Dear Friends:
Yesterday afternoon an Early Neutral Evaluation Conference was held in the Matter of the State Bar v. Graham Berry (SB # 128503) arising from the joint complaint of scientology attorneys Michael Gerner and Donald Wager. In essence, the allegations are that: (1) in filing the Berry v. Cipriano/Barton/Miscavige (Ingram/Moxon/Abelson) and Pattinson v. Church of Scientology cases I was maintaining "unjust actions"; (2) I paid some client costs from my business account instead of my trust account; (3) I disobeyed court orders by not paying the costs and sanctions orders in Pattinson, Barton, Jeavons and another case (despite my bankruptcy); (4) I tried to shield personal money for on-going business expenses from levy by Barton. The State Bar Court's Supervising Judge, Michael D. Marcus, considered the draft State Bar eleven-count-complaint to be factually and legally flawed. Indeed, he described two counts as being "theoretical " [which adds to the widespread speculation that scientology attorneys actually drafted the State Bar's Draft Complaint]. However, the judge thought there were still matters to which I needed to provide further response. Accordingly, I am to provide additional evidence and explanation and appear at a further hearing on April 30, 2001.
I want to thank everyone who has taken the time and effort to write, fax or email the President and Executive Directors of the State Bar supporting my Request For an immediate State Bar public inquiry into the conduct of the various Church of Scientology attorneys within its jurisdiction who have been involved in all of the wrongful attorney conduct now before the Bar in the various matters involving me, back as far as 1994, and later involving Keith Henson as well. The evidence being presented to the State Bar should also include evidence in connection with the Mark Bunker, Jesse Prince, Bob Minton, Dennis Erlich, Grady Ward, Arnie Lerma, FactNet, Wollersheim, Tom Klemesrud, Casey Hill, Lopez, and other cases. In addition to it being a public inquiry, the investigation of these matters should be conducted before a three-judge panel (perhaps a panel of retired judges). There is precedent in the form of the Clearwater Hearings and various investigations of the Church of Scientology in both Western and Eastern Europe as well as in Africa, Australia and New Zealand.
NEVERTHELESS, FURTHER HELP IS BADLY AND URGENTLY NEEDED.
I ask every reader of this letter to write, fax and/or email the State Bar and express strong support for Graham Berry's Request For an immediate State Bar public inquiry into the conduct of the various Church of Scientology attorneys, within its jurisdiction, who have been involved in all of the wrongful attorney conduct now before it in the various matters involving Graham Berry and Keith Henson back as far as 1994, It should also include the evidence in connection with the Mark Bunker, Jesse Prince, Bob Minton, Dennis Erlich, Grady Ward, Arnie Lerma, Factnet, Wollersheim, Tom Klemesrud, Casey Hill, Lopez and other similar cases.
YOU'VE GOT YOURSELF IN A CAUSE ---
This afternoon, Judge Marcus commented that I had gotten myself involved in a cause which was dragging me down in a spiral ("The dwindling spiral" a frequent scientology metaphor, although inadvertently used here no doubt!). Perhaps, but from my perspective I am the victim of an on-going RICO conspiracy involving at least three generously paid national law firms, some smaller law firms, some sole legal practitioners and a group of the scientology enterprise in-house lawyers. The conspiracy involves the intentional commission of serious crimes, torts and ethical breaches for the purposes of, among other things, interfering with constitional, civil and human rights; interfering with the representation of clients; interfering with the administration of justice and committing frauds upon every court in which an adversary seeks justice. We can now prove this conspiracy. The evidence comes from a number of different cases/litigants. To name only a few: Berry; Pattinson; Henson; Bunker; Prince; Minton; CAN Bankruptcy/Jason Scott; The Estate of L. Ron Hubbard; Lerma; Ward; Erlich; Klemesrud; Factnet; Penny; Wollersheim; Mayo; Fishman/Geertz; Jordan; Yanny; Armstrong; Cooper; Lopez; Jeavons; McPherson; Corydon; Friend, etc.
Clearly, in the ordinary course, the scientology attorneys believe that they are able to act with criminal, tortious and ethical impunity. A State Bar public investigation of those very same attorneys will reassure the public that this time those scientology attorneys cannot covertly and criminally interfere with the legal and judicial process. Once the State Bar openly receives the evidence they must act. They are under obligation to take it right into a grand jury room where the scientology lawyers are still prevented from interfering with the system until after an indictment.
