The Judge has gone on record:
1. Scourged Rosen, Kult Lawyer
2. Criticized Dresher, Kult Lawyer
3. Berated Fugate, Kult Lawyer
4. Acknowledged Kults excessive discovery, and apologized to Dandar's
side (Minton, Brooks depos)
5. Given notice about Kult's inter-court manipulations of process,
especially regarding the Circuit Court rulings
6. Criticized Moxon for crying about Kult critics
7. Criticized Kult's side for Minton's vacuous testimony
8. Criticized Kult's side for Brook's vacuous testimony
9. Come close to intimating that Minton is testifying under Kult-imposed
duress
10. Used the term "witness tampering" at Moxon with regard to Franks and
his confidentiality agreement with the Kult
11. Essentially put Kult on notice that Minton is lying about his Kult
meetings and his rationale about "setting the record straight"
In the omnibus motion proceedings, the Kult seems to be short one
bullet, or the gun itself, for their smoking gun about the last 250,000
March check and the Fat Man. Kult's entire theory of subornation of
Minton by Dandar is hanging by a thread of vacuous/unbelievable
testimony by Brooks and Minton, intimations by the Court of Minton
testifying under Kult's duress, thrashing performances by Fugate/Moxon,
and a sterling performance by Merrit on both the videotape and Fat Man
issues.
The record shows that if Minton was controlling the case, he failed
miserably. Even withdrawing his financial support failed to control the
prosecution of the case. Dandar's alleged subornation is "Dandar
said/Brooks-Minton said" with the latter fleeing in disrepute under a
cloud of unbelievable testimony, noticed by the Court no less!.
Minton/Brooks, with Brooks primarily, appear in testimony to be meddlers
in the case at best, and behind-Dandar's-back manipulators at worst.
Brooks activities look like tortious interference in Dandar's case.
And, where is the Dandar-Estate/Minton secret agreement? Simply
evaporated from lack of believable proof.
The last 250,000 check in early March is looking more and more like a
Kult-inspired sting operation against Dandar, executed by Minton at the
Kult's direction, to prove that Minton was in control of the case by
demonstrating the quid pro quo that internet critics were, in fact,
stiffled as Minton ordered. Well, that failed miserably, didn't it?
Of course, IANAL. Nevertheless, the omnibus hearing appears to be
another Kult footbullet in progress, with a direct judgment to dismiss a
real possibility. The case will go on, IMO.
