Dear Sirs:
This is a complaint regarding what I perceive to be the improper,
excessive, and dangerous use of force by MTPD Detectives Bonenfant and
Glavin of 22 Division (fugitive squad) using the Halton Police ETF on
Monday, May 28, 2001, to arrest my houseguest Mr. Henson. In fact, I
characterize the arrest and the actions around the arrest as an
unusual example of police terror against a citizen of Canada and his
guest. After a month I still have nightmares of guns shoved in my
face.
First, however, I consider Halton Police blameless. Even the
incredibly bad choice of location, right outside the main doors of the
Oakville Place Mall, was under the control of Detective Bonenfant.
The location put the public at serious risk had one of the EFT members
tripped and accidentally discharged a weapon.
These are serious allegations of professional misconduct and I do not
make them lightly. I have a documented history of strong support of
law enforcement. I would not make these allegations if I did not
think they merited investigation. Therefore, in order to understand
the circumstances preceding this misconduct I must explain briefly
events leading up to what I characterize as "the improper, excessive,
and dangerous use of force" at the direction of MTPD officers.
The reason that my houseguest Mr Henson (subject of the fugitive
warrant executed May 28th) is Canada is well documented. He and I
have been involved for a number of years in exposing the criminal
activities of Scientology. Scientology is multi-national corporation
posing as a "church." It is, in actuality, a front for a wide range
of criminal scams, and has been known to infiltrate or corrupt various
levels of governments, endeavouring to insulate itself from
prosecution. It has had both successes and reverses in the world's
courts. In the US the FBI's threat assessment group considers it
organized crime, even though the IRS granted Scientology 501c3 charity
status. (Now under investigation.) In Canada Scientology has a
criminal record for Breaches of the Public Trust and there was
judicial finding of egregious sustained libellous persecution by
Scientology of former Crown Prosecutor Casey Hill.
I first met Mr. Henson 1976 at a science fiction convention in Kansas
City when I was providing security with a group known as the Dorsai
Irregulars, and Mr. Henson was speaking on the latest research
progress from a study being conducted by NASA on space colonies. In
recent years our paths crossed again as both of us were attracted to
the major battle being fought in cyberspace between free speech
advocates and the "Church" of Scientology.
This battle spills out of cyberspace since pickets and demonstrations
are organized there to protest the abuses of the cult. I have
personally organized or attended more than 50 uniformly peaceful
demonstrations in Toronto and elsewhere. I was also principally
involved in supplying part of the information that led to the
rejection by Revenue Canada of Scientology's application for charity
status in 1997. Thereafter Scientology labelled me a "suppressive
person" who was, by their internal policies, "to be lied to, tricked
or destroyed". Mr. Henson has also been similarly "labelled" and has
picketed Scientology facilities close to 250 times. He is well known
internationally as an Internet based free speech advocate of long
standing. Neither Mr. Henson nor I have ever been involved in
Scientology as members.
I scheduled a protest picket for a Scientology event in Toronto on May
12. Mr. Henson was invited to attend. He traveled from California
and had a return ticket for the next day. Mr. Henson was about to be
sentenced in California to 200 days in jail for the misdemeanour
(ultimately) of picketing Scientology. His trial has drawn
international press attention for its kangaroo court atmosphere in a
Scientology controlled town. (See attachments.)
Unfortunately, Mr. Henson did not know of the obligation to inform
Immigration of his misdemeanour conviction when he entered Canada for
a two day visit. Regrettably, I also did not remark upon this
obligation. After Mr. Henson participated in our protest picket he
elected to stay an extra day and at my suggestion, consulted Mamann
and Associates, Immigration law specialists. On May 14th Mr. Mamann
examined the details of Mr. Henson's case, which were available on the
Internet. To my amazement, Mr. Mamann's expert opinion was that Mr.
Henson would qualify, uniquely, as a political refugee from the United
States.
Shortly thereafter a serious threat to Mr. Henson's safety, should he
be imprisoned in Hemet, was posted on the Internet by a known
Scientology spokesperson. Given the expert opinion of Mr. Mamann, Mr.
Henson elected to stay here rather than return to California for
sentencing, imprisonment and likely torture or death. He paid a
retainer to Mamann and Associates. Mamann and Associates was very
busy during the time from May 17th to May 28th, the day he was
arrested. Mr. Henson had an appointment to file his Refugee Claim on
the afternoon of May 29th.
