Federal law protects persons in a company with 15 or more people. My state seems to have no staute. This has been happening for 6 months. I told he bluntly to stop. I have no legal recourse. Do I quit? Can I demand severance pay? And for how long? The advances (physical) are made by my employeer in a private office. There is noone over his head to go to. I could tell his wife. But I still couldn't work there anymore. I have until Monday to decide. It is now or never and I need all the opinions I can get! HELP!!! Ladyluck58@hotmail.com Tammy :(

You can DEMAND ANYTHING you like. That doesn't mean they will address this with you.
I wish you had a little more time to seek a local attorney's advice. If you have researched the law and found that you are not protected due to the number of employees, then maybe a local attorney could figure an angle besides employment law.
Maybe personal injury...maybe he violated your civil rights. Maybe you could take him to small claims court. There are many attorneys that can present a creative look at a law that is on the books. That's not to say you'd win, but, it would be worth a shot!
It's not fair that you have been violated & only because it's a small company they get to get away with it...

I spoke with the local office that handle complaints. I can in my state, report him for investigation that leads to no real consequence. I can sue him in civil court. But she said an we all know it to be true... it is my word against his. If it is legal, is it etheical to tape record a phone conversation? My final option is to ruin him. I have more than enough information to take this man down. The angry part of me wants to but the rest of me is hesitant. I am not a vicious person. But I am hurt.
