Those are right out of the documents, most of which are annoying typed in ALLCAPS. ====== Analysis of subpoenas and subpoena correspondence ========== - There are several attachments to a subpoena of bank records (5093-5099). From those, it's possible to make a few inferences. Apparently Lisa and Kurt Paine were co-signatories on several shared bank accounts, in both Clearwater and Jacksonville. I was curious why they would be co-signers, and also why they would have a checking account in Jacksonville. Does anyone have any theories? - From the bank records subpoena correspondence, I learned that apparently Lisa transferred $33,000.00 to a checking account of Kurt Paine in the calendar year of 95, and also, his savings account appears to have been opened with $9000.00 in funds which came from one of Lisa's accounts. Do any of the TIFs contain the actual bank records? I'd be very interested in seeing those. - Subpoena request in TIF 5092 mentions that the CPD was investigating the possibility that Lisa had embezzled money from AMC Publishing thereby giving Bennetta Slaughter a motive to kill her. From document 5092 [written by CWPD Detectives James Little and Wayne Andrews]: "THE INVESTIGATION IS FOCUSING ON THE POSSIBILITY THAT AT LEAST $25.000.00 OF THE $33,000.00 WAS EMBEZZLED BY LISA McPHERSON FROM HER EMPLOYER. IF THIS OCCURED IT COULD BE A MOTIVE FOR ACTION TAKEN FROM HER EMPLOYER THAT RESULTED IN HER DEATH. HER EMPLOYER WAS IN A POSITION TO TAKE SUCH MEASURES." Apparently nothing came from this portion of the investigation as far as the police are concerned. But the last sentence is interesting, the detectives apparently concluding that it was within Bennetta Slaughter's power to have Lisa locked up in the IR. - McCabe's subpoena for a list of the names, addresses and phone numbers of employees of AMC Publishing (5083) specifically orders Bennetta Slaughter NOT to mention the existence of the subpoena to anyone else. Why do you suppose McCabe would have felt it necessary to say that? What do you think are the chances that Ms. Slaughter obeyed that particular instruction? Zero? Yeah, Zero, definitely. ====== Analysis of Scientology's responses to subpoenas ========== - It appears that the CoS did not properly comply with McCabe's subpoena which requested Fort Harrison room assignments for the cabana area during the period Lisa was held there. Document 5019 contains Scientology attorney Lee Fugate's response to the request for the room assignment sheets, and in it, Fugate implies that all documents not turned over are privileged. Writes Fugate: "Dear Mr. McGarry: Please find enclosed copies of some additional non-privileged documents [room assignment sheets] in response to your subpoenas." I'm not a lawyer, but the only way I can interpret Scientology's response is that they are tacitly claiming the room assignment sheets for the period being subpoenaed are privileged attorney/client communications. How can that be? Am I all wet in how I'm interpreting these? If this is a sleazy way of disobeying a subpoena, that seems to me to be quite a blatant contempt for legal processes, claiming a normal business record is privileged work product. Can any of our lawyer readers please educate me on this point? BTW, the CoS lawyers did graciously turn over room assignment sheets for the period of October 10 - Nov 17 (Lisa's babywatch in the Fort Harrison began on the 18th). Most of the Room Assignment Sheets had large sections of names and room numbers blacked out, either by the CoS or by McCabe's office. - Fugate, in the same document (5019), also claimed that all documents regarding internal communications with Laura Arrunada, Paul Greenwood and Janis Johnson were privileged, and so nothing was apparently provided by Scientology to satisfy McCabe's respective three subpoenas for such documents. - AMC Publishing's lawyer claims (in 5085) that assembling a list of AMC employee names and phone numbers is not required by law, but turns one over anyway, claiming to be acting in the spirit of cooperation. -In that same letter (5085), the lawyer says of Lisa McPherson's address: "the address for Lisa McPherson was the one her mother wanted to have her W-2 form sent to and as a result that is the address we supplied you." Apparently Lisa's mother wanted Lisa's 1995 W-2 mailed to her in Texas, following Lisa's death. Did she ever get this document in the mail? Does Dell Liebricht have it now? If not, perhaps new copies of Lisa's W-2s could be ordered by her estate for all years in which Lisa was employed by AMC. Or is this all covered in the discovery process for the civil suit? - Perhaps the most interesting documents in the 5000-5099 range are the responses to subpoenas that the CoS provided to McCabe in the form of two "debrief" documents. These documents are allegedly the notes taken during Scientology's own investigation, immediately following Lisa's death. What I think they really are, are the synthesis of Scientology's earliest attempts to generate a shore story. I'll be posting my analysis of these documents separately. The first debrief document is two pages (5068, 5069) of the Scientology investigator's notes taken during his/her phone conversation with Dr. Minkoff. The document contains lots of self-serving mentions of sudden viral infections, meningitis, etc. The second, 5 page debrief document (5070-5074) has brief descriptions outlining the participation of several people who physically participated in the babywatch, taking a turn as guard/nurse. There is also a longer section in this document outlining some statements by Janis Johnson. - Minkoff's prescription of Choral Hydrate for Lisa can be seen in document 5078. He prescribed 30 capsules of 500mg tablets. How many pills would one normally take each day? How many days worth of pills does this prescription contain? Michael Reuss