Scientology representatives in Canada complained to Immigration about
Mr. Henson's presence on or after May 12th. Toronto Scientology
Intelligence Officer Mr. A. Buttnor was ordered by his superiors to
falsely inform Immigration that Mr. Henson posed a terrorist threat to
Canadian citizens. However, Immigration apparently issued an arrest
warrant for Mr. Henson based only on his failure to inform Immigration
Canada, as he entered the country, of his misdemeanour conviction in
California.
Mr. Buttnor also falsely informed the fugitive squad that Mr. Henson
had posted bomb threats on the Internet. Scientology Dept. 20, Office
of Special Affairs (OSA--once known as the Guardian's Office) where
Mr. Buttnor is posted, also supplied to 22 Division officers numerous
documents tailored or doctored to support Scientology's complaints.
These false allegations could have been shown to be untrue with very
little effort, given the Internet alone, not to mention the
international police information resources available to these
officers. In fact, even this effort was unnecessary on the part of
fugitive squad officers since it is apparent that, from their
subsequent statements to the press, they were aware their source was a
criminal organization: Scientology. This "reliable source" has a
history in this country of attempts to deceive the Crown, subvert
local law enforcement and obstruct justice and has a criminal
conviction as a corporation for Breaches of the Public Trust. Part of
the subsequent questionable actions and inactions of these officers
demonstrates they were aware from the outset that these allegations
about Mr. Henson were baseless. Certainly a routine check of CPIC
would have indicated, based on my record, that Mr. Henson would have,
more than likely, been surrendered quietly by me had these Officers
cared to use the phone.
The "reliance" of MTPD Detectives upon the unfounded claim that Mr.
Henson was a "pipe bomb maker" was, in my opinion, using the barest
thread of legal justification for an excessive use of force when
arresting Mr Henson and detaining me. Their actions appear to have
been designed either to bully or terrorize Mr. Henson and me. They
certainly succeeded in terrorizing me.
These officers revealed their subterfuge when, despite having
exigent circumstances, they did not bother to have my vehicle searched
at the time of the arrest. Nor, apparently, did they make any effort
to obtain a search warrant for my home where it was known Mr. Henson
was openly residing from May 12th to May 28th. It is obvious these
officers knew the "pipe bomb" threat information was completely
unreliable, else they would have been obligated to search my family
residence as a potential "bomb factory". However, while conducting
surveillance of my suburban home, these officers inexplicably informed
at least one of my neighbours that I was harbouring an American
fugitive wanted on "explosive related charges." MTPD officers stopped
my neighbour, Mr. Keresteci (905 849 4671), at the local school where
he was delivering his two young daughters and recklessly spread this
alarming misinformation. (Hopefully this was only coincidentally the
same kind of "noisy investigation" routinely initiated by Scientology
against anyone it perceives as an Enemy.) This was an inexcusable act
of domestic terrorism since these officers must have known that no
such charges existed. Either that or the Officers in question
displayed a level of incompetence I find unbelievable for Detective
Grade Officers of the MTPD.
Please read below attached public posting I made shortly after my
brief detention and the arrest of Mr. Henson on May 28th at the hands
of Halton ETF under the direction of Detective Bonenfant of the MTPD.
On May 31st Immigration conducted a first information hearing on Mr.
Henson's case. Officers Glavin and Bonenfant put in an extraordinary
appearance. They falsely asserted a 52 division Sergeant's report
from May 21st, somehow unavailable at that time, would show Mr. Henson
was a danger.
On June 7th an Immigration adjudicator examined the documentation
supplied by Scientology's Dept 20, both to Immigration and MTPD. This
examination was thorough.
On June 8th Mr. Henson was released by Immigration and granted
provisional refugee status in Canada.
I request a rigorous investigation of the apparent misconduct of these
officers and their apparent open collaboration with a criminal
organization (Scientology in Canada).
I have served the Crown myself briefly as a Customs Officer and have
always supported and trusted law enforcement. It is a scandal that I
now experience feelings of fear when I encounter police officers as a
direct result of the inexcusable actions of Detectives Glavin and
Bonenfant. I still have nightmares where police are shoving Glock
handguns or machineguns in my face.
It is also a scandal that other more forthright MTPD Detectives
currently have sufficient evidence to lay numerous criminal charges
against members, agents and corporate Scientology itself, yet can not
do so due to "lack of resources". These charges include criminal
harassments, assaults, and extortion. Further intensive investigation
could likely develop into substantiating the charges relating to
organized crime offences, fraud, tax evasion, practicing medicine
without a licence and once again, breaches of the public trust by
obtaining and publishing private credit information.

officers apparently acting, either coincidentally or deliberately, in
Scientology's criminal interest.

Monday May 28, 2001.
