Yes is the quick answer to your question...
YES... the employer can be liable for neglecting to resolve the issue.
YES... it is possible for a teacher to be considered a victim of SH by a student.
You'd want to look at Title IX violations.
I cannot think of any cases about student perp v.teacher victim, but there are plenty of recent cases dealing with Title IX that that find the school at fault for not protecting and/or resolving the sexual harassment of students at school.
You need to start at the ( Equal Employment Opportunity Commission. (EEOC) They have strict deadlines so you should get there as quickly as possible in order to meet the dealines. If they pass, you have no recourse. 180 days from the last incident and in some states you have 300 days... I'd go by the 180 to be on the safeside.
