This delay was supposed to be for a "mandatory" settlement conference. I have a threatening letter from Susan Luce (in reply to an inquiry about a meeting from Helena Kobrin) about how the trustee is going to hurt Arel (financially) if I don't agree.
I think Ms Luce's butt is hanging out in the breeze because she lied to Judge Weissbrodt's court staff in taking the September 10, 2004 hearing off calendar. I would not agree to wasting a judge's time on a "mandatory settlement conference" but I did tell my lawyer he could set up an informal conference--which came off today.
Helena was there, Seid, Arel's lawyer, my lawyer, Susan Luce for the Chapter 7 trustee and John S. Wesolowski for the US Trustee's office.
I took extremely detailed notes--good enough I could generate a transcript of the meeting and might do so. (There were a lot of times when nobody could think of anything to say or they had the mute button pressed and I type fast. :-) )
Arel was so freaked out by the whole pack of thieves trying to rob her and extort me she gave up and went for a very long walk about half way through.
John Wesolowski stated that he has *never* looked at the internet about this case. Goes to show that the net does not penetrate some parts of the population at all. I mentioned that he really should get a feel for the net since there is some about *him* out there, some of it grossly out of date.
He also made a statement that the justice department's interest in this case being dismissed is automatic because they don't want fugitives "taking advantage" of the courts. If Judge Weissbrodt rules in my favor on his motion to dismiss the case he would appeal-- though he stopped short of saying he would appeal beyond the district court level.
Of course, the effect dismissal would have in my case is that RTC would walk off with the money and the other creditors (including in the original proposal the IRS) would be left without a cent.
When I mentioned that his part on the bad guy's side in this drama would be written up and archived for his kids and grand kids to read he seemed seriously disturbed by the possibility calling it a threat.
It is no more of a threat than any news story. Things you do get
reported. The difference being that the net has a *long* memory and
it isn't hard to find archived material such as this.
