I do not know how much this will help, or if it will help at all, or if it will even cause harm. However, I could not continue to do nothing in the face of this outrageous conduct by the Scientology cult.
Here is the email I sent. (It included as an attachment the copy of the Wager deposition posted to alt.religion.scientology by unknown parties.) I did not go heavily into legal arguments, just making sure that people are watching and they care.
I wish you the best of luck in all this, though I suspect you will need more than luck here. What you will need is at least one honest member of the Bar Association to stand up to these criminals and crooks.
I send my deepest regards. Thanks for fighting these criminals even at such a deep personal cost.
To Whom It May Concern:
The public watches with a great deal of interest in the upcoming proceedings against Graham Berry. In a case where the adverse party confessed to perjury and to having been paid for the production of a perjurious declaration, as well as to intimidation and posing as a police officer by Church of Scientology operative Eugene Martin Ingram, and despite the opposition to this activity by the party himself (Robert Cipriano), somehow Graham Berry himself was found to be a "vexatious litigant" for having sought judicial relief for libel and sworn falsification (perjury) to the effect that he is a pedophile. This sort of libel is frankly the most scurrilous and outrageous and unforgivable kind of libel as it can lead if believed to immediate social, personal and career demise, which damages have in fact occurred.
In the attached deposition transcript in Hurtado v. Berry, Scientology counsel Donald Wager, Esq. admits to suborning perjury.
Despite this damning and obvious evidence, which is certain to be featured even more broadly in public media with wide dissemination to the public, I hear that the nearly-catatonic State Bar of California, which has distinguished itself by years of inaction in even the grossest cases of attorney misconduct, including misconduct by the very attorneys now complaining against Berry, this very bar association is suddenly rewarding this series of vast and outrageous criminal and tortious activities carried out over years by proceeding with deliberations against Berry on the behalf of this bizarre cult which has been repeatedly sanctioned by courts around the globe for conduct such as this in cases which include Allard v. Church of Scientology, Wollersheim v. Church of Scientology of California, and Wollersheim v. Church of Scientology, and others too numerous to include in their entirety.
I assure you who read this that while these shenanigans have been going on in back rooms for years now, that those who participate in them now will certainly face the light of public scrutiny. It would be nice to believe that lawyers and state bars can be trusted to behave ethically without increased public scrutiny and the bright light of media attention, but be assured that, if not now, you will certainly face the music and the court of public opinion in any decisions you render shortly.
Attached is the deposition of Donald Wager, Esq. which has been posted by an anonymous party to the newsgroup alt.religion.scientology and which will be the matter of much future discussion.
Thank you for your kind and thoughtful attention to these matters in your deliberations, which are a matter of great public concern and which are being watched very closely by tens of thousands of people on the Internet and around the world. Your actions in the coming days will be scrutinized in minute detail, and I hope your behavior is a credit to your profession.
