COMMITTEE OF EVIDENCE FINDINGS AND RECOMMENDATIONS
ED MOONEY MISSION HOLDER HIGHLAND PARK MISSION
The Committee has met and reviewed reports and interviewed the Interested Party (I/P). Following are the charges as SMI Int EO # 141, and the Committees Findings and Recommendations:
HIGH CRIMES:
1) CONTINUED ADHERENCE TO A PERSON OR GROUP ACCURATELY PRONOUNCED A SUPPRESSIVE PERSON OR GROUP BY HCO.
I/P pleads NOT GUILTY. The Committee concurs due to no evidence on this point.
2) ORGANIZING SPLINTER GROUPS TO CONFUSE PEOPLE ABOUT THE TRUE BELIEFS AND PRACTICES OF SCIENTOLOGY OR TO DECEIVE THEM INTO CONSIDERING THAT THEY WILL BE ABLE TO STUDY PART OR ALL OF SCIENTOLOGY OR RECEIVE STANDARD PASTORAL COUNSELLING FROM THE SLINTER GROUP.
I/P pleads NOT GUILTY. The Committee concurs due to no evidence.
3) ORGANIZING SPLINTER GROUPS WHICH TAKE AND PERVERT SCIENTOLOGY MATERIALS OR PRACTICES, IN WHOLE OR IN PART, STILL CALLING IT SCIENTOLOGY OR CALLING IT SOMETHING ELSE.
I/P pleads NOT GUILTY. The Committee concurs due to no evidence.
4) SEEKING TO SPLINTER OFF AN AREA OF SCIENTOLOGY AND DENY IT PROPERLY CONSTITUTED AUTHORITY FOR PERSONAL PROFIT, PERSONAL POWER OR TO "SAVE" SCIENTOLOGY.
I/P pleads NOT GUILTY. The Committee concurs due to no evidence.
5) ENGAGING IN MALICIOUS RUMOR-MONGERING TO DESTROY THE AUTHORITY OR REPUTE OF ONE'S FELLOWS OR EXECUTIVES OF SCIENTOLOGY CHURCHES OR MISSIONS OR ORGANIZATIONS.
I/P pleads NOT GUILTY. The Committee concurs due to no evidence.
ADDITIONAL HIGH CRIMES:
7) Ed Mooney was found to be guilty of the highest crime in tech and Qual. Ed pleads GUILTY. Per HCO PL 8 March 1966 URGENT - HIGH CRIME:
"The Ethics Officer must look for this policy violation which is the highest crime in Tech and Qual:
"TOLERATING THE ABSENCE OR, OR NOT INSISTING UPON STAR-RATED CHECK OUTS ON ALL PROCESSES AND THEIR IMMEDIATE TECHNOLOGY AND ON RELEVANT POLICY LETTERS ON HGC INTERNES OR STAFF AUDITORS IN THE TECH DIV OR STAFF AUDITORS OR INTERNES IN THE QUAL DIV FOR THE LEVELS AND ACTIONS THEY WILL USE BEFORE PERMITTING THEM TO AUDIT ORG PCS AND ON SUPERVISERS IN TECH AND QUAL WHO INSTRUCT OR EXAMINE OR FAILING TO INSIST UPON THIS POLICY OR PREVENTING THIS POLICY FROM GOING INTO EFFECT OR MINIMIZING THE CHECK OUTS OR LISTS."
The Committee found that Ed Mooney's High Crime Checkouts are years out of date, and he has been auditing in spite of this. Ed noted that he had a confusion on how to get checkouts done on an auditor whose case level was that of OT III or above. He testified to the Committee that he did not have easy access to a twin of comparable case level that could do his checkouts.
Ed failed to get his own confusions cleared up on this and tolerated the absence of his High Crime Checkouts being up to date for years, which is not excusable for a Class VI Auditor (Ed completed the St Hill Special Briefing Course in 1974).
Ed has also been C/Sing without having done the technical training to properly certify and authorize him to do so.
8) Ed was also found guilty of failing to Keep Scientology Working. Ed pleaded Guilty. As per HCO PL Keeping Scientology Working Series # 1:
"Therefore actions which neglect or violate this Policy Letter are HIGH CRIMES resulting in Comm Evs on ADMINISTRATORS and EXECUTIVES."
The Committee finds Ed Guilty of this High Crime due to the fact that he has been C/Sing without having done the proper technical training to properly certify and authorize him to do so.
CRIMES:
1) PLACING SCIENTOLOGY OR SCIENTOLOGISTS AT RISK.
I/P pleads NOT GUILTY. Committee finds him GUILTY. This action of him not having his High Crimes checkouts in present time is putting Scientology and Scientologists at risk.
2) OMISSIONS OR NON-COMPLIANCE REQURING HEABY (sic!) INTERVENTION BY SENIORS CONSUMING TIME AND MONEY, WITH DEV-T.
I/P pleads NOT GUILTY. Committee concurs, insufficient evidence. However, Ed has ommitted the full application and use of LRH Administrative Policy and of WDC orders based on these regarding the Book One use, Mission Management Letter # 1 and the full Div 6 program "Booming your Mission thru Div 6". He has not fully implemented these, and with very few compliance reports having been submitted to his senior at SMI.
3) BEING OR BECOMING A POTENTIAL TROUBLE SOURCE.
