Overheard in "The Cellar," a restaurant in David Chodos' (Simke Chodos firm) building. A group of lawyers over lunch were overheard expressing their outrage at Cipriano changing sides and telling the truth. "How dare he change sides!" Also a topic of discussion of among many other groups of lawyers around LA.

Settlement discussions in the Pattinson case have fallen apart.
Berry has been appointed special counsel to Pattinson's bankruptcy trustee over the incredulous shouts of Moxon. Continuing with the travails of Moxon, he now to decide whether to file a correct verification in the Hutado case. His usual pattern is to file incorrect verification. He now has to decide whether to subject Hutado to a perjury prosecution by having improperly verified the Hutado complaint something any lawyer without a conflict of interest (representing both CoS and Hutado) would advise Hutado not to do.
(In case you wonder, Hutado has made false claims of abuses at the hands of Berry.)
Moxon had another down stat yesterday when he and Ava Paquett arrived to take the deposition of one of Berry's legal assistants, the legal assistant and his attorney arrived for the 9:30am depo and when neither, Moxon., Paquett or the Court reporter showed up by 9:30, they left. leaving Moxon and Paquett astonished when they arrived 5 minutes later. Moxon continued to scream at the assistant's attorney today and DM and Rinder are proably still screaming at Moxon and Paquett.
The JS depo (another of Berry's legal assistants) did not proceed today. There Moxon is trying to obtain all of JS's financial records which have nothing to do with Berry and which Bank of America says will take 12 months and 50k to produce.
The third day of Berry's 2004 (bankruptcy) examination has been postponed from this Friday to the 29th.
Berry has told them they get one more day and that's it. Scientology has cost Berry $8k for copying and legal fees because of their antics in a no asset bankruptcy.
Meanwhile Berry now has Ingram as counter defendant in the Hutado case, along with Hutado for abuses of process. (going back to 1994)
And he has Moxon as counter defendant in Moxon's clam for sanctions arising out of the Pattinson case for abuses of process going back to 1993.
A prudent lawyer would have stopped going after Berry at the bankruptcy courthouse door.
Instead, Miscavige and Rinder going with their usual footbullet style have taken a Trogen horse in the Bankruptcy court--- where the FBI maintains a special unit to pursue fraudulent creditors and debtors alike.
