Dear Judge Wallerstein: I am fairly sure someone well bring you a copy of this letter. For certain it is not ex-parte because the scientologists will have it in minutes and the DA's office will have it within hours of me posting it. First, I am in Canada. This is not a secret. I have filed for refugee status here. The paperwork in front of me reads: "Pursuant to section 45 of the Immigration act, you have been found to be ELIGIBLE to have your claim to be a convention refugee determined by the Convention Refugee Determination Division of the Immigration and Refugee Board." "Accordingly, pursuant to Section 64.02 of the Immigration Act, your claim is hereby referred to the Refugee Division." I don't know all the details of what will unfold, but as I understand it, the prosecution charges, all the filed papers, including Frank Oliver's OSA manuals, and the trial will be reviewed by the Refugee Board. You might be interested to know that the scientologists caused me considerable trouble in Canada, in fact, getting me jailed for ten days based on a document dated May 19, 2001 which is now on the freehenson.da.ru web site. (There is a certain amount of irony in a US free speech advocate being supported by a Russian web site.) The document is clearly based on the letter former Gambino family lawyer Eliot Abelson had included in the sentencing report. After immigration looked into the matter in detail, I was released. By the way, in spite of making a number of calls, as of yesterday Mr. Harr still didn't have a complete copy of the sentencing report. At one point it was suggested to him to obtain it from Mr. Abelson. I understand from Mr. Harr that the DA's office is pushing for sentencing on July 6. That's ok with me, but you should be aware that I will not accept and have not authorized Mr. Harr to accept any terms of probation. There is just too much obvious potential for the scientology corporation to use probation to further persecute me.
