Do the courts even knowing this person is viloent and has a history still allow the father to get the children. He has an order to not drink/or possess alchol when he has Zach. He has so far everytime and twice has fallen off a horse due to the drinking. Do they just continue to win even after I am out of the situation. I am now scared for my son now that I am not there to watch him. Plus he has a girlfriend that has already shaken Zach by the shoulders

Obviously, I don't know the full facts of your case. Was the father awarded full custody, or does he just have part-time visitation rights?
You are rightly concerned given the circumstances you describe. You need to document every date/time and occurrence of inappropriate behavior by your ex-husband. If there are witnesses who can corroborate what has occurred, get statements from them. Also, if your ex appears to have been drinking when there are custody exchanges and it is a frequent occurrence, have an uninterested witness present, even a police officer or family court services person to verify his conduct. If you have an attorney, take the evidence to him/her. You could return to court to seek supervised visitation only by the father. That he has continually violated an order of the court should be brought to the ordering court's attention immediately.