I returned to my home in Oakville at 1:15 PM from my
employment. As I entered my driveway I felt, once again, the prying
eyes of watchers. I glanced about and felt I had spotted Scientology
Intelligence (Office of Special Affairs) or hired PI thugs watching my
home. It would not be the first time. This was not unexpected. Keith
and I had peacefully picketed Scientology in Toronto numerous times in
the last 10 days. They had not yet come to picket my home and harass
my wife and children again. At the pickets the Scientologists had
stopped sending out its goons squad to harass me and *quietly walk
elbow to elbow with Keith Henson* discussing his conviction on
concocted OSA lies in the US. Instead, the Co$ had taken to hand
wringing, hiding and wailing to the police they were being terrorized
by our presence and the words of our signs and handouts. Keith and I
had theorized they would begin to tail us so they would have
forewarning whenever we loaded a car with Picket materials and headed
into Toronto.
But today it was not the OSA.
It was something more terrible.
Something sickening to me: Perversion of the Canadian Justice
System by a Criminally Convicted Corporation: Scientology.
At approximately 2:15 pm Keith Henson and I were shopping at
the Oakville Place Mall. Finished, we went to my four-door Protégé,
which was parked, in the lower parking lot near the main entrance to
the Grocery store and the Mall Food Court. We were seated in the
vehicle, which was the last car in a row of cars, with the passenger
door opening onto the lane way. Immediately after I started the car,
the Oakville Police ETF executed a High Risk Take Down upon myself and
Keith Henson.
An unmarked Van blocked the rear of my car and another
unmarked van pulled up on the passenger side of the vehicle. My first
reaction was that these were Scientology paid Bounty Hunters
attempting to do a kidnapping of Keith, Then I saw the blue Flak
jackets, uniforms and badges for a moment and after that all I saw was
guns. Lots of guns.
Two Officers carrying machine guns had Keith in their sights
and were standing to the right of the car. Two more, with drawn Glock
handguns, had me in their line of fire. We were ordered to freeze and
keep our hands in view. Keith slowly raised his. As did I. Keith was
ordered to exit the vehicle, hands in view and to lie prone on the
ground. Keith complied without comment. He was quickly handcuffed (and
shortly thereafter gently raised to his feet.) Then an officer opened
my door and took control of me with a grip and twist of my left wrist.
I was taken from the car to the rear of the vehicle and bent over the
trunk. My pockets were emptied and fanny pack removed. I was also
handcuffed.
The Halton Police Emergency Task Force had acted
professionally and gained total control of this situation in moments.
They were, given the circumstances, courteous and considerate of the
Grandfather they were arresting and the slightly overweight
middle-aged local citizen they were detaining for the moment.
At the scene were at least six ETF officers in battle gear, at
least one of which was a woman. There were also at least three marked
cruisers, besides the two unmarked vans, and another 4 to 6 uniform
Oakville uniformed cops.
There was also the leader of this High Risk Take Down; A Metro
Toronto Police Force Detective form 22 Division. I believe his name
was Bonenfant. The Detective was in plain clothes and questioned me
briefly to record my particulars. He made certain statements to me,
which I shall not repeat at this time, but have forwarded to Keith's
Legal counsel here in Canada.
The Detective stated he was executing an Immigration Canada
Warrant for Keith Henson's Arrest. And had employed the Halton Police
ETF and Uniformed Officers to execute the warrant. Keith was to be
taken to 22 Division in Toronto and handed over to Immigration there.
I later discovered he was then to be sent to the infamous Immigration
Metro West Holding Centre at 111 Disco Rd in Etobicoke. This is near
the Toronto International Airport.
I immediately called Keith's Immigration Lawyers: Mamann and
Associates. Mr. Polton was on the case immediately and shortly
thereafter spoke with Keith and the Immigration Officer detaining him
at 22 Division.
The apparent basis of this Immigration Warrant is the
allegation Keith Henson failed to disclose information to Immigration
Canada, when he entered Canada on May 12, 2001. That information was
an alleged Felony Fugitive Warrant in the US, and/or a misdemeanour
conviction for a so-called "hate crime" (Calif 422.6) in California.
The fact is Keith was not wanted at that time. And tho' he may
be wanted now for a misdemeanour flight this itself is not a
violation, according to the Lawyers.
Also, since Keith is in process of claiming Refugee Status
from Scientology oppression of Free Speech and endangerment of his
life, all backed by US Government assent, then Keith's failure "to act
with candour" and volunteer to immigration that he was convicted of a
misdemeanour in California, is moot.
This arrest was a perversion of Canadian Justice.
