Committee of Evidence Findings and Recommendations
Pat McCabe Mission Holder Fresno
The Committee met, took testimony from the Interested Party (I/P), reviewed stats and the data submitted.
The previous Mission Holder of Fresno, David Stokes, left around January 1982, turning the mission over to Pat for an agreed upon exchange of $ 20,000. Pat and the mission inherited two threatened law suits over broken leases; due to these financial pressures the mission agreed to join in with Kingsey (sic!) Wimbush's "Steven Creek Network" of missions. Wimbush paid off Stokes and the former landlords. Pat and the mission them became involved with Wimbush's squirreling. Wimbush is now declared Suppressive. Note: I/P = Interested Party.
HIGH CRIMES:
1. Continued adherence to a person or group accurately pronounced a Suppressive Person or Group by HCO.
I/P pleads Not Guilty. The Committee concurs.
2. Organizing splinter groups to confuse people about the true beliefs and practices of Scientology or to deceive them into considering that they will be able to study part of all of Scientology or receive standard Pastoral Counselling from the splinter group.
The I/P pleads NOT Guilty. Committee finds him Guilty.
Pat participated in the use of and enforcing of the Kingsley Wimbush "PTS handling" tech in his mission and in his field, broadly.
This action and putting this in denied standard Scientology to people for a short period of time, while he had this in. This squirrel tech was put in under the guise of being Scientology, when it was not.
3. Organizing splinter groups which take and pervert Scientology materials or practices, in whole or in part, still calling it Scientology or calling it something else.
I/P pleads Not Guilty. The Committee finds him Guilty. See High Crime # 2, above.
4. Seeking to splinter off an area of Scientology and deny it properly constituted authority for personal profit, personal power or to "save" Scientology.
I/P pleads Not Guilty. Committee concurs. No evidence.
5. Engaging in malicious rumour-mongering to destroy the authority or repute of one's fellows or executives of Scientology Churches or Missions or Organizations.I/P pleads Guilty. Committee concurs.
During the summer of 1982 Pat engaged in unsubstantiated accusations against two Fresno mission staff, Jacqui and Michael Latten, claiming they were "suppressive" but without ever applying standard Scientology justice to substantiate this. These accusations were made to the entire Fresno staff, per reports received by the committee.
The Committee has no evidence that Pat wrote Knowledge Reports on this or applied the standard policy to the handling of these two individuals.
Additional High Crimes:
1. Pronouncing Scientologists guilty of the practice of the religion of Scientology.
I/P pleads Not Guilty. Committee finds him Guilty.
See High Crime # 5. Per evidence to hand, these accusations mada against these two staff members were false. Pat took no action to substantiate his claims that they were guilty of being suppressive.

I/P pleads Guilty. Committee concurs.
Pat involved the mission in squirrel PTS tech though he later took action to clean this up.
CRIMES:
1. Placing Scientology or Scientologists at risk.
I/P pleads Not Guilty. Committee finds him Guilty.
See above evidence on squirrel tech. Pat also involved the Mission in "Casino Night" which was squirrel Stokes tradition (former Msn Holder). Parishioners at one time bought bookstore credits and gambled for bookstore items. This violates California laws on gambling and placed those participating at risk. (note: this has since ceased.)
2. Omissions or non-compliance requiring heavy intervention by seniors consuming time and money, with dev-t.
I/P pleads Not Guilty. Committee finds him Guilty.
Pat admitted to being non-productive and lazy on occasion. He did not effectively implement management programs from SMI and WDC based on Founder HCO PLs and HCOBs that if used would have improved his scene in the mission. The stats of his mission have been poor (all stats on file with SMI INT). Yet Pat did comply with squirrel admin orders from now declared Suppressive Kingsley Wimbush. His omissions and non-compliance have required senior intervention to get Pat wearing his hat getting his mission productive, which has consumed much extra time with developed traffic.
3. Being or becoming a potential trouble source.
I/P pleads Not Guilty. Committee concurs. Insufficient evidence.
4. Withholding from local Scientology exectuvies (sic!) that he or she is a potential trouble source.
I/P pleads Not Guilty. Committee concurs. Insufficient evidence.
5. Failing to report a potential trouble source to local HCO.
I/P pleads Not Guilty. Committee concurs. Insufficient evidence.
6. Being a knowing accessory to a suppressive act.
I/P pleads Not Guilty. Committee concurs. No Evidence. Pat himself was involved in High Crimes but these are already covered under the High Crimes above.
7. Following illegal orders or illegal local policies or alter-is, knowing them to be different or contradictory to those issued by the International Board.
I/P pleads Not Guilty. Committee finds him Guilty.
Pat is a Class IV auditor and as such should have known the off-policy actions promoted by Wimbush were squirrel.
8. Permitting a section, unit, department, or zone or division to collapse.
I/P pleads Not Guilty. Committee finds him Guilty.
The Fresno mission stats have been very poor (stats available at SMI INT). Pat did not take responsibility to fully revert the scene that occurred in his mission, through his using the Policy and Source that he does know to get the mission flourishing. Pat has done as Executive Director hat yet has not used this material to its full extent to really get the mission producing, as evidenced by his statistics. Through this action by himself he has permitted the mission to collapse.
9. Spreading destructive rumours about Senior Scientologists.
I/P pleads Not Guilty. Committee finds him Not Guilty.
(Pat is guilty of engaging in malicious rumour mongering as in High Crime # 5 above, however the two staff this was concerning were not Senior Scientologists.)
10. Overworking an executive by ignoring one's duties.
I/P pleads Not Guilty. Committee finds him Guilty.
Pat has not been fully on post of late and Justice action had to be taken by executive at SMI to get him to begin wearing his hat.
11. Neglect or omission in safeguarding the copyrights, registered marks, trademarks, registered names of Scientology.
I/P pleads Not Guilty. Committee finds him Guilty. See above data in High Crimes # 2 and 3, and Crime # 1. These actions did show neglect in safeguarding the copyrights, registered marks, trademarks, and registered names of Scientology.
12. Neglect of responsibilities resulting in a catastrophe even when another manages to avert the final consequences.
I/P pleads Not Guilty. Committee finds him Not Guilty. While the state of the Fresno mission has been quite poor, this did not reach the point of catastrophe as it was caught in time.
Additional Findings:
Pat made good gain while on MEST work demonstrating change. He completed a Liability Formula while in Los Angeles.
Recommendations:
1. Although guilty of High Crimes the Committee recommends that Pat be spared declaration as a Suppressive Person as he has made good ethics change.
2. He is to route and complete the SMI ethics program, which is to include any undone or improperly done lower conditions.
3. His ED Mini-Hat cert is cancelled as he has not applied this data and he admitted to not studying for application.
4. He is assigned a condition of Liability for false attest to the above course.
5. He is to receive full HCO sec checks in the areas found by this Comm Ev.
6. Pat is to receive a Qual Correction program from SMI INT.
7. When appropriate he is to do a full Non-E with his Mission Consultant.
8. Pat is put on a probation period of six months with regards to his post production to be reviewed in close liaison with the SMI Justice Chief.
