been watching the workers of Golden Era
Productions, and how they have been reacting to him when they see him
arrive and loiter around the area. The e-mails also mention how the
workers have changed their procedures during the day, starting from
the time when the buses pick the workers up at their apartments to
when they are dropped off at the end of the day. The e-mails indicate
the defendant has been watching and taking notes of the workers'
procedures throughout the day.
Another attachment is a declaration from Frank Petty describing how he
observed the defendant and a man named (David) Rice standing in front
of Golden Era taking coordinates from a GPS. Another attachment is
from Edwin G. Richardson who says he is a private investigator and has
been investigating the defendant. He gave a summary of what he knows
about the defendant's past. He was hired by the law firm of Moxon and
Kobrin regarding postings the defendant made on the Internet which
have been of a threatening nature. Various Churches of Scientology
have been subject to serious acts of violence, and from his
investigation of the defendant, the churches' concerns for their staff
and adherents were well founded.
Mr. Richardson stated the defendant is an expert in explosives and his
exploits were written up in a book some years ago. His investigation
revealed that when the defendant left Arizona and moved to California,
the bomb squad of the local police department had to be called to his
old residence to remove dangerous chemicals he had stored in a brick
shed in the backyard.
Mr. Richardson indicates the defendant is not a stable person, and he
was previously under psychiatric care. He states the defendant's
hatred for the Church of Scientology is something he does not hide and
is not confined to the Internet. In 1997, the defendant was arrested
and subsequently stipulated to an injunction to stay away from a
Scientology minister in Los Angeles. The defendant's threats were
expanded to also provide protection to various Scientology facilities
and their staff.
Between May 2000, and July 21, 2000, the defendant has traveled on
several occasions to San Jacinto from his residence in Palo Alto,
California. Not only has he picketed Golden Era Productions principal
property located on Highway 79, he has also taken photographs of
individual staff and vehicles. He has recorded license plate numbers
and has followed Golden Era buses to and from the apartments located
in Hemet.
On one occasion, on or about July 5, 2000, the defendant was
"picketing" Golden Era Productions with a David Rice and Barbara Warr.
Mr. Richardson and another retired LAPD officer, Frank Petty, were
keeping close watch on all three as they were walking up and down the
highway, which runs through the middle of Golden Era Productions'
property. Rice had a Global Positioning System (GPS) and a compass.
There were observed taking and writing down various coordinates of
various buildings located on Golden Era Productions' property. Mr.
Richardson was close enough to the three of them to hear what they
were saying. The defendant and Rice discussed the coordinates and the
defendant mentioned launching missiles.
Mr. Richardson became very concerned after hearing the conversations
between the defendant and Rice. He had previously advised Mr. Hoden,
and their security staff on actions to take to protect the more than
700 staff on the property. These actions included rerouting staff
around the property so no one would get hurt if the defendant were to
throw an explosive device on to the property, rerouting buses and
increasing security at the apartments in town.
Mr. Richardson concluded by stating he has been in many dangerous
situations in his professional career, and unequivocally, in this
matter the concern and fear seen amongst the staff and Golden Era is
real and warranted.
The last declaration was provided by Ken Hoden. Fie describes how his
facility and workers have had to change their day procedures out of
fear from the defendant's acts. He personally knew the defendant had a
history of making and setting off bombs. He read a portion of a book
entitled, Great Mumbo Chicken and the Transhuman Condition, which
describes the defendant's history of creating and setting off bombs of
mass destruction. Mr. Hoden has also seen Internet postings written by
the defendant, which clearly show that he has the personal knowledge
of making bombs to the extent to where he advises others on the
Internet on how to make bombs. These postings mainly occurred on a
news group on the Internet called alt.eng.explosives. Mr. Hoden made
reference that the defendant and his associates, David and Frederick
Rice have threatened to launch missiles at the church or carry such
devices to the church. This has resulted in extraordinary measures to
protect members of the church and his personal family at Golden Era's
property.
Mr. Hoden, stated that the defendant himself, in his recent postings
on the Internet talks about all the disruption that he personally is
causing. The defendant describes staff trying to get away from his
presence, and describes church staff being rerouted to other
pedestrian tunnels to get away from his presence. At great expense to
the church, Mr. Hoden has had their attorney hire two professional
investigators to stay near the defendant to prevent him from trying to
get over the fence onto church grounds and prevent the defendant from
attempting to hurt church staff. On a number of occasions the
defendant has followed the church buses to and from the church and
staff apartments in Hemet. When staff wake up in the morning, the
defendant is sitting there waiting for them, and then he follows the
buses. This is creating fear on the part of staff, causing buses to be
rerouted and alternative means of transportation implemented.
In summary, Mr. Hoden stated he has had to totally disrupt the normal
activities of the church to protect staff. Members of the church
should be free to practice their religion without the fear of being
bombed or hurt in some fashion. Mr. Hoden prays that this practice be
stopped before someone gets seriously hurt.
