Hello, I have a slightly involved Question. The company I worked for went on a manditory bus trip to another city. there were people from another group with us. On the way home we usually have a beer. On this bus trip our Territorial Manager (which is a man) ended up getting drunk with the other group and he became very lewd and ubnoxious. There was talk of male amd female genitals. He kept looking into the bathroom when a woman would go in and comment on what color underware she was wearing. There was 22 people on the bus. Eight people called Personal. There was a meeting but we never found out what happened. There is hearsay that this was his 3rd offense. I was wondering if there was any legal actions I can take againt him now. Thank you.

Making a legal move would be against the company, not him personally. In my opinion, you do not necessarily have an action against him at this moment.
If you are continually subjected to this behavior and have proof that it continued to happen & the company did nothing or nothing *effective* to resolve the situation, I would get to an attorney and have them advise you on the precise law that the company has violated.
This could be viewed differently because you were only exposed to say the fact that he opened the bathroom door on someone else.
It can get tricky. Write everything down about this incident... dates, times, who was present. Keep it in a safe place for now.
If there is another incident, the company may be showing a trend in allowing the violations to continue. Then you probably will have a case.
Even if your best friend "tells" you she "heard" rumors about this happening previously. If you cannot prove it AND the eye witnesses will not testify, it doesn't really matter if he has done this 100 times. Your case will go right out the window. Keep a journal and encourage (on break time or off-work property) for your co-workers to do the same. Warning: There is a law against precenting workers from speaking about "unfair work practices" but, that doesn't mean the employer won't be able to shaft you if they are aware that you are speaking to co-workers about the journals. So just beware!
