Both of my daughters were molested by there step father (the man i was married to).We just had the first trial 3/7/00. Because of unpreparedness of the DA's office I feel that we lost the case. I don't feel that this was handled properly from the beginning starting with children & youth. How can I have the conduct in this case looked at? What can you do about a jury in this case that was reported by a tipster that they were in the deliberation room laughing and joking and came back with a not guilty verdict in 10 minutes. My daughters nightmare is not a laughing matter. HELP!!!!!!

If there was a not guilty verdict in this case then all legal remedies are final, unless you can prove there was jury misconduct. Contact the DA who handled the case and inform them of the information you have. They will make a determination if there are adequate legal grounds to go forward with an investigation of jury misconduct.
Regarding the conduct of the DA who prosecuted your case, you can always write a letter of complaint to the elected District Attorney's attention and have victim advocate groups write letters on your behalf. That will not, however, change the result of the trial.
I understand that the legal system can be a frustrating and harsh. Your experience was very unfortunate and you have my sympathies.
Best of luck in your future endeavors.

Thank you for your response. unfortunately the outcome of the trial was a not guilty verdict. As far as going to the DA for help on this one. I did and he reassured me that he has given us a fine lawyer. He's very arrogant and non caring. He does not like me for the fact that I have met with him twice and told him exactly how I feel about how his office has conducted themselves poorly from the begining of this matter. He will no longer meet with me. Who can I go to over his head? I live in a small town where the local Governing people all play golf together and owe each other favors. When I told my daughters' lawyer to stand up to judge Seaman's about what was right he just gave me the look of "yeah right!" I don't know what else to do but I have to fight for justice for my daughters. Can you point me in the right direction? I want judge Seamans to answer for some of his decisions as well who can help me with that???
Sincerely, kandi Kelley

It is sometimes difficult to find justice in the court system. Yours is one of many stories I have been told and personal experiences I have had within it. The only people who might change anything would be victim advocate groups or the media, although the outcome of the case will likely not change unless there was proven to be jury misconduct. Check for an advocate group for child molest victims in your state and ask for advice. They may have deal with the same or similar problems in your area and have ideas how to approach this.
Best of luck.