I/P pleads NOT GUILTY. Committee concurs. No evidence.
4) WITHOLDING FROM LOCAL SCIENTOLOGY EXECUTIVES THAT HE OR SHE IS A POTENTIAL TROUBLE SOURCE.
I/P pleads NOT GUILTY. Committee concurs. No evidence.
5) FAILING TO REPORT A POTENTIAL TROUBLE SOURCE TO LOCAL HCO.
I/P pleads NOT GUILTY. Committee concurs. No evidence.
6) BEING A KNOWING ACCESSORY TO A SUPPRESSIVE ACT.
I/P pleads NOT GUILTY. Committee concurs. Insufficient evidence.
7) FOLLOWING ILLEGAL ORDERS OR ILLEGAL LOCAL POLICIES OR ALTER-IS, KNOWING THEM TO BE DIFFERENT OR CONTRADICTORY TO THOSE ISSUED BY THE INTERNATIONAL BOARD.
I/P pleads GUILTY. Committee concurs. Ed did briefly participate in squirrel tech from now declared Suppressive Person Kinglsey Wimbush. Ed did quickly come to his senses as regards this and has received cramming on Keeping Scientology Working. See Crime # 8 below also.
8) PERMITTING A SECTION, UNIT, DEPARTMENT OR ZONE OR DIVISION TO COLLAPSE.
I/P pleads GUILTY. Committee concurs. Ed in late summer of 1982 made a decision to disestablish part of his Div 6 and move it across the street from his Mission.
He then had an individual in the field who had purchased a SMI Starter Package take responsibility for this unit. Agreements were made, based on verbal direction received from a staff member at SMI INT, that this new Div 6 unit should turn into a Mission as there was no reason he couldn't allow this to be done within his Parish. Ed Mooney agreed to do this instead of asking or referring to the Policy on this matter, and the Div 6 unit became a Mission.
In doing this Ed permitted his Division 6 of his Mission to collapse, resulting in very low and unproductive Division 6 activity in his own Mission.
This action, as well as some off Policy decisions that Ed made in regards to the useage of his Missions Reserves, resulted in low inflow and not having the resources to build the Mission back up quickly.
9) SPREADING DESTRUCTIVE RUMORS ABOUT SENIOR SCIENTOLOGISTS.
I/P pleads NOT GUILTY. Committee concurs. No evidence.
10) OVERWORKING AN EXECUTIVE BY IGNORING ONE'S DUTIES.
I/P pleads GUILTY. Committee concurs. Ed, through above mentioned decisions that resulted in collapse of his Division 6 (see crime # 8), and through not fully implementing the Division 6 programs sent to him by SMI for implementation in his area, and by not fully establishing a good two way communication line with his SMI Consultant (per his own testimony) has ignored his duties as a Mission Holder and a staff member in fully getting his mission on the rails and making new Scientologists, in volume as per LRH ED 340R INT LRH MISSION BIRTHDAY GAME. Much Executive time has been consumed in reverting the scene in his mission.
11) Neglect or omission in safeguarding the copyrights, registered marks, trademarks, registered names of Scientology.
I/P pleads NOT GUILTY. Committee concurs. No evidence.
12) Neglect of responsibilities resulting in a catastrophe even when another manages to avert the final consequences.
I/P pleads NOT GUILTY. Committee concurs. Insufficient evidence. Although Ed has neglected responsibility (see crimes # 2, 8 and 10 above), this did not result in a catastrophe to speak of.
ADDITIONAL FINDINGS:Ed, while in Los Angeles doing MEST work around the Cedars Estate Org, has had excellent ethics change, and cognitions about himself and his responsibility as a staff member in the Mission.
He recovered his viewpoint of himself as a staff member, in a remote area, and with this viewpoint he immediately showed his responsibility level by getting onto his Mission and getting the Mission to start applying the correct ethics condition.
Ed, since March 1982, has not fully established a communication line from himself to SCIENTOLOGY MISSIONS INTERNATIONAL management terminals. This per his testimony, created a situation where he didn't know whether or not he was getting the correct things done, or the correct data. He did not establish a line to his Senior at SMI to ensure that he got the on source on policy management direction available to him from the SMI Consultant (his senior).
Ed has seen this and has taken effective action to fully establish his lines and get his Mission productive.
RECOMMENDATIONS:
I). Per HCO PL of MARCH 1966 Reissued 30 AUG 1980 - URGENT HIGH CRIME - Ed should be DECLARED. However, in weighing the good contributions Ed has made and his Ethics change while in L. A., upon notice of these Findings and Recommendations Ed has 24 hours to get himself in service lines and started on his HIGH CRIME checkouts [... ] else he will be declared a Suppressive Person per the above PL. Ed is to notify the Dir I and R SMI INT that he has enrolled and is starting his checkouts.
2) Ed is assigned a condition of Confusion.
3) He is to report to HAS SMI INT to get this condition completed and is to do any further handling there as regards to establishing a comm line with his seniors before returning to his Mission.
4) If not already done at this point, Ed is to fully handle all his queries and confusion on procedures lines and terminals involving his relationship with management.
5) Ed is to do a Qual corrective program at SMI INT as written up by the Qual Sec SMI INT.
6) A full HCO Sec Check to be done on Ed on Tech and Admin as a Mission Holder.