According to Immigration and Metro Police they were acting on
a "tip from a reliable source" that Keith Henson was a danger to the
community. How ironic. Scientology lies are considered reliable. L.
Ron Hubbard was right about some things: "You can control people by
lies..." "the law can be very easily used to harass". "Find or
*manufacture* enough threat ... to ruin him utterly." " To control
local government overtly overwhelm them or covertly infiltrate and
subvert them." " Tell acceptable truths."
There was *no* justification in the law to execute this kind
of high tension *armed and dangerous* arrest. Immigration and the
Metro and Oakville Police Department were acting strictly on false and
misleading information supplied to them from Criminal Scientology
sources.
Even the police at the scene finally realized that the "armed
and dangerous" grandfather Keith Henson was not threat and never was
because my car was never searched and neither has my home been
searched for any stray ICBMs.
The lies of Criminal Scientology put Officers, a Citizen and a
Tourist starting a Refugee claim, at risk.
One or more officials at the Immigration or Metro and Oakville
Police has acted precipitously, without all the facts or doing all the
homework and an incredible disability which prevent the simple use of
a phone. To call me.
The police knew Keith Henson was staying at my home. Had the
Officer In Charge of this sickeningly dangerous circus bothered to
check the CPIC system they would have found my record to be spotless.
They would have found out I qualify for Airport Security clearance.
They would have discovered I was instrumental in the arrest, trial and
conviction of my own son on minor drug trafficking offences a few
years ago. (My son has straightened out nicely.) They would have found
out that they could have simply *called* me and asked for Keith to
surrender himself at the Oakville Police station. And it would have
been done.
The ETF action was not justified, not rational, and while
executed flawlessly was an unnecessary risk which put the lives or the
Officers, Keith, myself and the public at large in a crowded shopping
mall parking lot all in *real* jeopardy.
And this jeopardy is the direct result of the Lies of
Criminals in the Criminal Cult of Scientology.
I think it is time for Federal, Ontario and especially Toronto
Police authorities to get off the pot and act on the *volumes* of
evidence supplied and at their disposal. Instead of acting on the
unreliable tips of Criminally Convicted Scientology, the Police should
lay charges on the Toronto Org of Scientology and specific members,
for the known and evidentiary proven acts of Extortion, Violent
Assault, multiple acts of Criminal Harassment over the last 5 years,
Criminal Mischief, Organized Crime Gang Activity and Trademark
Infringements the Scientologists have committed.
Not "tips" but real hard evidence: victim interviews, videoed
victim statements, audio recordings of extortion threats, video
recordings of intimidation of individuals by groups of Scientology
thugs, death threats, eyewitness accounts and victim complaints of
assault, years of evidence of stalking and harassments by criminal
Scientology OSA operatives, organized libel campaigns, threats to
disrupt individuals places of employment, including public schools and
investigations of teachers and staff, deliberate terrorizing of
elderly parents and siblings of those critical to Scientology in
Canada, video recordings of Scientology hate crimes against
gay/bisexual critics, false statements by Scientology to Police and
other *real* evidence.
Maybe I should just call in an anonymous tip and claim
Scientology has ICBMs. Why not? It worked for the Criminally Convicted
Cult of Greed and Power.
What is really ironic is that cash strapped Metro Toronto is
partly funding these documented criminal activities by the Criminal
Cult. Toronto has given and apparently continues to grant Scientology
a 50% property tax break on their Yonge and St Mary property. A
property that is mainly used to retail and run quid pro quo workshops
called "courses" and "processing" etc. The US Supreme court, in 1993,
and basing its decision on English common law, ruled that Scientology
"courses and processes" were a profit making enterprise and should be
taxed. (The US IRS subsequently infamously ignored this as has weak
willed Congress/Senate). Charities Division of the former Revenue
Canada did not grant Scientology Religious Charity Status in part
because Scientology eschews charity as "rewarding the downstat." As
did the Tax authorities in Great Britain.
Perhaps Ottawa, Ontario and especially authorities in Toronto
are less interested in justice and fair play in the courts and in the
division of property tax liabilities than tackling the infamously
litigious well-heeled and very criminal cult of Scientology. After all
why pull the tail of the skunk? Scientology is too small a fraud and
too loud an opponent to bother with, eh?
Maybe if the politcos had ETF guns shoved in their faces
because of Scientology lies they would get the moral backbone to do
their jobs, difficult as that might be.
This mess is going public with the high profile Immigration
Law Firm of Mamann and Associates acting for Keith Henson. And a lot
of red faces are likely on the Federal and Toronto political scene
when it is shown they were duped once more by Canada's only Criminally
Convicted "Church": Scientology.
